National Register Testing, Evaluation, and Form Preparation at Big Bend, Fort Randall, and Gavins Point
Project Lands, South Dakota and Nebraska
MARCH 21, 2022
1. General:
This is non-personal services contract to provide cultural resource services on lands currently owned by the U.S.
Army Corps of Engineers (USACE) at Big Bend and Fort Randall Project in South Dakota and Gavins Point Project in Nebraska. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service provider shall be accountable solely to the contractor who, in turn is responsible to the Government. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items to perform the activities defined in this Performance Work Statement (PWS), except for items specified as government-furnished property and services. The contractor shall perform to the standards identified in this PWS.
2. Background:
The purpose of this work is to meet the Department of the Army's federal preservation legislation and associated implementing regulations. The most pertinent for this investigation is Public Law 89-665, National Historic Preservation Act as codified in 54 USC 3001, et seq., implementing regulations 36 CFR Parts 60 and 61 Appendix A; and 36 CFR Part 800, and Army Regulation 200-1 Chapter 6. Persons working under this contract are considered to be carrying out official agency duties under federal direction, associated with the management of archeological resources, and therefore are exempt from obtaining an Antiquities Permit per Section 5(c) of 32 CFR Part 229 - Protection of Archaeological Resources Uniform Regulations.
3. Objectives/Deliverable
The contractor will perform archaeological testing and National Register Evaluation (Phase II Archaeological Investigation) of 27 archaeological sites totaling approximately 101 acres of land belonging to USACE Lake Project Offices, with options for an additional four sites and 44 acres, and produce draft National Register of Historic Places (NRHP) Nomination forms (NPS Form-10-900) for sites recommended eligible for listing to facilitate USACE’s management responsibilities under Sections 106 and 110 of the National Historic Preservation Act (NHPA).
The following deliverables will support the objective:
A) Kick-Off Meeting. Electronic deliverable.
B) Work Plan. Electronic deliverable.
C) Literature Review. Electronic deliverable.
D) Fieldwork. Physical deliverable.
E) Draft Documents, to include draft report, site form updates, draft NPS Form 10-900s, and associated geospatial data. Electronic deliverable.
F) Final Documents, to final report, final site form updates, final draft NPS From 10-900s, and associated electronic files/data and hard copies. Electronic and physical deliverable.
4. Scope:
After award of the contract, the USACE will provide the contractor shapefiles that identify the site locations. The contractor shall perform a Phase II archaeological investigation of 101 acres within 27 sites associated with the base contract and an optional 44 acres within four additional sites associated with the contract option. Two reports shall be produced, one detailing the investigation in South Dakota and one detailing the investigation in Nebraska, each shall conform to the published standards of their respective state. Updated site forms shall be produced for each site and draft NRHP Nomination forms (NPS Form-10-900) shall be produced for all sites recommended eligible for listing.
A) Base and Option
Difficult access locations are not adjacent to public roads and may be best accessed by boat. Some sites are known to have deposits of interest below 50-cm.

B) Deliverables
i) Kick-Off Meeting – Contractor key personnel, excluding crew chief(s), shall meet with USACE via government provided WebEx meeting or other mutually agreed upon video conferencing platform within 10 days of award to discuss invoicing, authorities, and execution of the contracted work. The meeting is expected to take between 30 minutes and an hour, depending on the extent of questions and no travel is authorized.
ii) Work Plan - The draft and final work plan will provide a detailed schedule for the background research, fieldwork, and report preparation. These detailed schedules will have an estimated date for deliverables. In addition to the detailed schedules, the draft and final work plan will have the resumes of personnel assigned to this contract and testing strategy to address the general research questions that might be associated with the sites.
After the award of the contract, the contractor shall have 30 calendar days to complete a draft work plan. The Government will have a maximum of 20 calendar days to review and comment. The Contractor shall have 10 calendar days to correct and submit a final work plan. The Government will have 10 calendar days to review and accept the final work plan. The contractor shall submit the draft and final work plan electronically to the COR.
iii) Literature Review - The contractor shall perform a search of pertinent background literature for the project sites, including but not limited to State Historic Preservation Offices (SHPOs) and USACE Omaha District Office files related to known inventories and cultural resources, to ensure that the contractor is familiar with the previous work conducted in the area and that appropriate historic context has been established prior to testing. Excessive travel for the literature review will not be permitted.
The contractor shall submit a list of all records and documents consulted during the literature review and an overview of research questions and data requirements for evaluating site types that are to be investigated to the COR. The contractor should consider the South Dakota State Plan for Archaeological Resources (Sundstrom 2019) in the establishment of research questions. After fieldwork begins, this initial list can be expanded, if necessary.
iv) Field Work – If human remains are discovered during field work, all work will stop immediately. The contractor shall secure the site and immediately contact the Human Remains Discovery hotline 1-888- 761-2772, as well as the COR and the Project Archeologist. The COR or the Project Archeologist will provide further instructions.
No fieldwork may begin until the USACE accepts a work plan. The contractor shall conduct Phase II archaeological fieldwork in accordance with the accepted field plan. The principle investigator (P.I.)
and/or crew chief(s) shall be present during fieldwork in a quantity sufficient to provide appropriate oversight to all personnel during the field investigation.
The USACE does not ordinarily allow collection of artifacts from cultural resource sites. However, in some circumstances, the collection of artifacts may be necessary. The COR and the Project Archeologist will make these decisions on a case-by-case basis as needed. In the event that an artifact of exceptional importance is encountered the P.I. should contact the COR and Project Archeologist.
With the exception of any artifacts approved for collection, all artifacts identified will be documented in the field and back filled in the same test unit from which they were recovered. Any artifacts approved for collection will be documented and provided to the COR and or the Project Archeologist as soon as practicable. The curation, cataloguing, and storage of approved artifacts is the responsibility of the USACE.
The contractor shall keep clear and legible field records. The contractor shall keep such field records up to date and make them available upon request. These records will include, but are not limited to, field notebooks, field maps, and photographs. Geospatial data should be accurate to within 1-meter.
The contractor shall submit weekly field progress reports to the COR and the Project Archeologist.
These progress reports will detail the activities completed during the week and the proposed activities for the upcoming week. The contractor shall submit the progress report by the close of business every Friday.
The contractor shall comply with all federal, state, and local laws. All vehicular traffic within the project area shall be restricted to existing roads. If the contractor would like to utilize an Off-Highway Vehicle (OHV), they must request a permit from the Project Office.
The contractor will coordinate with the COR and the Project Archeologists to avoid any threatened, endangered, or protected species’ critical propagation periods, which are typically early April to mid- August. Coordination will be necessary because some area may be closed or inaccessible during this period.
v) Draft Documents and Geospatial Data - The Contractor shall prepare a comprehensive Draft Report, which will detail the work completed, the investigation results, National Register eligibility recommendations, and an appendix of updated site forms. Additionally, initial draft NRHP Nomination forms (NPS Form-10-900) for any sites recommended eligible should be produced.
Evaluations shall follow the evaluation process defined in National Register Bulletin 15: How to Apply the National Register Criterion for Evaluation, and National Register Bulletin 36: Guidelines for Evaluating and Registering Archeological Properties. The report shall be marked CUI//SP-ARCHR, in accordance with National Archives and Records Administration’s CUI Handbook dated 2016-12-06.
The contractor shall format the report to the standards published by the SHPO of the state documented within the report.
The draft report, associated forms, and geospatial data shall be complete and have undergone the Contractor’s Quality Assurance process prior to being submitted electronically to the COR via DODSAFE or similar agreed upon electronic file transfer service. Draft files shall be provided in Microsoft Word 365 compatible and PDF format. Excessive errors will result in the rejection of the deliverable. The USACE will have 30-days to review the accepted deliverable and provide editorial comments for the final.
(1) Geospatial Data: Collected and generated geospatial raster/vector data will comply with Federal
Geospatial Data Standards, including the Spatial Data Standards for Facilities, Infrastructure, and Environment (SDSFIE) and National Standard for Spatial Data Accuracy (NSSDA) where applicable. Associated metadata will comply with Federal Geographic Data Committee Content Standards for Digital Geospatial Metadata. All raw geospatial raster/vector data collected shall be delivered in its collected coordinate system. All processed geospatial raster/vector data collected shall be delivered in UTM Zone 14 NAD 1983. Both raw and processed geospatial data will be provided in a format compatible with Esri ArcGIS Desktop version 10.x.
vi) Final Documents and Electronic Data – The final documents shall incorporate the editorial comments provided by the USACE and be provided as both final electronic and printed reports and electronic data on archival quality optical discs within 30 days of receipt of comments. The print reports shall be printed two sided, single spaced, on good quality bond paper measuring 8.5 inches by 11.0 inches, with 1.5 left and bottom margins and 1 inch top and right margins. The reports shall be unbound consisting of three copies of the South Dakota report and two copies of the Nebraska report. release. The reports will use correct English grammar, and there will be no typographical errors. All pages will be numbered consecutively, including the bibliography and attachments. Any illustrations that might be done must be clear, legible, self-explanatory, and of sufficiently high quality to be reproduced easily by standard photocopy equipment. All photographs should be clear, quality compositions with captions identifying subject, location, and date. Maps shall be clean, clear, and easily reproducible. Maps must be labeled with a caption/description, north-oriented to the top of the page, and will contain a scale, north arrow, legend, township and range, map size and date, and map source (USGS quad name or published source). The features to be illustrated, such as anomalies, shall stand out clearly against the other features on the map. Electronic data associated with report imagery should be provided in standard graphics formats such as .GIF, tiff, jpeg, .png, etc.
5. Period of Performance:
The period of performance will be a two-year (730 day) period for the contract. The following table demonstrates the performance schedule.

6. Method of Payment
Payment for services rendered will be made as follows:

7. General Information:
The Contractor is expected to pursue the study in a professional manner to meet the target dates. Neither the Contractor nor their representatives will release or publish any sketch, photograph, report, or other material of any nature obtained or prepared under this contract without specific written approval of the Contracting Officer's Representative. The Government may, at any reasonable time, inspect the progress of the work.
Such inspection, however, shall not be performed in such a way as to unduly affect the progress of the work.
Final acceptance of the work will be made upon successful completion of the work required under the contract.
The investigations shall be conducted on lands managed by the USACE.
8. Quality Assurance:
The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
9. General Safety Requirements:
All contractor and all associated sub-contractor’s employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative).
10. Hours of Operation:
Based on the contractors needs to accomplish this scope of work.
11. Recognized Holidays:
The contractor shall develop their work schedule based on the services listed in the PWS.
12. Place of Performance:
The work to be performed under this contract will be performed at the contractor facility and study areas on lands managed or owned by USACE Big Bend, Fort Randall, and Gavins Point Project lands in South Dakota and Nebraska.
13. Security Requirements:
All Contractor and all associated sub-contractor’s employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes. The Contractor must pre-screen Candidates using the E-Verify Program (http://www.dhs.gov/E- Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E-Verify system. An initial list of verified/eligible candidates must be provided to the Government Representative no later than 3 business days after the initial contract award.
14. Physical Security:
The Contractor shall be responsible for safeguarding all government material and information provided for contractor use.
15. Award Conference/ Periodic Meetings:
The Contractor may be required to have periodic meetings to discuss project progress.
16. Special Qualifications:
The minimum professional qualifications for the Principal Investigator and any crew chiefs are those given in 36 CFR Part 61, Appendix A - Professional Qualifications. personnel not covered in this CFR who are hired or subcontracted for their special knowledge and expertise must carry academic and experiential qualifications in their own fields of competence. Such qualifications are to be documented by means of vitae or resume attachments submitted with the proposal or at a later time if the consultant has not been retained at the time of proposal. The Principal Investigator must periodically check on the progress of the work each week and be available to advise or instruct personnel should any problems develop. The minimum qualifications for Geographic Information Systems Specialist are a bachelor’s degree in GIS, geography, computer science, or a minimum of five years related experience. Such qualifications are to be documented by means of a vitae or resume attachments submitted with the proposal.
The Government may send a representative to inspect the various phases of the operations and review project records without prior notification. All aspects of the field examination shall be conducted by or under the direct supervision of a qualified archeologist. Any change in personnel after the award of contract must be approved by the Contracting Officer. A person replacing a vacated position must have a comparable background and knowledge of the study area to maintain the same level of expertise and quality of performance. Failure to make an acceptable replacement could result in cancellation of the contract.
17. Post Award Conference/ Periodic Meetings:
The Contractor maybe required to participate on conference calls and meetings post award. The Contractor is required to attend a pre-fieldwork meeting with designated Archeologists before fieldwork may begin.
18. Contracting Officer Representative (COR):
The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
19. Key Personnel:
The following personnel are considered key personnel by the government: Principal Investigator, Project/Program Manager, and Crew Chief(s). Key personnel shall be identified before contract award. The Contractor shall provide a contract manager who shall be responsible for the performance of this work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the contracting officer. The manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 07:30 and 16:00 Central Time., Monday thru Friday except Federal holidays. All personnel and vita/credentials shall be identified in the Work Plan.
20. Contractor Travel:
The Contractor may be required to travel for the Literature and Records Search and during the Field Investigations. This travel schedule shall be determined by the Contractor and identified in the Work Plans.
21. Data Rights:
The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
22. Organizational Conflict of Interest:
Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of information or analyses, which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.
23. Project Pricing: The Government shall award a fixed price contract. See Pricing Schedule for CLIN 0001 and

2.0 DEFINTIONS AND ACRONYMS
2.1 DEFINTIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or services to the government. The Term used in the contract refers to prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER’S REPRESENTATIVE (COR). An employee of the U.S.
Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.12. WORKDAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.13. WORK WEEK. Monday through Friday, unless specified otherwise in the work plan.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF1449, letterhead stationary, or as otherwise specified in the solicitation. Offers must be submitted electronically, unless other arrangements have been made. Send completed offers to Brianna Boehne, Contract Specialist at Brianna.Boehne@usace.army.mil.
The proposal shall consist of one (1) pdf document not to exceed 25 pages. The price worksheet will not count towards the 25 page limit. The Government may not review any additional pages after 25. As a minimum, offers must include with their proposal:
(1) The solicitation number;
(2) The name, address, federal tax identification, email, and telephone number of the offeror;
(3) Names, title, email, and telephone number of persons authorize to negotiate and sign the proposal;
(4) All required technical, past performance, and price factor information stated in FAR 52.212-2, Evaluation – Commercial Items;
(5) A statement specifying agreement will all terms, conditions and provisions included in the solicitation.
Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration;
(6) Acknowledgement of Solicitation Amendments, if applicable;
(7) A completed copy of the representations and certifications at FAR 52.212-3, if applicable (see FAR 52.213- 3(b) for those representations and certifications that the offeror shall complete electronically); and

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from 52.21 the date specified for receipt of offers.
(m) Questions. All questions pertaining to this combined synopsis and solicitation shall be in writing, directed to the attention of Brianna Boehne, Contract Specialist at Brianna.Boehne@usace.army.mil. All questions shall be submitted not later than seven (7) calendar days prior to the proposal due date, in order to ensure adequate time is allotted for form an appropriate response and if needed, amend the solicitation. Offerors are requested to review the solicitation in its entirety for answers to questions, prior to submitting a new question.
(n) Insurance Required (FAR 52.228-5): In accordance with FAR 28.307-2, “Liability,” the contractor shall procure the following minimum insurance:

Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors.
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
This evaluation will be a BEST VALUE – TRADE OFF.
The following factors shall be used to evaluate offers:
1) Technical – The quoter shall provide a technical narrative describing the approach to be used to accomplish the contract tasks. The technical narrative shall be detailed, concise, and shall cover every aspect of how the contractor will accomplish the Objectives (Part 3) of the Performance Work Statement (PWS). The narrative should describe the contractor’s quality control program and how the contractor will implement it, in accordance with the PWS. The contractor shall describe their technical proficiency and unique qualifications for requirements described in the PWS.
The minimum professional qualifications for the Principal Investigator are those giving in 36 CFR Part 61, Appendix A- Professional Qualifications. The Principal Investigator shall also have Great Plains Archeological experience in conditions, type of cultural resource sites likely to be encountered, and history of the geographical area. Such qualifications are to be documented by means of vitae or resume.
The minimum qualifications for Geographic Information Systems Specialist are a bachelor’s degree in GIS, geography, computer science, with a minimum of five years related experience. Such qualifications are to be documented by means of a vitae or resume.
The quoter will receive a rating of exceptional for providing a technical narrative that (1) covers all aspects of the Specific Tasks listed in the PWS, (2) describes an appropriate quality control program that meets the standards stated in the PWS, and (3) demonstrates sufficient technical proficiency and possesses the unique qualifications stated in the PWS.
The quoter will receive a rating of satisfactory for providing a technical narrative that (1) covers most of the aspects of the Specific Tasks listed in the PWS, (2) describes an appropriate quality control program that meets some of the standards stated in the PWS, and (3) demonstrates limited technical proficiency and possess some of the unique qualifications stated in the PWS.
The quoter will receive a rating of unsatisfactory for providing a technical narrative that (1) does not cover most of the aspects of the Specific Tasks listed in the PWS, (2) does not describe an appropriate quality control program that meets the standards stated in the PWS, and (3) does not demonstrate technical proficiency and does not possess the unique qualifications stated in the PWS.
2) Past Performance – The quoter shall provide a list of no more than five (5) projects completed within the past 10 years that are similar to this requirement. Similar experience consists of projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work.
Projects need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate at least five (5) years of experience, and how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all projects provided. If the quoter provides more than five
(5) projects, the government will review only the first five (5) projects submitted.
Additionally, past performance may be based on the contracting officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Governmentwide Contractor Performance Assessment Reporting System (CPARS) contained at www.cpars.gov.
The quoter will receive a rating of exceptional for past performance that demonstrates more than five (5) years of experience on similar projects, and the additional information retrieved from CPARS and from the Contracting Officer is favorable, as applicable.
The quoter will receive a rating of satisfactory for past performance that demonstrates at least five (5) years of experience on similar projects, and the information from CPARS and the Contracting Officer is favorable, as applicable.
The quoter will receive a rating of unsatisfactory for past performance that does not demonstrate at least five (5) years of experience on similar projects and/or the additional information from CPARS and/or the Contracting Officer is not favorable.
3) Price – The quoter shall complete the Supplemental Pricing Sheet in its entirety. The quote shall be inclusive of all costs to perform the work specified in the PWS. All line items, which includes all base and option line items will be evaluated as a total price for this project. If the quoter does not complete all pricing items on the Supplemental Pricing Sheet, the government may determine the quote to be unacceptable.
*If the quoter fails to provide any of the information stated in Factors 1-3 above, the government may determine the quote to be unacceptable. If it is in the government’s best interest, the government may request additional information from the contractor, to make an award decision. After evaluation of all quotations, the government will identify from all quotations one that is the most suitable to the user.
Factor 1 is approximately equal to Factor 2 and when Factors 1 and 2 are combined they are approximately equal to Factor 3 - Price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
