Oahe Dam Hydraulic Steel Structure (HSS) Nondestructive Testing

1.0 General Information: This is a GSA purchase contract (under FAR Part 8) contract to provide Non-Destructive Testing (NDT) in accordance with ANSI/AWS D1.1 Structural Welding Code – Steel (2020) to determine if any surface cracks exist in tested welds or base metal for the Omaha District Army Corps of Engineers. The Government shall not exercise any supervision or control over the contract service providers performing the services herein.

Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Background.

1.1.1 Oahe Dam is located on the Missouri River near the town of Pierre, South Dakota. Structures to be inspected are located on the intake structure upstream of the. Structures requiring nondestructive testing include eight intake bulkheads that are 24’-7” tall x 19’-1” wide x 2’-2” deep.

The intake bulkheads are used for dewatering (with personnel behind them) and consist of horizontal built-up girders, with multiple upstream compression flanges and a downstream tension skin plate. The tension skin plates are considered fracture critical, as are any members or welds within 12” of the skin plates. These steel structures were fabricated in the late 1950s and early 1960s.

1.2 Scope of Work. This is a GSA purchase contract (under FAR Part 8) to provide nondestructive testing on Oahe Dam hydraulic steel structures. Nondestructive testing shall be performed whether or not welds meet visual inspection criteria. The government will provide access to the structures requiring nondestructive testing. The contractor is responsible for providing their own safety equipment mentioned in Part 4 of this PWS. Specific items and areas to be nondestructively tested are as listed below. Additional items to be investigated with magnetic particle or dye penetrant testing may be identified by the Government during the inspection, as long as such additional work does not require the inspection to extend beyond the specified duration. Unless noted otherwise, all testing will be performed over existing paint. In some areas, the contractor may be required to perform some light cleaning, brushing, and/or scraping to prepare surfaces for testing. It is anticipated that all on-site work required in this PWS will be completed by one NDT technician within the specified inspection duration.

Intake Bulkheads Magnetic particle testing:

All welds within 12” of the downstream skin plate and base metal within 3” of those welds All welds connecting lifting plates to the bulkhead and base metal within 3” of those welds All accessible surfaces of painted magnetic steel lifting pins and shackles Areas within 3” of lifting pin bearing locations on lifting plates

Dye penetrant testing:

All accessible surfaces of unpainted lifting pins and shackles

The Contractor will provide all Non-Destructive Testing Equipment and will: 1) coordinate with the COR to schedule the inspection; 2) inspect the identified members using the prescribed NDT method in accordance with AWS D1.1; 3) bring any indications or defects to the attention of the Government at the time of inspection and fully document all indications and defects including defect location, length, width, orientation, extent, and type as much as possible. 4) create a written stand-alone report fully documenting the members inspected, method of NDT used, and results including detailed information about any indications or defects discovered.

1.3 Period of Performance: Non-Destructive Testing work at Oahe Dam shall occur June 5-9, 2023. The NDT report shall be submitted within 30 calendar days of completing the inspection. If Government review comments require any revisions to the report, the corrected report shall be submitted with 15 calendar days of receiving Government comments.

1.4 Contractor Bids: Contractor shall submit for approval a bid on the following work items:

1.4.1 Travel-related expenses for personnel to reach project site.

1.4.2 Daily rate for employee costs, to include per diem, fuel costs and any additional Contractor expenses during the inspection.

1.4.3 Preparation of the written report.

1.5 Quality Control

1.5.1 The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS.

1.5.2 The Contracting Officer reserves the right to disapprove any individual whom he considers incompetent to perform the work required. The Contracting Officer will provide a written notice of any disapproval to the contractor.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.1 The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.

1.6.2 If any of the services do not conform to contract requirements, the government may require the contractor to perform the services in conformity with contract requirements and at no increase in cost. If the contract requirements are not met after a second attempt the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.

1.6.2.1 Upon verification of a validated customer complaint or corrective action report, the COR will notify the contractor that they are required to re-perform specific services within one business day of notification.

1.6.3 The government may take action, if the contractor fails to perform the services again or to take the necessary action to ensure future performance is in conformity with the contract requirements. The government may (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that related to the performance of such service or (2) terminate the contract in whole or in part

1.6.4 The contractor is responsible to replace/repair any damage to government property due to negligence, at his or her own cost. The government may take action, if the contractor fails to replace/repair any damage to government property. The government may (1) by contract, or otherwise, replace/repair damaged government property and charge to the contractor any cost incurred by the government to replace/repair any damage or (2) make a determination to not exercise any future option periods on the contract.

1.7 Hours of Operation. The contractor is responsible for conducting business between the hours of 0730 - 1700 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Access to USACE Projects is controlled and access is restricted. Contractor personnel that are non-US citizen can require up to 4 weeks to be approved for site access. Coordinate access to the site through the COR. The Contractor must maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.8 Pre-Inspection/Out-Briefing Meeting: The Contractor agrees to attend any pre-inspection or out-briefing meetings within the specified inspection duration. These meeting will be held at the Corps Project Office. At the pre-inspection meeting the inspectors from Design Branch, Structural Section, will review the structural members to be inspected, the inspection schedule, hours, procedures, and safety plan. The Contractor will coordinate access with the Project. At the out-briefing, the Contractor and Government inspectors will report any significant preliminary findings to the Project Representative.

1.9 Standards and Regulations. The Contractor shall perform to the standards in the contract and comply with all Local, State, and Federal Regulations during the services performed. The Contractor is responsible for ascertaining the extent to which these regulations affect the operations resulting from this contract. The Contractor shall comply will all applicable regulations. Please reference the specifications for specific standard and regulations requirements.

1.9.1 Activity Hazard Analysis (AHA). Contractor shall prepare AHAs IAW Paragraph 01.A.14 or 01.A.15 of the EM 385-1-1. If using Paragraph 01.A.15, prepare AHAs IAW Figure 1-2. Submit the AHA electronically for review at least five (5) calendar days prior to the start of on-site work. The analysis should be used during daily inspections to ensure the implementation and effectiveness of the activity's safety and health controls. The Activity Hazard Analysis Template will be provided. An electronic copy of the AHA may be downloaded from the following site.

Note: Contractors and other individual employers typically use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools. These documents are considered equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA, commensurate with the type of services being performed.

1.9.2 Abbreviated Accident Prevention Plan (APP). EM 385-1-1 in its entirety may be too complex for the type of work performed under these contracts; Contractors may reference Appendix A, for abbreviated Accident Prevention Plan (APP). The contractor shall only need to submit items in Appendix A that are pertinent to the contract. The contractor shall use a qualified person to prepare the site-specific Abbreviated Accident Prevention Plan (AAPP).

Prepare the AAPP in accordance with the format and requirements of the EM 385-1-1 and supplemented herein. The Contractor shall sign and submit the APP for Government approval prior to the start of work onsite.

1.9.3 Safety Equipment. The following is a list of minimal safety equipment the Contractor is expected to supply.

The safety equipment shall meet the requirements in EM385-1-1: Steel Toe Boots, Hard Hat, Safety Glasses, Fall Protection Harness, Safety Vest, and Hearing Protection.

1.10 Physical Security

1.10.1 The Contractor shall be responsible for safeguarding all Government facilities, property, and materials provided for Contractor use. The Contractor shall secure at all times all Government facilities, property, and materials. Specific security conditions may change based on threats to national defense, and based on the risk of specific facilities to these threats. The Contractor shall abide by these changing conditions at all times.

1.11 Antiterrorism/Operation Security Requirements

1.11.1 Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or Security Office.

Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

1.11.1.1 For contractors who do not require Common Access Card (CAC), but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

1.11.2 Pre-screen candidates using E-Verify Program. The Contractor must pre‐screen candidates using the E‐ verify Program (http://www.dhs.gov/E‐Verify) website to meet the established employment eligibility requirements.

The vendor must ensure that the candidate has two valid forms of government issued identification to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the COR no later than three (3) business days after the initial contract award.

1.12 Payment

1.12.1 The government will make payment after services have been inspected and accepted, and the contractor’s invoice has been reviewed, approved, and processed. The contractor shall submit the invoice to the COR and/or any other person that has been designated in the contract to receive the invoice.

1.12.2 The contractor must provide the contractor’s name, address, contract number, period of services completed, CLIN number and total requested, for an invoice to be considered proper. The contractor shall submit the invoice for services completed upon completion of all services, in accordance with the period of performance stated in the

CLIN.

2.0 Definitions. The following definitions and descriptions apply wherever the word(s) or phrase(s) is/are stated in this PWS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER: A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE: A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE: Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY: The number of hours per day the Contractor provides services in accordance with the contract.

2.1.12. WORK WEEK: Monday through Friday, unless specified otherwise.

3.0 Government Furnished Items and Services

3.1 Materials. The Government will provide:

3.2 Facilities (If applicable): The Government will provide the necessary workspace for the contractor staff to provide the support outlined in the PWS to include office space for pre-inspection and out-briefing meetings.

3.4 Equipment: The Government (Corps) will provide any equipment necessary to access structures.

3.5 Materials (If applicable): N/A

4.0 Contractor Furnished Items and Responsibilities

4.1 General: The Contractor shall furnish all supplies, equipment, and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Secret Facility Clearance: N/A.

4.3. Materials (If applicable). The Contractor shall provide personal safety devices such as hardhats, fall protection harness, steel-toed boots, safety goggles and hearing protection as required. The contractor shall also provide any miscellaneous supplies necessary for inspection such as flashlights and any materials required to perform the NDT.

4.4. Equipment (If applicable). The Contractor shall furnish any NDT equipment required.

5.0 Specific Tasks

5.1 Basic Services. The contractor shall provide the basic services summarized below. See the project Specifications and Drawings for more specific requirements.

5.1.1 Review all Government provided materials.

5.1.2 Coordinate with the COR to schedule the inspection.

5.1.3 Inspect structures using the specified NDT methods in accordance with AWS D1.1.

5.1.4 Bring any indications or defects to the attention of the Government at the time of inspection and fully document all indications and defects including defect location, length, width, thickness, depth, orientation, extent, and type as much as possible.

5.1.5. Create a written stand-alone report fully documenting the members inspected, method of NDT used, and results including detailed information about any indications or defects discovered.

5.2 Personnel Qualifications. All persons conducting magnetic particle tests, dye penetrant tests, or ultrasound tests are required to be certified to the provisions of ANSI/ASNT CP-189, and all Non-Destructive Testing (NDT) technicians shall be qualified in accordance with this standard to Level II or III for each applicable method. Submit inspector qualifications.

5.3 Access. The government will provide access to all structures requiring testing.

6. APPLICABLE PUBLICATIONS (CURRENT EDITIONS)

6.0. The Contractor shall perform all work in accordance with U.S. Army Corps of Engineers Safety and Health Requirements Manual EM 385-1-1 (30 November 2014).

6.1 Performance Requirements Summary. The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984)

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
