SECTION 002100
INSTRUCTIONS TO OFFERORS
1. SOLICITATION DESCRIPTION
1.1 Indefinite Delivery Type Contracts: As part of the Advanced Contract Initiative (ACI) Emergency Temporary
Roof Repair acquisition strategy, the Government intends to issue one solicitation and award one single award task order contract (SATOC) for the U.S. Virgin Islands (USVI) to include the islands of St. Croix, St. John, St. Thomas and remaining populated USVIs:
Acquisitions to be awarded under this solicitation:
Primary Region Secondary Region Set-Aside Capacity
St. John and St. Thomas and remaining populated USVIs
St. Croix Small Business $45,000,000.00
This solicitation is for the 2021 contract only. A separate solicitation was issued for the 2020 contract covering the primary region of St. Croix in the spring of 2020. The geographic scope of this solicitation allows for work in the entire USVI if needed. All task orders issued under the SATOCs will be Firm Fixed Price.
The SATOC will not exceed $45,000,000.00 in capacity, with a minimum guarantee of $2,500.00 (to include the base and option period). Award will be made to the most responsible offeror whose proposal conforms to the criteria established in this solicitation and is considered most advantageous to the Government for each region; price and other factors considered. In any case, the Government may not award any contract if the resulting contract would not represent the “best value” to the Government using trade-off selection procedures as required by the DFARS and using guidance as prescribed by the Department of Defense (DoD) Source Selection Procedures. It is strongly encouraged that the provisions stated in the solicitation be fully studied prior to assembly of the proposal.
The period of performance for the SATOCs consists of a 5-year base period and a 2-year option period for a total
7-year performance period. The Government’s decision to exercise an option will be contingent on satisfactory contactor performance and an informal survey of current market conditions. The decision to exercise the option is at the discretion of the Government.
An offeror will only be considered for one (1) $45,000,000 SATOC in the U.S. Virgin Islands between the 2020 and 2021 solicitations. This includes any combination of teaming arrangements, Joint Ventures or mentor-protégé arrangements as prime contractors. This restriction does not include subcontracting. An offeror who was awarded a
SATOC under the 2020 solicitation, will not be considered for award in this 2021 solicitation for USVI. An offeror will still be considered for SATOCs in solicitations for areas other than USVI. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.
1.2 Set-Aside: This solicitation is set aside for small business participation only.
1.3 Eligibility Verification: The System for Award Management or (https://www.SAM.gov) website will be checked to verify an offeror’s current classification under North American Industry Classification Code
(NAICS) 238160, Roofing Contractors with a small business size standard of $16.5million.
1.4 Awards: The U. S. Army Corps of Engineers intends to conduct this acquisition by use of competitive source selection procedures in accordance with the provisions set forth in this solicitation.
The 2020 and 2021 contracts will be awarded to fulfill the Government’s anticipated need for numerous rapid-response temporary roofing projects in the U.S. Virgin Islands to include the islands of St. Croix, St. Johns, St.
Thomas and remaining populated U.S. Virgin Islands. The effect will be to have two capable and responsible contractors that can facilitate and maximize the Government’s response capability in the event of an emergency, as it is the Government’s intent to maximize the number of contracts, and thus contractors to draw upon, to respond to a catastrophic event. Having two contractors with contracts that have scopes with overlapping geographic coverage is crucial to meeting the Government’s needs here, which is to ensure that the Government has adequate coverage and contract capacity in the event of an emergency event in any, one (1) location.

In addition to the past performance records, the offeror shall also provide notification and information concerning any projects where it’s right to proceed was terminated for default during the last six (6) years, or so state that there were none.
Past performance records may be obtainable by offerors using one of the following methods.
1) Accessing past performance information directly from the Contractor Performance Assessment Reporting
System (CPARS) website at https://www.cpars.gov/. CPARS is an electronic repository of performance information collected by all the major federal performance reporting systems and can be accessed at the aforementioned website. Contractors are encouraged to obtain and use a certificate from an External Certificate
Authority (ECA). External Certificate Authorities (ECAs) and Interim External Certificate Authorities (IECAs) provide digital certificates to the DoD's private industry partners, contractors using their own equipment or working in non-government facilities, allied partners, and other agencies. Additional information about the PKI certificate is at https://www.cpars.gov/pki_info.htm web page. You will also need your DUNS number and Marketing Partner
Identification Number (MPIN) to log onto CPARS. The MPIN number was selected by whoever registered your company in the System for Award Management (SAM) Registry at https://beta.sam.gov/. If you do not know your
MPIN number, you will need to contact the SAM help desk by emailing them from the email link on the SAM web page. Please be aware that they will only release the MPIN number to the person who originally registered your company. Additional instructions on locating your MPIN is located in the Frequently Asked Questions (FAQs) section under the Help tab.
2) Past Performance Questionnaires (PPQs) may be used to provide or supplement a firm’s past performance with other than U.S. Governmental clients. Contact your client point of contact (POC) for the project you need a past performance record and request the POC to complete the PPQ. The PPQ included in this solicitation is provided for the offeror to submit to the client for each project the offeror may need a past performance record for to meet the http://www.cpars.gov/ http://www.cpars.gov/ http://www.cpars.gov/pki_info.htm http://www.cpars.gov/pki_info.htm http://www.cpars.gov/pki_info.htm requirements in this solicitation. Ensure correct phone numbers and email addresses are provided for the client POC.
Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). It is the offeror’s responsibility to follow-up with client POCs to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Wayne C. Weidenhamer, at lynne.d.reed@usace.army.mil prior to proposal closing date. If a PPQ is submitted for a project, the complete PPQ shall be submitted (either by the client POC or the offeror) prior to proposal closing date.
3) Any equivalent to CPARS or PPQ issued by the client.
If the offeror’s CPARS rating is available, then the offeror should submit the CPARS rating. A PPQ should not be submitted when a CPARS rating or other official rating is available. For those offerors whose past performance information is not located in a system such as CPARS, offerors should contact their references and request each reference complete the PPQ. The PPQ should be completed by the client or client’s representative not affiliated with the offeror’s firm and should be signed by the client or client’s representative. PPQs previously completed by the client for other solicitations are acceptable (to include those previously completed for other RFPs.
The Government intends to assess the relevancy and performance based on the past performance information provided received and/or retrieved. A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Source Selection Evaluation Board (SSEB). Therefore, it is incumbent upon the offeror to include all relevant information, including demonstrated corrective actions, in its proposal.

7. NOTICE REGARDING BUY AMERICAN ACT
The Buy American Act (41 U.S.C. 10a-10d) generally requires that only domestic construction material be used in the performance of this contract. Exception from the Buy American Act shall be permitted only in the case of non-availability of domestic construction materials. A bid or proposal offering non-domestic construction material will not be accepted unless specifically approved by the Government. When a bidder or offeror proposes to furnish non-domestic construction material, the bid or proposal must set forth an itemization of the quantity, unit price, and intended use of each item of such non-domestic construction material. When offering non-domestic construction material pursuant to this paragraph, bids or proposals may also offer, at stated prices, any available comparable domestic construction material, so as to avoid the possibility that failure of a non-domestic construction material to be acceptable under this paragraph will cause rejection of the entire bid. All bidders are cautioned that, prior
Government conduct notwithstanding, the Contractor's selection of a domestic construction material (as defined in
FAR 52.225-9, Buy American - Construction Materials) which would require the subsequent selection of a foreign construction material for compatibility is not a justification for waiver of the Buy American Act. It is the
Contractor's responsibility to verify, prior to submitting the materials for approval that each system can be built to meet the contract specifications without the use of foreign construction materials.
