1. Firm Fixed Pricing Task Orders

1.1 Binding Capped Hourly Labor Rates

The binding capped labor rates for this contract shall be provided by the Offeror in Table 1 (to also be completed in the excel spreadsheet provided along with the formula(s) or calculations used to burden the labor rates). The amount to be paid to the contractor for each firm-fixed price task order shall not exceed the “maximum” hourly rates proposed by the contractor for the labor disciplines listed in Table 1, “Binding Labor Rates.” The fully burdened labor rates provided in Table 1 will also be used for negotiation of task order modifications.

1.1.1 The capped hourly rates provided on Table 1 shall be “Fully Burdened,” i.e., shall include Overhead (OH), General/Administrative (G&A), Labor Burden Fringes, and any other indirect costs exclusive of profit.

1.1.2 Labor rates used in formulating task order proposals shall not exceed the capped labor rates as of the date of task order requirement.

1.1.3 The Offeror shall indicate for each discipline whether it is employed by the prime or a subcontractor by annotating PRIME or SUB next to the discipline in the first column. For example, “CADD Operator (SUB)”.

The rates shown per labor discipline shall be fully burdened rates, exclusive of profit for the prime contractor or joint venture.

1.1.4 The hourly burdened labor rates proposed in the Binding Capped Labor Rate Schedule are binding upon contract award for the life of the MATOC, to include all option periods and extensions. These rates are applicable to both task orders and modifications.

1.1.5 If a discipline is not listed in the contract rate pricing schedule and is required for the contractor to perform a specific task order, the contractor may propose the required labor category and provide the direct and indirect costs which formulate the fully burdened labor rate (exclusive of profit for the prime contractor or joint venture) in the proposal submitted in response to the issued Request for Task Order Proposal (RTOP).

1.1.6 If during the Contract Period of Performance, the Offeror’s original key personnel (prime or subcontracted) are no longer available, the Offeror shall replace these individuals with personnel whom, at a minimum, have the same qualifications as the personnel being replaced. The Offeror shall be responsible for negotiating labor rates for those personnel that do not exceed the rates provided in Table 1, which are the maximum rates the Government will pay for any personnel. The Contractor shall submit the replacement personnel’s qualifications to the Contracting Officer for approval.

1.1.7 The applicable capped labor rates shall be governed by the effective date of the Task Order. Task Orders will use the prices for the 12-month period effective on the date the Task Order is issued. Modifications to Task Orders will reflect the rates of the “current 12-month” binding labor rate schedule. For example, if the rate schedule changes over on 1 November of each year, and a Task Order is issue on 1 September 2020 for 12 months work, the maximum rates will be the rates that were effective on 1 November 2019. Under the same assumptions, if a modification to the Task Order is required in December 2020, the labor rates effective on 1 November 2020 will apply.

1.1.8 The Offeror has the responsibility to provide labor rates that comply with Davis Bacon wage decisions for each labor discipline subject to those wage determinations/wage decisions. The Government will provide the applicable wage determination(s) for the specific geographic location of the task orders in the Request for Task Order Proposal (RTOP).

1.1.9 Provide one (1) rate per labor discipline, regardless of whether the individuals employed for that discipline are directly employed or subcontracted.

1.1.10 Provide Other than Certified Cost or Price Data, which consists of the formula used to arrive at the burdened rates provided in Table 1.

1.2 Firm-Fixed Price Escalation and Maximum Profit

1.2.1 The escalation rate applied to years 2 through 7 shall be provided by the Offeror in Table 2. The listed rate shall be the rate applied to the hourly labor rates in Table 1 for each year.

TABLE 2: Escalation Rate

Period 1 - Period 2

Period 2 - Period 3

Period 3 - Period 4

Period 4 - Period 5

Period 5 - Period 6

Period 6 - Period 7

Period 7 - 6-Month Extension

Profit will be negotiated at the task order level for each Firm-Fixed Price task order but shall not exceed the maximum profit rate provided by the Offeror in Table 3, “Maximum Profit.” The maximum profit shall be binding for the life of the contract, to include all option periods and extensions, and shall be the maximum profit the Contractor will be allowed to propose for all firm-fixed-price task orders and modifications issued under this contract.

1.2.2 The Contractor may propose a lower profit when responding to a RTOP (or subsequent modifications) based on the tasks identified in the request and the risk associated with the project.

1.2.3 The maximum profit on this contract shall be provided by the Offeror in Table 3:

TABLE 3: Maximum Profit

2. Binding Capped Rates for Firm Fixed Task Orders

The Binding Capped Rates represent the maximum Overhead, G&A, or other Indirect rates that the Contractor shall use when responding to a RTOP issued by the Government. The Offeror may use lower rates in proposals, but not higher.

2.1 The Binding Capped Rates shall be the maximum applied OH, G&A and other indirect rates used for the duration of the contract. The Binding Capped Rates will not be adjusted upward as a result of an audit of the contract or the follow-on task orders. For proposals in response to RTOP that require disciplines not included in the Table 1 labor rates, the Contractor should use the actual labor rate(s) paid to the employee(s) for each discipline and apply the applicable indirect rates up to the binding capped rates listed in Table 4. The proposed task order indirect rates will not be adjusted upward as a result of an audit of the contract or the specific task order.

2.2 The Binding Capped Rates for this contract shall be provided by the Offeror in Table 4 along with the applicability of each rate submitted. If a listed category does not apply to the firm, list as “N/A”. Table 4 shall include all indirect cost rates that the firm may use in their proposals in response to the Government’s RTOP. The capped rates provided by the Offeror are binding upon contract award for the life of the MATOC, to include all option periods and extensions. These rates are applicable to both task orders and modifications.

3. Department of Labor Wage Rates

The appropriate Department of Labor Wage Determination/Decision will be provided for individual Task Orders issued against the contract.

4. Travel

The Contractor shall perform all travel and attend all meetings necessary for completion of the work required by the Task Orders. If Per Diem (lodging and MI & E expenses) and transportation expenses are required to perform the Scope of Work, travel costs may be included in the Firm-Fixed-Price proposals for task orders in accordance with the offeror’s accounting practices. The Government will use the Federal Travel Regulation (FTR) as guidance to assist with a reasonableness determination.

The Government reserves the right to include a separate cost reimbursement CLIN in individual RTOP for travel costs. If the separate CLIN is used on a task order, Per Diem (lodging and MI & E expenses) shall be paid at the current Government rates in accordance with the Federal Travel Regulation (FTR) per person per calendar day spent in travel status. No per diem will be paid for travel less than the number of hours per day stated in the current FTR.

Per Diem rate information may be obtained at http://www.defensetravel.dod.mil/. Actual cost of transportation by public conveyance (plane, limited to coach class) shall be paid. Air travel shall (if possible) be planned in advance in order to acquire the best prices available. Privately owned vehicles shall be paid at the current Government mileage rate in accordance with the FTR. The maximum amount paid for an airline ticket shall be the cost of travel via coach class.

5.2. 1. VOLUME 1, TAB 1 – FACTOR 1 – PAST PERFORMANCE

Submission Requirements

5.2.1.1 In this tab, the Offeror shall submit a minimum of two (2), no more than four (4) project examples. The Offeror shall have been the prime contractor or joint venture participants in the construction aspects in each design-bid-build project example submitted, and in the design and construction aspects in each design-build project example submitted.

Project examples should illustrate the types of projects described in Division 01 11 00, Scope of Work. The offeror should present the number of project examples that demonstrate prowess, breadth, and depth of experience as it relates to the scope of work for this requirement. Projects for which the Offeror was a subcontractor or a teaming member of a subcontractor at the time of project execution are not acceptable. Each project example should consist of no more than a two (2) page narrative and should clearly demonstrate the design-build and/or design-bid-build capabilities and experience of the Offeror.

NOTE: If more than four (4) project examples are submitted, only the first four (4) contained in the proposal will be evaluated. If more than a two (2) page narrative per project example is submitted, only the first two (2) pages will be evaluated.

5.2.1.2 Each project example cited shall have a contract (stand-alone contract or single task order) dollar value at award that is $1,000,000 or greater and a Building Occupancy Date (BOD) or date when construction was complete and system was operational within seven (7) years of the date that Phase 1 proposals are due. Indefinite Delivery/Indefinite Quantity (IDIQ) Contracts, where numerous Task Orders are summed to meet the minimum contract dollar value identified herein, are not acceptable.

5.2.1.3 The narrative should include the items below in the following order:

1. Project title

2. Project description

3. Contract number, task order number, or unique customer-assigned identifier

4. Location (include: installation/base/facility, city, state, country)

5. Contract (stand-alone contract or single task order) dollar value at award

6. Final Design Cost

7. Final Construction Cost

8. Notice to proceed date

9. Original construction completion date

10. Actual construction completion date

11. Explanation for any cost or schedule growth

12. Name, address, telephone number, and e-mail address of a representative of the customer or an alternate individual not affiliated with your firm and familiar with your firm’s experience on the project example that can verify the experience cited

13. Briefly explain the relevance of the project example compared to the types of projects stated within this solicitation

5.2.1.4 The Offeror should submit, at a minimum, the past performance ratings for each project the Offeror included in Factor 1 – Previous Experience. Contractor Performance Assessment Reporting System (CPARS) evaluations are preferred. Past Performance Questionnaires (PPQs) are also acceptable (to include those previously completed), as are evaluations in other formats (not CPARS or PPQ) if the evaluation criteria and ratings types are similar to those used in a CPARS and/or a PPQ evaluation, the evaluation includes the same level of detail (or greater) as a CPARS and/or a PPQ evaluation, it is signed by the Customer, and all other RFP requirements are met.

5.2.1.5 If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Contract Specialist, prior to proposal closing date. Offerors shall instruct the clients to refer to the solicitation number in the subject line. PPQs are source selection materials. All successfully submitted PPQs will receive an email confirmation upon receipt. If the offeror does not receive the confirmation, it is the offeror’s responsibility to follow up to ensure the Government has received the information. The Government reserves the right to contact the personnel listed on the PPQ. The inability to validate the information on the PPQ will affect the Government’s evaluation. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror. Narratives must not be more than one (1) page. Narratives do not absolve the offeror of prior performance.

Narratives provide the offeror an opportunity to frame prior poor performance. The Government will review this data and consider its content when reviewing past performance. Narratives are also encouraged for example projects that may be missing requested elements (i.e. nearly complete projects, non-DOD project that still meets all the complexity requirements, etc) explaining to the Government why it should consider the project as a complete submission. The Government reserves the right to subjectively determine the impact of the content of the narrative and how it will impact the ratings.

In the event that a formal past performance evaluation has not been completed via CPARS, or CCASS, the Past Performance Questionnaire (Form PPQ-0, Attachment 1) is provided for the Offeror or its team partners to submit to the client. The PPQ should be completed by an owner or owner’s representative not affiliated with your firm. Ensure correct phone numbers and email addresses are provided for the client point of contact.

5.2.1.6 Completed PPQs shall be submitted with your proposal or to the designated personnel listed below prior to the Phase 1 proposal due date. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the designated Government's point of contacts, via email at ericka.t.collins@usace.army.mil and john.d.hickman@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference previously completed PPQs from other RFPs into their proposal. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation at its own prerogative, nor does it preclude the Offeror from utilizing a previously completed PPQ and submitting into their proposal.

5.2.1.7 Do not submit PPQs for projects evaluated via CPARS or CCASS. In the event an Offeror submits a PPQ for a project for which a CPARS evaluation is available, the CPARS evaluation will be considered authoritative.

5.2.1.8 The Government will assess the past performance on projects submitted under the Factor 1 - Past Performance and reserves the right to conduct telephone interviews with points of contact identified in the proposal.

In addition, the Government may review any other sources of information for evaluating past performance of the Offeror on the submitted projects and any other previous work. Other sources may include, but are not limited to, past performance information retrieved through the CPARS using all Commercial and Government Entity (CAGE)/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror. The Government reserves the right to contact any and all individuals identified in the projects submitted. It is the responsibility of the Offeror to provide current contact information for the individual identified therein. The Offeror may provide additional points of contact (POCs) with the customer (prime contractor, if appropriate). The POC information should include the POC’s title, telephone number and e-mail address. The POCs may be contacted to validate the information provided.

5.2.1.9 The Government intends to assess the relative risks associated with the Offeror's performance based on the past performance information provided in the proposal. A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Government. Therefore, it is incumbent upon the offeror to include all relevant information, including demonstrated corrective actions, in its proposal.

5.2.1.10 In addition, the offeror shall provide a list of CPARS entries they feel are most applicable to this acquisition. The Government will review this list and other CPARS entries. No part of this submission restricts the Government’s rights to review past performance data from other sources, or limits what the Government can review from CPARS.

5.2. 2. Additional Requirements:

5.2. 2.1 General Requirements

The Government will review past performance data for recency and relevancy considering the following work factors.

Offerors are encouraged to highlight their prowess and capabilities in the sample submissions to ensure the Government is aware of the offeror’s capabilities in meeting similar elements of work.
