PERFORMANCE WORK STATEMENT (PWS)

Noxious Weed Spraying Services USACE- North Alabama Bend & Audubon Bend

PART 1

GENERAL INFORMATION

1.0 General Information

1.1 Background. The properties, known as North Alabama Bend and Audubon Bend, were purchased by USACE in 2009 as part of the Missouri River Recovery Program. These properties are natural areas that provide wildlife habitat. The public frequently uses these areas for hunting, fishing, and hiking. North Alabama Bend consists of approximately 546 acres adjacent to the Missouri River plus approximately 75 acres of accreted ground.

Approximately 55% of the property is wooded, 37% is open grassland, and the remaining 8% is a mixture of grassland and trees. Audubon Bend consists of 2,382 acres adjacent to the Missouri River with approximately 4.5 miles of riverfront. Approximately 24% of the property is irrigated cropland, 53.5% is recent native plantings (planted in 2011 through 2018), 17% is woodland, 5% is open grassland, and 0.5% is wetlands. The cultivated area is currently under an agricultural lease with a portion of the cultivated area planted to native habitat each year.

1.1.1 Objectives. Our primary goal is to effectively control noxious weeds/invasive species at North Alabama Bend and Audubon Bend without damaging nearby trees and shrubs and minimizing damage to desirable ground vegetation. Noxious weeds/invasive species targeted for control may include Canada thistle (Cirsium arvense), musk thistle (Carduus nutans), spiny plumeless thistle (Carduus acanthoides), bull thistle (Cirsium vulgare), leafy spurge (Euphorbia esula), purple loosestrife (Lythrum salicaria), common reed (Phragmites australis), saltcedar (Tamarix spp.), Russian olive (Elaeagnus angustifolia), common buckthorn (Rhamnus cathartica), Siberian elm, and other species as necessary. Our secondary goal is to control any undesirable vegetation in native habitat restoration plantings (that may out-compete planted species) at Audubon Bend or vegetation in parking areas at the properties.

1.2 Scope of Work. This is an Indefinite Delivery/Indefinite Quantity (IDIQ) services contract to provide chemical weed control services on lands administered by the U.S. Army Corps of Engineers (USACE) Gavins Point Project.

Services include chemically controlling noxious weeds and other undesirable vegetation (as listed in section 5.0 Specific Tasks). The government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the government. This is a requirements service contract with both Firm Fixed Price (FFP) and Time and Materials (T&M) pricing arrangements.

1.3 Period of Performance. The period of performance shall be for one (1) Base Year of 12 months and two (2) 12-month additional years. The Period of Performance reads as follows:

Base Year: 01 May 2019 through 30 April 2020

Active period of performance: 01 May 2019 through 31 October 2019 Inactive period of performance: 01 November 2019 through 30 April 2020

Year 1: 01 May 2020 through 30 April 2021

4.1 General. The contractor shall furnish all supplies, equipment, facilities, and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2. Utilities. The contractor shall furnish their own municipal water source for tank mixing purposes. The Contractor is not authorized to utilize non-potable water from the Missouri River or water sources located within USACE lands for any purpose when conducting chemical application services.

4.3. Equipment. The contractor shall furnish all necessary equipment, such as but not limited to, vehicles, spraying equipment, GPS unit, required safety equipment, etc. to complete the requirements of this PWS.

4.3.1 Spraying Equipment. Chemical application shall be accomplished by the use of ground spraying equipment (4-wheel drive vehicle with spray boom/gun, ATV with spray boom/gun, or backpack/hand-carry spray unit) only.

Areas inaccessible by motorized vehicles will require the use of a backpack/hand-carry spray unit. Aerial spraying is not authorized under this contract.

4.3.1.2 Equipment Storage. The contractor's equipment shall not be stored on government property administered by the USACE Gavins Point Project. At the close of each work period, all chemicals, chemical mix, chemical refuse/waste, and equipment shall be removed from government lands. It is the contractor’s responsibility to secure their personal property during working and non-working hours. The government will not be held liable for damaged, lost, stolen, or vandalized property.

4.3.2 GPS Unit. Depending on the size, location, and type of spraying involved in the task order, work areas may be marked by field flags, flagging tape, other identifying markers, or they may be unmarked. The contractor may need to navigate to work areas using aerial maps and/or GPS coordinates. To accurately navigate to a work area using GPS coordinates, the contractor’s GPS unit shall be recreation grade or better.

5.0 Specific Tasks

5.1 Basic Services. The contractor shall provide services to chemically control target vegetation without damaging nearby trees and shrubs and minimize damage to non-target ground vegetation. Various types of chemical applications may be required. Some areas may require spot treatments, while others may require solid coverage. Basal bark applications may be required for some woody species. Application rates for herbicides may be specified in the task order or the contractor may need to determine the proper application rate based on the manufacturer specified rate and conditions. Application rates shall be such that the target species is killed and not simply injured. Work areas may be identified by markers or the contractor may need to navigate to work areas using GPS coordinates and/or aerial maps.

The contractor shall follow all label instructions for mixing (including the addition of any adjuvants) and applying all herbicides. All spray equipment shall be properly calibrated prior to spraying.

5.2 Pesticide Application Documentation and Recordkeeping. The contractor is also responsible for accurately completing a Pesticide Application Record (PAR) for each application. A Pesticide Application Record (PAR) (Attachment 1) must be completed daily on-site for each application and submitted to the COR along with the corresponding invoice.

5.3 Location. The work to be performed under this contract will occur at two separate locations (Attachment 2).

North Alabama Bend is located near Vermillion, South Dakota in Clay County. The property is accessed via the adjacent public road, Highway 19. Audubon Bend is located near Wynot, Nebraska in Cedar County. The property is accessed via the adjacent public road, 893rd Rd. Contractor vehicles shall be parked in a manner so as to avoid interference with agricultural activities, adjacent landowners, the recreating public, or municipal/government operations.

5.3.1 Site Inspection. It is the prospective contractor’s responsibility to inspect the sites where services are to be performed to satisfy themselves as to all general and local conditions that may affect the cost of performance of the agreement. The prospective bidder shall base their bid on their personal site visit/field assessments, rather than from any maps, aerial photos, or estimates that may be furnished by the government as background/orientation information. In no event will a failure to inspect the sites constitute grounds for withdrawal of a bid after opening, or a claim after award of the agreement. Site inspections can be arranged by contacting Linda Filo at 605-290-6479.

5.4 Task Orders. Each Task Order will contain a description of the work to be performed, along with a specified period of performance. Requests for an extension must include a detailed explanation of why the task order could not be completed within the allotted timeframe and must be submitted in writing to the COR. Approval of extensions will be at the discretion of the KO. The target species, location, and type of pricing arrangement shall be included with each Task Order at the time of issuance. Prospective contractors will provide Firm Fixed Price (FFP) and Time and Materials (T&M) prices as their offer to the solicitation. For FFP arrangements, the contractor and the government will agree on the number of labor hours and the amount of chemical required to complete the application, prior to the start of the work. FFP arrangements are performance based agreements where the government defines and measures desired outcomes. For T&M arrangements, the contractor will be paid for actual labor hours worked and the actual amount of chemical applied. For T&M arrangements, a COR will be onsite throughout the application, and a not to exceed dollar amount will be set for each task order. Herbicide applications under either type of arrangement may include the following chemicals and conditions:

5.4.1 Spraying with Aminopyralid (Milestone® or equivalent). The main target species may include Canada thistle, musk thistle, spiny plumeless thistle, bull thistle, or other species located in grassland areas. There has typically been some spraying for thistles with aminopyralid each year, though the amount has been variable.

Applications have included both broadcast and spot applications.

5.4.2 Spraying with Clopyralid (Stinger® or equivalent). The main target species may include Canada thistle, musk thistle, spiny plumeless thistle, bull thistle, or other species located in areas with young cottonwood trees.

Potential applications are expected to be highly variable from year to year.

5.4.3 Spraying with Picloram (Graslan® or equivalent). The main target is leafy spurge located in grassland areas. Spraying for leafy spurge with picloram has occurred yearly since 2017, though the treated area is typically limited to approximately 6 acres or less.

5.4.4 Spraying with Glyphosate (RoundupProMax® or equivalent). Applications may include complete herbaceous vegetation control in woodland plantings prior to tree seedling emergence, complete herbaceous vegetation control around established saplings, complete vegetation control of areas in preparation for planting, complete vegetation control in parking areas, and/or spot spraying of other selected areas as directed.

5.4.5 Spraying with Aquatic Formulation of Imazapyr (Habitat® or equivalent). The main target species may include purple loosestrife, common reed, saltcedar seedlings, or other species located in wetlands or aquatic areas.

Aquatic spraying has typically been minimal in most years, but may vary considerably depending on conditions, including water levels and accessibility of wetlands/shoreline.

5.4.6 Spraying with Imazapic (Plateau® or equivalent). The main target species may be leafy spurge.

Applications may include broadcast and/or spot spraying of selected areas as directed. No spraying for leafy spurge with imazapic has occurred in recent years, but it remains an option for certain areas.

5.4.7 Spraying with Triclopyr (Pathfinder II® or equivalent). The main target species may include Siberian elm, Russian olive, common buckthorn, or other invasive woody species. Spraying may consist of basal bark applications to trees less than 6 inches in diameter. The contractor must use a dye when applying triclopyr to woody species. No basal bark applications of triclopyr have previously occurred, but the potential exists for future applications.

5.5 Spraying Activities. The contractor shall NOT start spraying until issuance of a task order. It shall be the contractor's responsibility to start and provide a continuous spraying operation from day to day, weather permitting, until completion of the contracted work within the allotted time frame. The potential exists for work areas to be in close proximity to areas of human activity. The contractor is to avoid contact with the public, work force, livestock, and crops with either spray or drift.

5.6 Types and Rates of Chemicals. Only those EPA registered chemicals approved for use in the State of South Dakota/Nebraska and listed on the bid sheet shall be applied. The potential exists that not all of the chemicals listed on the bid sheet will be utilized during the period of performance. If the KO considers the proposed chemical prices unreasonable, the prices may be negotiated until acceptable by both the bidder and the KO. For chemicals not listed on the bid sheet, an acceptable price will be negotiated prior to acceptance and application of that chemical.

5.7 Weather Conditions. The contractor shall identify weather conditions before beginning any herbicide application, and continue to monitor weather conditions throughout the course of the application. Manufacturer's label directions and warnings relative to temperature, wind, or other weather conditions shall be strictly adhered to.

The contractor shall immediately stop applying herbicides if weather conditions begin to adversely impact the application. Herbicide applications shall not take place when precipitation is expected before the herbicide formulation is rainfast. Care shall be exercised at all times by the contractor to protect desirable (non-target) species from damage by the required chemical applications.

5.8 Notification. The contractor shall notify the COR by telephone no later than the working day prior to time and material applications. This will allow the COR to be on site during the applications.

5.8.1 Notification of Chemical Spills, Damage, or Injury. The contractor shall notify the COR immediately (on the day of occurrence/observance) of any chemical spillage, damage to government property, and injury to any person resulting from the contractor's operations. In the event of a spill, the contractor shall comply with state reporting requirements. Please provide the following information with your quote:

Company’s Name as it appears on SAM:

Company’s Address as it appears on SAM:

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of quotations. Submit quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Electronic quotations are preferred over paper responses, unless other arrangements have been made. Send completed quotation to Destiny Jeffries; destiny.jeffries@usace.army.mil

Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotations;

(3) The name, address, and telephone number of the quoter;

(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3( b ) for those representations and certifications that the quoter shall complete electronically);

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Reserved.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during testing.

(f) Late submissions.

(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.

(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is late and will not be considered unless it is received before purchase order issuance and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.

(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(g) Issuance of purchase order. Quotations should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR part 15.

(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.
