Chemical Weed Control Services

USACE- North Alabama Bend & Audubon Bend

PART 1

GENERAL INFORMATION

1. GENERAL: This is a Requirements service contract with both Firm Fixed Price (FFP) and

Time and Materials (T&M) pricing arrangements to provide chemical weed control serves on lands administered by the U.S. Army Corps of Engineers (USACE) Gavins Point Project.

1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform chemical weed control as defined in this PWS except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2 Background: The properties, known as North Alabama Bend and Audubon Bend, were purchased by USACE in 2009 as part of the Missouri River Recovery Program. This program is designed, in part, to restore and enhance biological diversity and hydrological processes associated with the Missouri River. North Alabama Bend consists of approximately 546 acres adjacent to the Missouri River plus approximately 100 acres of accreted ground. Approximately

55% of the property is wooded, 37% is open grassland, and the remaining 8% is a mixture of grassland and trees. Audubon Bend consists of 2,382 acres adjacent to the Missouri River with approximately 4.5 miles of riverfront. Approximately 36% of the property is irrigated cropland, 41.5% is recent native plantings (planted in 2011 through 2015), 17% is woodland, 5% is open grassland, and 0.5% is wetlands. The cultivated area is currently under an agricultural lease with a portion of the cultivated area planted to native habitat each year.

1.3 Objectives: Our primary goal is to effectively control noxious weeds/invasive species at

North Alabama Bend and Audubon Bend without damaging nearby trees and shrubs and minimizing damage to desirable ground vegetation. Noxious weeds/invasive species targeted for control may include Canada thistle (Cirsium arvense), musk thistle (Carduus nutans), plumeless thistle (Carduus acanthoides), leafy spurge (Euphorbia esula), purple loosestrife (Lythrum salicaria), common reed (Phragmites australis), saltcedar (Tamarix spp.), Russian olive

(Elaeagnus angustifolia), common buckthorn (Rhamnus cathartica), common burdock (Arctium minus), and other species. Our secondary goal is to control any undesirable vegetation in native habitat restoration plantings (that may out-compete planted species) at Audubon Bend.

1.4 Scope: The Contractor shall provide all labor, tools, transportation, materials, and equipment necessary to chemically control target vegetation as listed in Part 5 (Specific Tasks).

The Contractor will chemically control target vegetation without damaging nearby trees and shrubs and will minimize damage to non-target ground vegetation. Various types of chemical applications may be required. Some areas may require spot treatments, while others may require solid coverage. Basal bark applications may be required for some woody species. The Contractor shall follow all label instructions for mixing (including the addition of any adjuvants) and applying all herbicides. All herbicides shall be applied at the manufacturer specified mixture rate. All spray equipment shall be properly calibrated prior to spraying. All vegetation control operations shall be conducted in a safe and professional manner. The contractor is also responsible for accurately completing a Pesticide Application Record (PAR) for each application.

1.5 Period of Performance: The period of performance shall be three years. Depending on seasonal weather patterns and the target species, the spraying season typically lasts for seven (7) months per year (April thru October). Pricing will be separated by year as follows:

Base Year – Date of Award to June 30, 2017

Year 2 – April 1, 2017 through March 30, 2018

Year 3 – April 1, 2018 through March 30, 2019”

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Part 3 of this PWS.

4.2. Secret Facility Clearance: N/A

4.3. Utilities: The Contractor shall furnish their own municipal water source for tank mixing purposes. The Contractor is not authorized to utilize non-potable water from the Missouri River or water sources located within USACE lands for any purpose when conducting chemical application services.

4.4. Materials: The Contractor shall furnish all necessary materials, such as but not limited to, chemicals, insurance, permits, licenses, work plan, accident prevention plan, quality control, completed PAR forms, invoices, etc. to complete the requirements of this PWS.

4.5. Equipment: The Contractor shall furnish all necessary equipment, such as but not limited to, vehicles, spraying equipment, GPS unit, required safety equipment, etc. to complete the requirements of this PWS.

4.5.1 Spraying Equipment: Chemical application shall be accomplished by the use of ground spraying equipment (4-wheel drive vehicle with spray boom/gun, ATV with spray boom/gun, or backpack/hand-carry spray unit) only. Areas inaccessible by motorized vehicles will require the use of a backpack/hand-carry spray unit. Aerial spraying is not authorized under this contract.

4.5.1.2 Equipment Storage: The Contractor's equipment shall not be stored on Government property administered by the USACE Gavins Point Project. At the close of each work period, all chemicals, chemical mix, chemical refuse/waste, and equipment shall be removed from

Government lands. It is the Contractor’s responsibility to secure their personal property during working and non-working hours. The Government will not be held liable for damaged, lost, stolen, or vandalized property.

4.5.2 GPS Unit: Depending on the size, location, and type of spraying involved in the task order, work areas may be marked by field flags, flagging tape, other identifying markers, or they may be unmarked. The Contractor may need to navigate to work areas using aerial maps and/or GPS coordinates. To accurately navigate to a work area using GPS coordinates, the Contractor’s GPS unit shall be recreation grade or better.

PART 5

SPECIFIC TASKS

5. SPECIFIC TASKS:

5.1. Basic Services: The Contractor shall provide services to chemically control target vegetation without damaging nearby trees and shrubs and minimize damage to non-target ground vegetation. Some areas may require spot treatments, while others may require solid coverage.

Basal bark applications may be required for some woody species. Application rates for herbicides may be specified by in the task order or the Contractor may need to determine the proper application rate based on conditions. Application rates shall be such that the target species is killed and not simply injured. Work areas may be identified by markers or the Contractor may need to navigate to work areas using GPS coordinates and/or aerial maps.

5.2 Pre-Inspection of Work Sites. It is the prospective Contractor’s responsibility to inspect the sites where services are to be performed to satisfy themselves as to all general and local conditions that may affect the cost of performance of the agreement. Aerial photographs are available for review at the USACE Gavins Point Project Office in Crofton, Nebraska. The prospective bidder shall base their bid on their personal site visit/field assessments, rather than from any maps, aerial photos, or estimates that may be furnished by the Government as background/orientation information. In no event will a failure to inspect the sites constitute grounds for withdrawal of a bid after opening, or a claim after award of the agreement. Site visits can be scheduled with the COR at (402) 667-2569.

5.3 Type and Rates of Chemicals to be Applied: Only those EPA registered chemicals approved for use in the State of South Dakota/Nebraska and listed on the bid sheet shall be applied.

Chemicals shall be mixed and applied at rates consistent with their respective labels and manufacturer recommendations. Application rates shall be such that the target pest is killed and not simply burnt. The potential exists that not all of the chemicals listed on the bid sheet will be utilized during the period of performance. Pesticide costs will be paid as a reimbursable expense and only the actual amount applied shall be charged to the Government. Chemical costs will be reimbursed at the bid price submitted by the bidder on the bid sheet if those proposed prices are deemed reasonable by the KO. If the KO considers the proposed chemical prices unreasonable, the prices may be negotiated until acceptable by both the bidder and the KO. For chemicals not listed on the bid sheet, an acceptable price will be negotiated prior to acceptance and application of that chemical.

5.4 Weather Conditions: The Contractor shall identify weather conditions before beginning any herbicide application, and continue to monitor weather conditions throughout the course of the application. Manufacturer's label directions and warnings relative to temperature, wind, or other weather conditions shall be strictly adhered to. The Contractor shall immediately stop applying herbicides if weather conditions begin to adversely impact the application. Herbicide applications shall not take place when precipitation is expected before the herbicide formulation is rainfast. If treatment is followed by rain before the application is rainfast as specified in the herbicide label, the area shall be retreated at the Contractor's expense. Care shall be exercised at all times by the Contractor to protect desirable (non-target) species from damage by the required chemical applications.

5.5 Notification: The Contractor shall notify the COR by telephone no later than the working day prior to treatment. This will allow the COR to be on site if desired. It will facilitate access, coordination with partners and other contractors, and communication with the public.

5.6 Task Orders: The Contractor shall complete each Task Order within 14 days of the Task

Order being issued, unless an extension is granted by the KO. Requests for an extension must include a detailed explanation of why the task order could not be completed within the allotted timeframe and must be submitted in writing to the COR. Approval of extensions will be at the discretion of the KO. Some applications may allow a longer time period for application. Any application period that extends beyond the standard 14 day timeframe will be specifically stated in the Task Order. If there is confusion by the Contractor with regard to the Task Order, the

Contractor immediately contact the COR to clarify the areas to be treated. The target species, location, and estimated acreage of specific work areas shall be included with each Task Order at the time of issuance. Herbicide applications may include the following chemicals and conditions:

5.6.1 Spraying with Aminopyralid (Milestone® or equivalent): The main target species include

Canada thistle, musk thistle, and spiny plumeless thistle. Spraying for thistles, especially the biennial species, has been highly variable from year to year. Applications have typically been broadcast applications, though spot applications may also be necessary.

5.6.2 Spraying with Imazapic (Plateau® or equivalent): The main target species is leafy spurge.

Applications may include broadcast and/or spot spraying of selected areas as directed.

5.6.3 Spraying with Aquatic Formulation of Imazapyr (Habitat® or equivalent) in

Wetlands/Aquatic Areas: The main target species may include Canada thistle, purple loosestrife, common reed, and/or saltcedar. Aquatic spraying has typically been minimal in most years, but may vary considerably depending on conditions.

5.6.4 Spraying with Glyphosate (RoundupProMax® or equivalent) in Restoration Plantings:

Applications may include complete herbaceous vegetation control in woodland plantings prior to tree seedling emergence, complete herbaceous vegetation control around established saplings, complete vegetation control of areas in preparation for planting, and/or spot spraying of other selected areas as directed.

5.6.5 Spraying with Triclopyr (Pathfinder II® or equivalent): The main target species may include Russian olive, common buckthorn, or other invasive woody species. Spraying may consist of basal bark applications to trees less than 6 inches in diameter. The Contractor must use a dye when applying triclopyr to woody species.

5.7 Spraying Activities: The Contractor shall NOT start spraying until issuance of a task order.

It shall be the Contractor's responsibility to start and provide a continuous spraying operation from day to day, weather permitting, until completion of the contracted work within the allotted time frame. The potential exists for work areas to be in close proximity to areas of human activity. The Contractor is to avoid contact with the public, work force, livestock, and crops with either spray or drift. Holiday applications will NOT be allowed without prior authorization from the COR. If adverse weather conditions prevent the completion of the task order within the allotted time frame, the Contractor will be required to submit, in writing to the COR, a request for an agreement time extension, which must document the cause(s) for the call order not being completed on time. Lack of personnel, equipment, or other work priorities will not be acceptable reasons for allowing an agreement time extension. Approval of any agreement extension shall be at the determination of the Contracting Officer (KO).

5.8 Aquatic Sensitive Areas: Those areas designated as aquatic sensitive areas or are an aquatic area by nature shall only be treated with chemicals labeled for aquatic use. If an herbicide application is made to an aquatic area, a weather forecast for the 24 hour period immediately following the application must be submitted with the PAR. All aquatic sensitive areas will meet

NPDES requirements for the state in which they are located.

5.9 Record Keeping: All areas treated shall have PAR forms completed in accordance with the specifications set forth within this PWS. The Contractor shall be required to completely fill out an accurate, Government PAR form (Technical Exhibit 4) for each area treated on the day of application. The PAR form(s) shall be submitted to the COR within 10 days of the application.
