Instructions to Quoters—Commercial Items
This solicitation is being advertise as a best value procurement. [If applicable, include the following: See FAR 52.212-2 Addendum; Evaluation—Commercial Items for specific information to be submitted with your quote.
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 1250 employees.
(b) Submission of quotations. Submit quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation.
(c) Due to the fact that the existing rig support body is a serialized property book item, upon award the successful vendor will need to sign a DA form 3161. For more information please refer to DA Pamphlet 710-2-1
Quotations are due by 15 August 2016 Send you completed quotation package to the attention of Matthew Hibbert at matthew.d.hibbert@usace.army.mil Electronic quotations are preferred over paper responses, unless other arrangements have been made with the individual identified above.
As a minimum, quotations must show-
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotations;
(3) The name, address, and telephone number of the quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3( b ) for those representations and certifications that the quoter shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Reserved.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during testing.
(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.
(f) Late submissions.
(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.
(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is late and will not be considered unless it is received before purchase order issuance and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.
(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(g) Issuance of purchase order. Quotations should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR part 15.
(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.
(i) Availability of requirements documents cited in the solicitation.
(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to-

(j) Data Universal Numbering System (DUNS) Number. (Applies to all quotations exceeding $3,000, and quotations of $3,000 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The quoter shall enter, in the block with its name and address on the cover page of its quotation, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the quoter’s name and address. The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the quoter to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the quoter does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. A quoter within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. A quoter located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The quoter should indicate that it is a quoter for a Government contract when contacting the local Dun and Bradstreet office.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of a quotation, the quoter acknowledges the requirement that a prospective contractor shall be registered in the SAM database prior to purchase order issuance, during performance and through final payment of any contract resulting from this solicitation. If the quoter does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to issue the purchase order to the next otherwise successful registered quoter. Quoters may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Requests for information. The contracting officer will not notify unsuccessful quoters that responded to this solicitation. Quoters may request information on purchase order(s) resulting from this solicitation from the contracting officer.
(m) Insurance Required (FAR 52.228-5):
In accordance with FAR 28.307-2, “Liability,” the contractor shall procure the following minimum insurance:

And, when contract performance involves use of vessels, the Contracting Officer shall require, as determined by the agency, vessel collision liability and protection and indemnity insurance. The contractor is responsible for contacting the state for compliance with its workman’s compensation laws.
(n) State and Local Taxes:
The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-
107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142.
Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors.
SPECS
Contract purchase for a new;
Water Tank Rig Support Body
General Specifications.
Contractor is to provide all materials and labor to build and mount a new rig support body to include water tank, crane, tool boxes, and diesel fuel tank to the Mack water truck with VIN number
1M2AG11C97M052093. The old support body will be removed and assessed a trade in value that will be accounted for in the contractor proposal and estimate.
The rig support body and tank shall have a minimum capacity of 2000 U.S. gallons and no more than
2500 Gal. The tank will be rectangular in shape and be no more than two feet in height, 8 feet in width and no more than 22 feet long. The rig support body shall be mounted to an existing U S Army Corps of
Engineers truck1.
The water tank and other components of the new rig support body shall be manufactured and assembled by certified welders (i.e FCAWG, AWS,) and conform to the most current DOT and OSHA standards.
Main Components of the Rig Support Body are as follows:
Water Tank
Tool boxes
Diesel fuel tanks
Flood lights
Ladders
Heavy duty telescopic crane
Heavy duty pintle hook towing hitch
Fold down table
Water tank
The water tank shall have a minimum capacity of 2000 gallons and be constructed entirely of ¼” steel plate, it shall also have a baffle system, and be lined with an EPA interior epoxy coating to prevent corrosion. Fill ports on the tanks shall be on the top and be 3” in diameter with a female cam‐lock. The tank shall have at least one vertical vent pipe. There shall be a minimum of 4 water discharge ports, one on each side and 2 at the rear of the body, all discharge ports will be 2” diameter with 2” ball vales and cam‐lock fittings on the end. The water tank shall have at least one site gauge. Both sides of the tank shall have cargo tie down rails with stake pockets (1 ¾ by 4 ¾ inches inside diameter) incorporated into the rail running the entire length of the body for the purpose of tying down drilling equipment on the top of the tank. The top of the tank shall be able to support a minimum of 16,000 lbs of equipment

The cab to axle length is 168” see photos including the crane. The whole Rig Support Body will be painted white to match the Government furnished truck.
Tool boxes
The rig support body as completed will have at least 2 vertical tool boxes and 4 horizontal boxes (2 boxes ahead of the axles and 2 behind the axles). All tool boxes shall be constructed out of at least 1/8” steel plate, they all shall have a locking mechanism and keyed a like. All tool boxes will have some sort of weather proof gasket or seal on the doors. The vertical tool boxes will be mounted behind the cab of the truck, general size shall be approximately 5’ high, 2’ wide, and 20” deep with at least 2 shelves. The horizontal tool boxes will be as large as possible as space permits ahead and behind the back axles and with at least 2’ of clearance from the ground. Within the horizontal tool boxes some compartments and shelves are required but exact placement and dimensions are left to then contractor to include in the proposal.
Diesel fuel tanks
Two diesel fuel tanks of a minimum 100 gallon capacity (each) will be mounted behind the cab and between the vertical tool boxes of the rig support body. These tanks shall have a powered pumping system with in cab controls. The diesel fuel hose for fueling rigs will be at least ¾” dia. x 50’ in length with an auto shut off nozzle on the end of the hose. The hose will be in a spring loaded reel mounted on top of the tanks. The installation of the diesel fuel tanks shall all be in accordance with the most current applicable D.O.T. and HAZMAT regulations.
Floodlights
At a minimum there shall be two manually adjustable floodlights mounted at the highest place on the rig support body. These floodlights will be an outdoor all‐weather 12V 80 watt LED light with in cab control switch.
Ladders
Affixed to the rig support body will be at least 2 ladders to access the deck of the truck. Both ladders shall have grab handles to provide stability. In accordance with OSHA and DOT standards.
Telescopic Crane
The exact specification for the crane mounted to the rig support body will be an IMT series 7500
Telescopic Crane or equivalent. See crane specifications attached. The crane shall have a 22 foot long boom with maximum lift of 7500 lbs and 2045 lbs capacity at maximum reach. The crane will be mounted on top of the deck on the back portion of the passenger side of the body. The pedestal for the crane will be structurally sound to provide the best stability in order to lift the maximum of the cranes capacity. Once mounted to the rig support body all standard features of the IMT 7500 crane will be function able through the radio remote controller including starting and shutting down the truck engine while stationary. Power activation for the crane will be from in cab control switch.
Heavy-Duty Pintle Hitch
Specification for the towing hitch shall be a Pintle hook with no less than 25 Ton rating. The hitch shall be securely mounted to the frame of the truck to handle this capacity. All other necessities for towing, a
7‐pole connector and wiring for lights, and air supply lines shall all be in accordance with D.O.T.
regulations.
Fold Down Table
Mounted to the rear of the rig support body shall be a fold‐down working table as wide as the body permits, approximately 8’ wide and 2’ deep with a strong (minimum weight capacity of 1000 lbs.)
expanded surface and its hinges securely mounted to the frame. With the addition of the table and other options to the rig support body all reflective markings, clearance lights, rear tail lights and back‐up lights will be in accordance with DOT requirements.
Trade in Value
Contractor’s proposal shall include trade in value of existing water tank, tool boxes, fuel tank, and crane.
Option 1
Contractor is to provide all materials and labor to build and mount a new rig support body to include water tank, crane, tool boxes, and diesel fuel tank to the International water truck with VIN number

EVALUATION--COMMERCIAL ITEMS
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. The following factors shall be used to evaluate quotes:
1. Past Performance – The quoter shall provide three references of projects completed within the past five (5) years. Experience can be based on projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work. These references need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all references.
2. Technical - Due the cost associated with the delivery of the truck, distance from Omaha, NE to the vendor’s location will be considered. To receive an “excellent” rating in this section, a vendor must be within 1500 miles from Omaha, NE 68112; an acceptable rating will be distances between 1201 and 1600 Miles; a fair rating will be anything further than 1601 from Omaha, NE. Distance will be calculated using www.Mapquest.com. lease note, this factor alone will not eliminate a vendor from completion. All factors will be evaluated to determine best value for the Government.
3. Price – The quote shall be inclusive of all costs to perform the work specified in the PWS. Additionally the total price will include any trade in value of the existing rig body
Technical and past performance when combined are significantly important than price.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within one (1) day. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

Only a warranted Contracting Officer (either a Procuring Contracting Officer (PCO), or an Administrative Contracting Officer (ACO)), acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUL 2016)
ALTERNATE I (OCT 2014)
The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C.
395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C.
