PART 1

General Information

1. GENERAL: This is a services contract to provide all labor, supervision, equipment, and transportation to provide elevator inspection services for the Corps of Engineers at the Fort Peck Project.

1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform elevator inspections for the Corps of Engineers as defined in this Performance Work Statement except for those items specified as government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2 Background: The Corps of Engineers operates five (5) elevators at the hydroelectric power plant on the project. The Corps of Engineers requires the Contractor to perform all the applicable periodic tests and inspections specified in the latest edition of the American Society of Mechanical Engineers Code for Elevators and Escalators, ASME A17.1, including any applicable supplements, on the these elevators.

1.3 Objectives: Contractor shall provide for the safe, careful and efficient operations of all equipment and protection of Government funds and property under the direction of the COR. The Contractor shall maintain a clean and orderly work area.

1.4 Scope: Services include elevator inspection and testing. The Contractor shall perform annual inspections and periodic tests on the project elevators at the power plant within the timeframe specified. The Contractor shall schedule the elevator inspections with the POC at least two weeks in advance of performing the work. Information as to the type of equipment, number of stops, capacity, etc. is included as Attachment 1in Part 7.

1.5 Period of Performance: Initial work for the base year must be completed by December 31, 2021. If option years are awarded the work shall be completed within one (1) year from completion of work from the previous year.

1.6 General Information

1.6.1 Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract.

1.6.2 Quality Assurance: The government shall evaluate the Contractor’s performance under this contract, IAW Part 7 of this Performance Work Statement. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

The Government’s Quality Assurance Representative shall be TBD.

1.6.3 Recognized Holidays: Contractors will not be required to work on the Federal Holidays specified in the instructions and notices section.

1.6.4 Hours of Operation: The Contractor shall be required to complete all inspections between 7:00 a.m. & 5:00 p.m. (Mountain Time), Monday through Thursday.

1.6.5 Place of Performance: The work to be performed under this contract shall be performed at the Fort Peck Power Plant. The power plant is located on Yellowstone Road, 2.5 miles East of Fort Peck, Montana.

1.6.6 Type of Contract: The government will award a Firm Fixed Price Contract.

1.6.7 Security Requirements: All Contractor personnel shall notify the Government upon entering and leaving the facility perimeter. All Contractor personnel shall sign the visitor registry and log entry and leaving times. The Government will issue all Contractor personnel a visitor badge which shall be worn at all times. A Government representative will be provided to escort Contractor personnel during the performance of work.

1.6.7.1 PHYSICAL Security: The Contractor shall be responsible for safeguarding all government equipment, information and property provided for Contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.7.3 Lock Combinations: N/A

1.6.8 Special Qualifications: All employees shall possess required licenses/certificates/ insurance as required by federal, state, and local authorities. Elevator inspectors must be qualified to inspect and test elevators as specified in the QEI-1 Standard for the Qualification of Elevator Inspectors. Inspectors shall use the Guide for Inspection of Elevators, Escalators, and Moving Walkways, ASME A17.2-2013, as a reference for the inspection of all elevators.

1.6.9 Post Award Conference/Periodic Progress Meetings: N/A

1.6.10 Government POC: (Also referred to in text as the COR) The POC monitors all technical aspects of the contract and assists in contract administration. The POC is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the POC, a copy of which is sent to the Contractor, states the responsibilities and limitations of the POC, especially with regard to changes in cost or price, estimates or changes in delivery dates. The POC is not authorized to change any of the terms and conditions of the resulting order. The POC for this contract shall be TBD.

1.6.11 Key Personnel: The following personnel are considered key personnel by the government: Contractor shall at a minimum furnish one (1) adult (18 years or older) to provide the elevator inspection and testing services. The individual selected to provide the elevator inspection and testing services shall not be substituted for, unless prior approval by the COR is obtained.

1.6.12 Identification of Contractor Employees: All contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by the Contractor are suitably marked as Contractor products or that Contractor participation is appropriately disclosed. All Contractor personnel shall be required to wear identification badges which will include name of the person and the company who he/she is employed with.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and to make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the Contracting Officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

2.1.12 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

3.5 Materials: The Government shall supply required test weights for performance of Category 5 full load tests.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Secret Facility Clearance: N/A

4.3 Materials: N/A

4.4 Equipment: The Contractor shall furnish all equipment. Equipment used by the Contractor shall be in compliance with OSHA, EPA and other DOD Directives.

4.5 Liability on Tests: The contractor shall not be liable for damage to Government equipment being tested when the damage results directly from and as a result of the tests specified in this specification and not due to neglect by the Contractor, his agents or employees. The Government will assume liability for the cost of labor and replacement parts and may choose to negotiate the cost of repair work with the Contractor.

PART 5

SPECIFIC TASKS

5. SPECIFIED TASKS:

5.1 Basic Services: The Contractor shall provide elevator inspection and testing services at the Fort Peck Power Plant for the Corps of Engineers. All work shall take place between the hours of 7:00 a.m. & 5:00 p.m. (Mountain Time) Monday – Thursday. The Contractor shall complete all work in a professional manner and shall be carried out such that there will be a minimum of interference with the execution of Government business. All work must be completed in accordance with statement of work and attached work schedules. Storage or work areas will be assigned to the Contractor by the POC at the site. The Contractor shall notify the Contracting Officer two (2) weeks prior to commencing work. The Contractor shall guarantee that all requirements for the inspections and tests are completed and documented.

5.2 Elevator Periodic Tests:

A. Inspection and Testing: The work shall consist of but not be limited to the inspection and/or testing of the following equipment:

Hoistway and car doors, hangers, guides and operating devices Hoisting machines, sheaves and brakes Motors, motor generator sets Hoisting, governor, compensating and operating cables Controllers (including contacts, switches, etc.)

Signal systems, controls and traveling cables Governor, safeties, interlocks and contacts Guide rails and oiling devices Terminal, slow down and leveling devices Elevator car, counterweights and buffers Machine room, hoistway and pits

B. Periodic Inspection and Tests: The Contractor shall conduct Category 1 and Category 5 test requirements in accordance with the ASME A17.1 Elevator Code. Category 5 tests shall be performed in 2021 (base year) on elevators as listed in Technical Exhibit 2.

C. Reporting Results of Inspections and Tests: As part of the required work, the inspector shall complete one original and one copy of Elevator Inspection Report, MRO Form 1669, 01 Jun 77, which will be furnished by the Government at the site. A sample copy is included as Attachment 2. Delete requirements pertaining to Item Line No. 9C & 9D on MRO Form 1669. A separate inspection report shall be prepared for each elevator. The report shall include under “Remarks” recommendations for correction of all defects found during the inspection. The recommendation shall show the item line number referred to, a brief description of the defect and the recommended corrective action. An estimated repair cost for each item and a total estimated cost for all repairs listed under “Remarks” shall be included with the original copy of the inspection report. Upon completion of the testing and inspection, the inspector shall give the copy of the inspection report to the Government Representative at the site. In addition, the Contractor shall complete a statement showing that the required inspection and tests were completed and obtain the signature of the Government Representative at the site on that statement. Statement forms will be furnished by the Government at the site. A sample copy is included as Attachment 3. The inspector shall also sign the inspection certificate posted in the car and indicate the date. Sample certificates for each elevator are included in Attachment 4. Within 30 days of completion of the inspection and tests, the Contractor shall forward the original copy of the inspection report and the signed copy of the statement of completion to:

D. Emergency Conditions: Any condition found affecting the immediate safety of the passengers or elevator equipment shall be immediately reported to the Government Representative at the site. Within 24 hours a written report, clearly listing the defects found, the action recommended and a rough estimate of the corrective action proposed shall be submitted to the Government Representative at the site.

6.2 The Contractor shall follow all elevator inspection and testing requirements detailed in the Safety Code for Elevators and Escalators per ASME A17.1-2013.

6.3 The Contractor shall utilize the Guide for Inspection of Elevators, Escalators, and Moving Walkways, ASME A17.2-2013, for the recommended inspection and testing procedures required to conform to the Safety Code for Elevators and Escalators.

6.2 The Contractor shall follow all Safety Requirements detailed in the applicable Safety & Health Requirements Manual, EM 385-1-1 date 15 September 2014. EM 385-1-1 is available on-line at:

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (MAR 2020)

52.212-1 Addendum; Instructions to Offerors—Commercial Items

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF1449, letterhead stationary, or as otherwise specified in the solicitation. Offers must be submitted electronically, unless other arrangements have been made. Send completed offers to Scott Dwyer at Scott.Dwyer@usace.army.mil and Nadine Catania at Nadine.L.Catania@usace.army.mil. The proposal shall consist of one (1) pdf document not to exceed 25 pages. The price worksheet will not count towards the 25 page limit. The Government may not review any additional pages after 25. As a minimum, offers must include with their proposal:

(1) The solicitation number;

(2) The name, address, federal tax identification, email, and telephone number of the offeror;

(3) Names, title, email, and telephone number of persons authorize to negotiate and sign the proposal;\

(4) All required technical, past performance, and price factor information stated in FAR 52.212-2, Evaluation – Commercial Items;

(5) A statement specifying agreement will all terms, conditions and provisions included in the solicitation.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from 52.21the date specified for receipt of offers.

(m) Questions. All questions pertaining to this combined synopsis and solicitation shall be in writing, directed to the attention of Scott Dwyer at Scott.Dwyer@usace.army.mil and Nadine Catania at Nadine.L.Catania@usace.army.mil. All questions shall be submitted not later than seven (7) calendar days prior to the proposal due date, in order to ensure adequate time is allotted for form an appropriate response and if needed, amend the solicitation. Offerors are requested to review the solicitation in its entirety for answers to questions, prior to submitting a new question.

(n) Insurance Required (FAR 52.228-5): In accordance with FAR 28.307-2, “Liability,” the contractor shall procure the following minimum insurance:

And, when contract performance involves use of vessels, the Contracting Officer shall require, as determined by the agency, vessel collision liability and protection and indemnity insurance. The contractor is responsible for contacting the state for compliance with its workman’s compensation laws.

(o) State and Local Taxes:

The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-

107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142. Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors.

52.212-2 ADDENDUM; EVALUATION--COMMERCIAL ITEMS

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. Quotations will be evaluated using the following factors:

1. Past Performance – The quoter shall provide three references of projects completed within the past five (5) years. Experience consists of projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work. These references need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all references.

Additionally, past performance may be based on the contracting’s officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Contractor Performance Assessment Reporting System (CPARS), contained at cpars.gov.

The quoter will receive a rating of exceptional for past performance that demonstrates successful completion of similar purchases on all references and the additional information retrieved from PPIRS and from the Contracting Officer is favorable. The quoter will receive a rating of satisfactory for past performance that has at least one reference that demonstrates successful completion of similar purchases and the information from CPARS and the Contracting Officer is favorable. The quoter will receive a rating of unsatisfactory for past performance that does not demonstrate any successfully completed similar purchases on the references and the additional information from CPARS and the Contracting Officer is not favorable.

2. Price – The quote shall be inclusive of all costs to perform the work specified in the PWS.

The best value determination will be determined where Factor 1 – Past Performance is approximately equal to Factor 2 - Price.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
