PERFORMANCE WORK STATEMENT

PERFORMANCE WORK

STATEMENT (PWS)

Tree Planting in Council Bluffs, Iowa

1.0 General Information.

1.1 Background. Trees will be planted at a site on the Missouri River in Council Bluffs as a mitigation requirement for the MO River LB & Indian Creek RB Levee Rehabilitation Project.

1.2 Scope of Work. This is a non-personal services contract to plant 66 trees at a designated location on the Missouri River in Council Bluffs (see Attachment 2). Work includes providing trees, planting, staking, guying, and installation of no less than 66 stems. Trees shall be watered and maintained through the plant establishment period (see Attachment 1). This is a fixed price, performance-based acquisition where the government defines and measures desired outcomes, while contractor methods are generally not constrained or directed.

1.3 Period of Performance. The period of performance shall be 15 months from date of award.

This includes a 12 month maintenance and watering period.

1.4 Contractor Personnel

1.4.1 The contractor shall perform all work under this contract using his or her own forces except as provided in Paragraph 1.4.2 Subcontracting. Employees who perform this work shall be qualified persons on the contractor’s own payroll.

1.4.2 Subcontracting. The contractor shall not subcontract any work without written approval of the Contracting Officer. Compliance with the provisions of this contract by subcontractors shall be the responsibility of the contractor.

1.5 Quality Control

1.5.1 The contractor shall designate, in writing, an employee who shall serve as the contact for matters involving quality and performance or nonperformance of the required work stated in this PWS. The employee(s) shall be qualified and fully competent with full authority to act for, and on behalf of, the contractor as necessary to ensure that the required work is performed in accordance with the standards contained herein. The contractor shall furnish the above written designation to the COR no later than the first day of work. The contractor shall include the name(s), address(s), and telephone number(s) of the responsible individual(s).

1.5.2 The Contracting Officer reserves the right to disapprove any individual whom he considers incompetent to perform the work required. The Contracting Officer will provide a written notice of any disapproval to the contractor.

1.6 Quality Assurance. The government will use a Quality Assurance Surveillance Plan (QASP) to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government may use Quality Assurance Evaluators (QAE(s)) to provide assistance with the quality assurance methods.

1.6.1 See Attachment 1. The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.

1.6.2 If any of the services do not conform to contract requirements, the government may require the contractor to perform the services in conformity with contract requirements and at no increase in cost.

If the contract requirements are not met after a second attempt the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.

1.6.3 Upon verification of a validated customer complaint or corrective action report, the COR will notify the contractor that they are required to re-perform specific services.

1.6.4 The government may take action, if the contractor fails to perform the services again or to take the necessary action to ensure future performance is in conformity with the contract requirements. The government may (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that related to the performance of such service or (2) terminate the contract in whole or in part.

1.6.5 The contractor is responsible to replace/repair any damage to government property due to negligence, at his or her own cost. The government may take action, if the contractor fails to replace/repair any damage to government property. The government may (1) by contract, or otherwise, replace/repair damaged government property and charge to the contractor any cost incurred by the government to replace/repair any damage.

1.7 Access. The contractor shall coordinate with COR to gain access to site via gated roads.

1.8 Pre-Work Meeting. Prior to commencing any activities, the contractor shall arrange a Pre-work Meeting with the COR. The Meeting shall discuss the work requirements, scheduling, submittal process, review of the Activity Hazard Analysis (AHA), and Abbreviated Accident Prevention Plan (AAP). At least one (1) week prior to commencing work, the Contractor shall coordinate their proposed work schedule with the COR.

1.9. Submittals. Prior to commencement of services, the Contractor shall submit the following documents to the COR for review and approval:

a. Activity Hazard Analysis (AHA)

b. Abbreviated Accident Prevention Plan (APP)

c. Proof of Insurance for Contractors and Subcontractors

d. Submittal requirements in Attachment 1

Provide tree, planting, staking, guying, and installation of no less than 66 stems as identified in 2.1.6.

3.2 APPLICATION OF HERBICIDE

When application of an herbicide becomes necessary to remove a pest or disease, an herbicide treatment plan shall be submitted and coordinated with the Contracting Officer's Representative.

Refer to all applicable paragraphs of this specification.

A state certified applicator shall apply required herbicide in accordance with EPA label restrictions and recommendations.

Clothing and personal protective equipment shall be used as specified on the herbicide label. A closed system is recommended as it prevents the herbicide from coming into contact with the applicator or other persons. Filling hoses shall be fitted with a backflow preventer meeting local plumbing codes or standards.

Overflow shall be prevented during the filling operation. Prior to each day of use, the equipment used for applying herbicide shall be inspected for leaks, clogging, wear, or damage. Any repairs are to be performed immediately. Contractor shall consult with Contracting Officer's Representative when wind speeds reach 7 mph or greater.

3.3 PREPARATION

3.3.1 Layout

Stake out approved plant material locations and planter bed outlines on the project site before digging plant pits or beds.

The Contracting Officer reserves the right to adjust plant material locations to meet field conditions. Plant tree species randomly. Do not plant in rows. Plant trees 8 to 16 feet apart. Do not plant closer than 8 feet to the edge of the road.

Do not plant closer than 15 feet to the riverside levee toe. Do not plant closer than 8 feet to existing trees.

3.3.2 Soil Preparation

3.3.2.1 Fertilizer Application Rates

Apply fertilizer at rates recommended by a nursery or arborist.

3.4 PLANT BED PREPARATION

Verify location of underground utilities prior to excavation.

Protect existing adjacent turf before excavations are made.

Where planting beds occur in existing turf areas, remove turf to a depth that will ensure removal of entire root system. Measure depth of plant pits from finished grade. Depth of plant pit excavation must be as indicated and provide proper relation between top of root ball and finished grade. Install plant material as specified in paragraph PLANT INSTALLATION. Do not install trees within 10 feet of any utility lines or building walls.

3.5 PLANT INSTALLATION

3.5.1 Individual Plant Pit Excavation

Excavate pits at least twice as large in diameter as the size of ball or container to depth shown.

3.5.2 Handling and Setting

Move plant materials only by supporting the root ball. Set plants on hand compacted layer of prepared backfill soil mixture 6 inches thick and hold plumb in the center of the pit until soil has been tamped firmly around root ball. Set plant materials, in relation to surrounding finish grade, one to 2 inches above depth at which they were grown in the nursery, collecting field or container. Replace plant material whose root balls are cracked or damaged either before or during the planting process.

Plant material must be set in plant beds according to the drawings. Backfill soil mixture must be placed on previously scarified subsoil to completely surround the root balls, and must be brought to a smooth and even surface, blending to existing areas.

3.5.2.1 Balled and Burlapped Stock

Backfill with prepared soil mixture to approximately half the depth of ball and then tamp and water. Carefully remove or fold back excess burlap and tying materials from the top a minimum 1/3 depth from the top of the rootball. Tamp and complete backfill, place mulch topdressing, and water. Remove wires and non-biodegradable materials from plant pit prior to backfill operations.

3.5.2.2 Bare-Root Stock

Plant so roots are arranged in a natural position. Place roots in water a minimum of 30 minutes prior to planting. Carefully work prepared soil mixture among roots. Tamp remainder of backfill, place mulch topdressing and water.

3.5.2.3 Container Grown Stock

Remove from container and prevent damage to plant or root system.

3.5.3 Earth Mounded Watering Basin for Individual Plant Pits

Form with topsoil around each plant by placing a mound of topsoil around the edge of each plant pit. Watering basins must be 6 inches deep for trees and 4 inches deep for shrubs.

Construct watering basin in a 4-1/2 foot diameter circle around specimen (not planted in a close group) trees and shrubs.

3.5.4 Tree Wrapping and Protection

Wrapping material shall be horticulturally approved waterproof wrapping paper. Wrapping shall be applied from the base of the tree to the second branch and secured with tape. Wrapping shall be done in the fall months prior to freeze and removed in the spring. It shall be the Contractor's responsibility to ensure wrapping does not remain on the trees in the summer months. In addition, each tree shall be surrounded by a hoop of metal mesh or hardware cloth staked or anchored at ground level, 4 feet high and 1 foot in diameter, for protection from beavers.

3.5.5 Weed Control Barrier

Weed control barrier shall be installed around each planting to prevent competition with other plants and weeds. An approximately 3 foot square piece of weed control barrier shall be cut and secured with landscape staples around each tree and shrub.

3.5.6 Tree and Shrub Caging

All containerized trees and shrubs 5 gallon size and under shall be caged with hardware cloth to prevent small mammal herbivory.

Hardware cloth shall be 1/8 11 to 1/4 11 size openings. Each planting shall be surrounded by a hoop of hardware cloth be cut to one foot (1') high and enough length to completely circle the base of the plant with space allowing for two to three years of growth. Caging shall be secured to the ground with landscape staples and hardware cloth shall be secured above ground with zip ties or cable ties.

3.5.7 Erosion Control Material

Install in accordance with manufacturer's instructions.

3.5.8 Mulch Topdressing

Provide mulch topdressing over entire planter bed surfaces and individual plant surfaces including earth mound watering basin around plants to a depth of 3 inches after completion of plant installation and before watering. Keep mulch out of the crowns of shrubs. Place mulch a minimum 2 to 3 inches away from trunk of shrub or tree. Place on top of any weed control fabric.

3.5.9 Watering

Start watering areas planted as required by temperature and wind conditions. Apply water at a rate sufficient to ensure thorough wetting of soil to a depth of 12 inches without run off.

3.5.10 Staking and Guying

3.5.10.1 Staking

Stake plants with the number of stakes indicated complete with double strand of 12 gage guy wire as detailed. Attach guy wire half the tree height but not more than 5 feet high. Drive stakes to a depth of 2- 1/2 to 3 feet into the ground outside the plant pit. Do not injure the root ball.

Use hose chafer guards where guy wire comes in contact with tree trunk.

3.5.10.2 Guying

Guy plants as indicated. Attach two strands of guying wire around the tree trunk at an angle of 45 degrees at approximately 1/2 of the trunk height. Protect tree trunks with chafing guards where guying wire contacts the tree trunk. Anchor guys to wood ground stakes. Fasten flags to each guying wire approximately 2/3 of the distance up from ground level.

3.5.10.3 Chafing Guards

Use hose chafing guards, as specified where guy wire will contact the plant.

3.5.10.4 Wood Ground Stakes

Drive wood ground stakes into firm ground outside of plant pit with top of stake flush with ground. Place equal distance from tree trunk and around the plant pit.

3.5.10.5 Flags

Securely fasten flags on each guy wire approximately two-thirds of the distance up from ground level.

3.5.11 Pruning

Prune in accordance with safety requirement of TCIA Z133.

3.5.11.1 Trees and Shrubs

Remove dead and broken branches. Prune to correct structural defects only. Retain typical growth shape of individual plants with as much height and spread as practical. Do not cut central leader on trees. Make cuts with sharp instruments. Do not flush cut with trunk or adjacent branches.

Collars must remain in place. Pruning must be accomplished by trained and experienced personnel and must be accordance with

TCIA A300P1.

3.5.11.2 Wound Dressing

Do not apply tree wound dressing to cuts.

3.6 MAINTENANCE DURING PLANTING OPERATION

Installed plant material shall be maintained in a healthy growing condition. Maintenance operations shall begin immediately after each plant is installed to prevent desiccation and shall continue until the plant establishment period ends.

Installed areas shall be kept free of weeds, grass, and other undesired vegetation. The maintenance includes watering, adjusting settling, and maintaining staking materials. All staking materials removed after two growing seasons or as directed by the Contracting Officer's Representative.

3.7 RESTORATION AND CLEAN UP

3.7.1 Restoration

Turf areas, pavements and facilities that have been damaged from the planting operation must be restored to original condition at the Contractor's expense.
