CLAUSES INCORPORATED BY FULL TEXT
52.212-2 ADDENDUM; EVALUATION--COMMERCIAL ITEMS
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. Quotations will be evaluated using the following factors:
1. Past Performance – The quoter shall provide three (3) references of projects completed within the past five
(5) years. Experience consists of projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work. These references need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all references.
Additionally, past performance may be based on the contracting officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Government-wide Past Performance Information Retrieval System (PPIRS), contained at www.ppirs.gov.
The quoter will receive a rating of exceptional for past performance that demonstrates successful completion of similar purchases on all references and the additional information retrieved from PPIRS and from the Contracting Officer is favorable. The quoter will receive a rating of satisfactory for past performance that has at least one reference that demonstrates successful completion of similar purchases and the information from PPIRS and the Contracting Officer is favorable. The quoter will receive a rating of unsatisfactory for past performance that does not demonstrate any successfully completed similar purchases on the references and the additional information from PPIRS and the Contracting Officer is not favorable.
2. Price – The quote shall be inclusive of all costs to perform the work specified in the PWS.
The award will be based on whether the lowest priced of the quotations having the highest past performance rating possible represents the best value when compared to any lower priced quotation or offer. In addition, each factor will be weighed equally in determining the successful bidder utilizing the following adjectival rating:
EXCEPTIONAL: Performance significantly exceeds contract requirements in the Government’s benefit.
SATISFACTORY: Performance meets contractual requirements.
SATISFACTORY:
Performance does not meet contractual requirements.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
For the purpose of the award of the contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows:
The evaluation will consider the possibility that the option can be exercised at any time, and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all quotations relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the quotations, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

1.0 General Information.
1.1 Background. Recently it was discovered that the stem water packing gland on the hoist serving Service Gate No. 2 at the US Army Corps of Engineers (USACE) Cherry Creek Dam Intake Tower in Aurora, CO is cracked and should be replaced. Although the gland is cracked, there is currently no compromise in the function of Service Gate No.2.
1.2 Scope of Work. This is a non-personal services contract to replace the cracked stem water packing gland on the hoist serving Service Gate No. 2 at Cherry Creek Dam, Aurora, CO. Services for replacement of the gland may include lifting the cylinder from its foundation, investigation of the reason for the cracked gland, replacement of the gland, determination whether any other damage has occurred to the stem and re-seating of the cylinder in its normal functioning position. In some cases removal and replacement of ancillary items may be required but not stated in the SOW, and any or all of the SOW actions may be adjusted, changed or omitted depending on actual site conditions and with authorization from USACE.
The government shall not exercise any supervision or control over the contract service provider’s performance of the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the government. This is a fixed priced, performance based service contract where the government defines and measures desired outcomes, while contractor methods are generally not constrained or directed.
Prior to the start of any work, the Contractor shall meet with Government/US Army Corps of Engineers USACE Tri-Lakes Project Office personnel to review all aspects of this contract, including a walk-thru inspection at the work site. This inspection is to protect the Contractor and USACE from any disputes of equipment damage or abuse. Notes and/or pictures shall be taken of the condition of equipment that will be used by the Contractor in the general area that might appear to have some existing damage or show signs of use. Representatives of both the USACE and the Contractor shall sign the inspection report. The Contractor shall then be free to proceed with the work.
1.3 Period of Performance. The period of performance shall be 45 calendar days after award.
1.4 Contractor Personnel
1.4.1 The contractor shall perform all work under this contract using his or her own forces except as provided in Paragraph 1.4.2 Subcontracting. Employees who perform this work shall be qualified persons on the contractor’s own payroll.
1.4.2 Subcontracting. The contractor shall not subcontract any work without written approval of the Contracting Officer. Compliance with the provisions of this contract by subcontractors shall be the responsibility of the contractor.
1.5 Quality Control
1.5.1 The contractor shall designate, in writing, an employee who shall serve as the contact for matters involving quality and performance or nonperformance of the required work stated in this PWS. The employee(s) shall be qualified and fully competent with full authority to act for, and on behalf of, the contractor as necessary to insure that the required work is performed in accordance with the standards contained herein. The contractor shall furnish the above written designation to the USACE Contracting Officer or Contracting Officer’s Representative (COR) no later than the first day of work. The contractor shall include the name(s), address(s), and telephone number(s) of the responsible individual(s).
1.5.2 The Contracting Officer reserves the right to disapprove any individual whom he considers incompetent to perform the work required. The Contracting Officer will provide a written notice of any disapproval to the contractor.
1.6 Quality Assurance. The government will use the methods stated in this PWS to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government may use Quality Assurance Evaluators (QAE(s)) to provide assistance with the quality assurance methods.
1.6.1 The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.
1.6.2 If any of the services do not conform to contract requirements, the government may require the contractor to perform the services in conformity with contract requirements and at no increase in cost. If the contract requirements are not met after a second attempt the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
1.6.2.1 Upon verification of a validated customer complaint or corrective action report, the Contracting Officer or COR will notify the contractor that they are required to re-perform specific services within 14 calendar days of the verification.
1.6.3 The government may take action, if the contractor fails to perform the services again or to take the necessary action to ensure future performance is in conformity with the contract requirements. The government may (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that related to the performance of such service or (2) terminate the contract in whole or in part.
1.6.4 The contractor is responsible to replace/repair any damage to government property due to negligence, at his or her own cost. The government may take action, if the contractor fails to replace/repair any damage to government property. The government may (1) by contract, or otherwise, replace/repair damaged government property and charge to the contractor any cost incurred by the government to replace/repair any damage.
1.7 Hours of Operation. The contractor is responsible for conducting business, between the hours of 7:00am - 5:30pm Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings. The Contractor must maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.8 Pre-Work Meeting. Prior to commencing any activities, the contractor shall arrange a Pre-work Meeting with the COR. The Meeting shall discuss the work requirements, scheduling, submittal process, review of the Activity Hazard Analysis (AHA), and Abbreviated Accident Prevention Plan (AAP). At least one (1) week prior to commencing work, the Contractor shall coordinate their proposed work schedule with the COR.
1.9. Submittals. Prior to commencement of services, the Contractor shall submit the following documents to the COR for review and approval:
1.9.1 Activity Hazard Analysis (AHA);
1.9.2 Abbreviated Accident Prevention Plan (APP)
1.9.3 List of who will perform work on this contract;
1.9.4 Proof of Insurance for Contractors and Subcontractors;
1.9.5 Technical scope of work with USACE-verified ordered steps.
1.10 Standards and Regulations. The Contractor shall perform to the standards in the contract and comply with all Local, State, and Federal Regulations during the services performed. The Contractor is responsible for ascertaining the extent to which these regulations affect the operations resulting from this contract. The Contractor shall comply will all applicable regulations. Applicable regulations include, but are not limited to the following:
1.10.1 Code of Federal Regulations (CFR), Title 36, Chapter III, Part 327, Rules and Regulations Governing Public Use on Corps of Engineers Water Resource Development Projects EP 1165-2-316 (http://www.publications.usace.army.mil/Portals/76/Publications/EngineerPamphlets/EP_1165-2- 316.pdf?ver=2013-08-22-104526-670)
1.10.2 Engineering Manual (EM) 385-1-1 (USACE – Safety and Health Requirements Manual), dated November 2014;
http://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385-1-1.pdf
1.10.3 Occupational Safety and Health Standards (29 CFR 1910);
1.10.4 Activity Hazard Analysis (AHA). The contractor shall prepare the AHA in accordance with Paragraph 01.A.14 or 01.A.15 of the EM 385-1-1. If using Paragraph 01.A.15, prepare the AHA IAW Figure 1-2.
Note: Contractors and other individual employer’s typically use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools. The government considers equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA, commensurate with the type of services the contractor is performing.
1.10.5 Abbreviated Accident Prevention Plan (APP). EM 385-1-1 in its entirety may be too complex for the type of work performed under these contracts; contractors may reference Appendix A, for abbreviated Accident Prevention Plan (APP). The contractor shall only need to submit items in Appendix A that are pertinent to the contract. The contractor shall use a qualified person to prepare the site-specific abbreviated
Accident Prevention Plan (APP). The contractor shall prepare the APP in accordance with the format and requirements of the EM 385-1-1 and supplemented herein. The contractor shall sign and submit the APP for approval prior to the start of work onsite.
1.11 Physical Security
1.11.1 The contractor shall be responsible for safeguarding all government facilities, property, and materials provided for contractor use. The contractor shall secure at all times all government facilities, property, and materials. Specific security conditions may change based on threats to national defense, and based on the risk of specific facilities to these threats. The contractor shall abide by these changing conditions at all times, as applicable.
1.11.2 Key Control. The contractor shall ensure all keys issued by the government are not lost, stolen, duplicated, or used by unauthorized persons.
1.11.2.1 The Contractor shall immediately report to the COR any occurrences of lost or stolen keys.
1.11.2.2 In the event keys, other than master keys are lost or stolen, the contractor may be required, upon written direction of the COR to re-key or replace the affected lock or locks without cost to the government.
The government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the payment due the contractor. If a master key is lost or stolen, the government may need to replace all locks and keys for that system. The government will deduct the total cost to replace the locks and keys from the contractor’s invoice.
1.11.2.3 The contractor shall prohibit the use of keys issued by the government by any persons other than the contractor’s employees. The contractor shall not facilitate access of secured areas to persons other than contractor personnel or subcontractors engaged in performance of contract work requirements.
1.12 Antiterrorism/Operation Security Requirements
1.12.1 Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area access and local security policies and procedures (provided by the COR). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
1.13 Payment
1.13.1 The government will make payment upon completion of all services, after the government has inspected and accepted the services, and the government has reviewed, approved, and processed the contractor’s invoice. The contractor shall submit the invoice to the COR or any other person that the COR has designated to receive the invoice.
1.13.2 The contractor must provide the contractor’s name, address, contract number, period of services completed (i.e., for the month of January or for the period of performance of January 1 through February 23), CLIN number and specific quantities of work performed (i.e., 1 Month, 40 days, 100 acres, etc.), and total requested, for an invoice to be considered proper. The contractor shall submit the invoice by the fifth (5th) of the month for services completed the previous month or submit the invoice upon completion of all services, in accordance with the period of performance stated in the CLIN.
2.0 Definitions. The following definitions and descriptions apply wherever the word(s) or phrase(s) is/are stated in this PWS:
2.1 Acceptable Level of Performance (ALP): The maximum percent defective, the maximum number of defects per hundred units, or the number of defects in a lot considered satisfactory on the average. The allowable leeway or variance from a standard before the government will reject the specific service.
2.2 Contracting Officer’s Representative (COR): means an individual designated as authorized in writing by the Contracting Officer to perform specific technical or administrative functions.
2.3 Performance-Based Contract (FAR 2.101): Structuring all aspects of an acquisition around the purpose of the work to be performed with the contract requirements set forth in clear, specific, and objective terms with measurable outcomes as opposed to either the manner by which the work is to be performed or broad and imprecise.
2.4Performance Requirements Summary (PRS): The PRS shows contract requirements, the component requirements related to each contract requirement, the price of each work requirement as a percentage of the associated contract requirement (Fixed Price Contracts), the standard of performance, and the acceptable level of performance (ALP) for each work requirement.
3.0 Government Furnished Items and Services
3.1 Services, Facilities and Equipment. The Government will provide the tower upper-level handrail fall-protection system, the 7.5-Ton Tower Crane, tool transport box, spanner wrench, and 10-ton rigging scale. The Government will operate or supervise the raising and lowering of Gate #2 and will assist the Contractor in adding blocking under Gate #2 to allow leakage flow.
3.2 Utilities. The Government will provide existing tower 110V power for use by the Contractor. The Contractor is responsible to know the limitations of the existing power facilities and will be responsible to repair all power-related accidents or outages. The Contractor will be responsible to provide all other utilities, including but not limited to, water, restroom facilities or used oil capture or clean-up facilities, and will instruct employees in utilities conservation practices.
4.0 Contractor Furnished Items and Responsibilities
4.1 General. The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.
5.0 Specific Tasks
5.1 Prior to the start of any work, the Contractor shall meet with USACE Tri-Lakes Project Office personnel to review all aspects of this contract, including a walk-through inspection at the work site.
5.2 USACE personnel will train the Contractor in the operation of the gate No. 2 hydraulic cylinder. Only the gate No. 2 hoist will be operated. Under no circumstances will other hydraulic cylinders be operated.
5.3 On the upper tower level, remove gate No. 2 well covers, cover support beams and install the USACE handrail system on the upper operating level.
5.3.1 The Contractor will strictly adhere to the USACE-approved fall protection plan when working around open gate wells.
5.3.2 Use of the 7.5-Ton Crane will be used to remove the gate well covers after installing the handrail system.
5.4 Inspect the 7½-ton overhead bridge crane and prepare it to lift the cylinder from its mounting. The larger 15-ton crane cannot access the cylinder center line, and shall not be used.
5.5 Transport Contractor-furnished and installed wood cribbing blocks to the lower level using the USACE-furnished tool transport box attached to the 7½-ton crane. These blocks will be used as safety blocking to support the cylinder assembly on its bonnet face after lifting.
5.6 Using the tool transport box, transport to the lower level needed tools and a clean oil drum and / or 5 gallon buckets to contain removed oil.
5.7 USACE personnel will place an emergency gate in slot #2 so work can be completed on Service Gate #2.
Contractor will need to place Lock-Out/Tag-Out protection on Service Gates #1 & 2 and Low-Flow Gate #2.
5.8 Prepare for wet tunnel access up to the emergency gates. An air meter will be in use during all personnel access of the wet tunnel, which is a non-permit confined space. The Contractor should anticipate that there will be some water in the tunnel from leakage at the emergency gate, and so should place adequate minor blocking under Service Gate #2 when it is in the closed/down position so water does not back up behind the Service Gate. After the wet tunnel is secure, transport the USACE-furnished spanner wrench and any other required tools up the wet tunnel to remove the lower leaf nut recess cover plate and the lower alloy leaf nut. The Contractor should expect that some or all of the recess cover cap screws will be “frozen” in place, causing difficulty in removing the access cover plate, and should plan to replace all of these screws.
5.9 Attach rigging to the stem extension at the top of the cylinder using the USACE-furnished threaded eye bolt while the gate is still in the lowered position.
5.10 Using the hydraulic system, completely raise the hydraulic cylinder stem. This will push the top stem extension shaft out of the service gate and top out the piston. Note: The control valves at the operating floor are spring return to open centers.
5.11 Once retracted, close the ball valves at the wall.
5.12 Oil in the cylinder does not need to be removed for weight, but there are no isolation valves at the cylinder and the hydraulic hoses connected to the cylinder are not long enough to allow the cylinder to be raised with the hoses still connected. With the gate stem fully raised, oil shall be drained from the cylinder by removing the cap or air vent at the very bottom of the lower pipe connection (just above the bucket). As the oil is being removed it shall be collected and placed into clean containers. (There is approximately 300 gallons of oil in the cylinder when in the raised position.) No attempt shall be made to disconnect the hoist hydraulic hoses until the crane has been attached to the upper stem extension, the gate stem is in the fully raised position and the oil has been removed from the cylinder. The crane should be connected before draining oil, as the gate hanger brake may not adequately hold the stem. The Contractor shall be responsible for the loss or spill of oil. If oil is spilled the Contractor shall clean all concrete surfaces and items covered with a solvent solution. The Contractor will mitigate any oil leakage out into the stilling basin and into Cherry Creek after consultation and approval of USACE.
5.13 With the hoist connected to the stem extension, the stem fully retracted and the oil removed from the cylinder, the upper hydraulic hose shall be disconnected from the cylinder and the lower hydraulic hose shall be disconnected from the hydraulic piping, adjacent to the isolation valve. The free end of the lower hydraulic hose shall be connected to the cylinder upper hose connection. The free end of the upper hydraulic hose shall be connected to the lower hydraulic piping. This will cause the cylinder and the piping to be “looped” preventing leakage of oil from both the piping system and the cylinder.
5.14 With the crane still connected to the stem extension, relax the pull from the crane (approximately 10 inches.) Remove three (3) brass studs equally spaced around the upper flange of the cylinder / cylinder head assembly. Install three (3) Contractor furnished 1-7/8” lifting eyebolts which are capable of lifting the required load. Contractor furnished rigging and / or slings shall be installed between the newly installed lifting eyebolts and the central clevis, making sure that the rigging does not interfere with the cylinder head. The crane should now be set up to lift the cylinder and bonnet cover assembly from the cylinder upper flange, and the gate stem and piston assembly from the stem extension.
5.15 Remove the forty-two (42) 1-5/8” diameter bonnet cover nuts from the studs taking care not to damage the gasket and seal, if there is one, between the bonnet and the bonnet seat plate. Nuts and gasket shall be safely stored to prevent misplacing, loss, or damage until reinstallation. Also see Item 2.28.
5.16 Using the 7-1/2 ton crane, raise the entire cylinder assembly approximately 6 feet or until the bottom of the stem is above the bonnet seating plate.
5.17 Crib up to each end of the bonnet and lower the hoist down to rest on the cribbing. For safety, crib up as the hoist is rising. Contractor shall furnish and transport all cribbing. Lifted assembly shall at all times remain attached and “snugged” to the 7-1/2 ton crane, even when the hoist is cribbed.
5.18 Cover the opening in the floor with plywood and / or tarps for safety and to keep from dropping parts or tools into the gate well. Any items dropped shall be retrieved by the Contractor. The opening and gate well are considered confined spaces.
5.19 The Contractor shall investigate to determine whether any damage has been done to the gate stem. Any visible damage shall be reported to the USACE Representative.
5.20 The upper gate leaf nut and spacer can now be removed. MARK OR MEASURE THE POSITION OF THE LEAF NUT IN RELATION TO THE END OF THE GATE STEM. Record the information.
5.21 Re-inspect integrity of the water packing seat and re-pack with new packing if required by USACE.
5.22 Raise the entire assembly slightly to allow for the removal of cribbing and the temporary cover over the gate slot. Lower the entire assembly showing care to align the bolt holes of the bonnet and the bonnet seat plate to facilitate the bolting of the bonnet back into place and to align the gate stem such that it is not damaged during the lowering operation.
5.23 Install all bonnet cover nuts from the studs taking care not to damage the gasket between the bonnet and the bonnet seat plate, if there is one. Replace any damaged nuts.
5.24 Remove the twenty (20) 1-3/4” diameter stud bolt holding the bonnet to the cylinder. Lift the cylinder/head assembly using care to continue to align the stem during the lift. Raise the assembly to the point that the threads in the stem for the lower leaf nut move past the water packing gland such that there is room to remove the water packing gland and install the new gland. Replace the used cylinder gasket with a new one. If the cylinder gasket is damaged, it shall be replaced by the Contractor. Use care not to damage the oil packing gland, oil packing seat, or the oil packing but, if any of these items are damaged or all oil is replaced, all shall be replaced by the Contractor.
5.25 Install the new water packing gland using the four (4) brass 7/8” studs.
5.26 Lower the cylinder/head assembly using care to align the gate stem such that the brass gland is not damaged. Align the bolt holes between the cylinder and the bonnet cover and reattach the cylinder/head assembly to the bonnet cover using the twenty (20) 1-3/4” diameter stud bolts. Raise the cylinder and bonnet to reinstall the upper leaf nut and spacer.
5.27 Prior to lowering and reseating the cylinder assembly the Contractor and USACE personnel shall inspect all work on the cylinder, the bonnet gasket and the condition of the top of the service gate.
5.28 If satisfactory, the hoist can be lowered, reseating the bonnet and reinserting the gate stem into the service gate. Provide 2 beads of water-proof sealant between the bonnet cover and the bonnet seating plate. The bonnet nuts shall be reinstalled and torqued evenly and all connection to the cylinder can be restored. USACE personnel shall be present until the bonnet is seated.
5.29 The Contractor shall again travel up the tunnel to reinstall the gate leaf nut and cover plate. All cover plate brass hardware will be replaced by the Contractor with new hardware.
5.30 The Contractor will be responsible for refilling with oil and bleeding the air out of the hydraulic system to the satisfaction of USACE. It may be desirable to try and prefill what equipment one can with oil to the extent possible. Air vent valves are available on the piping at appropriate locations. Old oil may be reused or it can be recycled and new oil added. New or used oil must be filtered thru a 5 micron filter prior to added to the system.
Hydraulic oil shall be Chevron Rykon Premium Oil ISO 32.
5.31 With a USACE representative present, test the operation of the gate and cylinder while bleeding any air from the system.
5.32 Upon satisfactory completion of the project, all work areas shall be thoroughly cleaned and restored to their previous state. Access hatches shall be reinstalled. The Contractor shall lightly brush touch up the paint on any disturbed coating areas on the cylinder that were disturbed under this contract only. The silver colored paint is aluminum based enamel and any other areas shall be alkyd based enamel. Color shall match the existing.
