Justification and Approval For Other Than Full and Open Competition
1. Contracting Agency: The responsible contracting agency is the U.S. Army Corps of Engineers, Omaha District, Contracting Division (CENWO-CT).
2. Description of Action: This is a Service Disabled Veteran Owned Small Business set aside solicitation. The contract will be Firm-Fixed Price using Non-Military, Civil funds.
For the acquisition and installation of irrigation components connected to an existing irrigation system at the Fort Logan National Cemetery, Denver, CO, estimated at $400,000.00.
3. Description of Services: This project is for the U.S. Army Corps of Engineers, Omaha District, who is overseeing the acquisitions and construction of a gravesite expansion and cemetery improvement project at Fort Logan National Cemetery (In- Ground Cremains and Pre-Place Crypts, PN 888CM3038, Fort Logan National Cemetery, Denver, CO solicitation number W9128F-16-R-0014). A portion of this project includes the procurement and installation of irrigation components that will tie into an existing irrigation system at the cemetery. Irrigated areas at the cemetery include turf and plant material for burial areas and turf in areas of cemetery improvements.
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 gives DOD the authority to Sole Source Awards when there is only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1(a)(2) states:
“When the supplies or services required by the agency are available from only one responsible source… and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”
5. Reason for Authority Cited: The following items describe why it is in the best interest of the Government to Sole Source the new irrigation system components to be compatible with the existing irrigation system; any other course of action would result in a substantial duplication of cost to the government:
• The project will connect to, and expand, the cemetery's existing irrigation system.
The irrigation system components (including, but not limited to, quick coupling valves, remote control valves, and heads) must be fully compatible with the existing irrigation controllers and other hardware to provide a fully-integrated irrigation system for the cemetery grounds.
• The cemetery is responsible for maintaining the irrigation system and is required to stock replacement parts needed to maintain the system. It is not cost effective to purchase and stock different brands of irrigation components in order to complete repairs.
Stocking different brands of irrigation components will result in the inventory storage area needing to be enlarged in order to keep the parts separate and would complicate management of inventory levels. Additionally, the cemetery has certain tools on hand that are only compatible with certain components. If different brands of irrigation components are purchased, this may result in the cemetery needing to purchase additional tools that are compatible with those components. As such, this would increase acquisition costs.
• Additional time and cost will be incurred in training, tooling, and maintaining inventories for multiple brands of irrigation components.
6. Efforts to Obtain Competition: Based on the information provided in paragraph 5 above, competition was not feasible for this requirement; acquiring, storing, maintaining the inventory, and maintenance staff training would negate any possible savings and would add additional cost to the cemetery yearly operating cost.
7. Action to Increase Competition: There is no action required to increase competition.
8. Market Research: FAR 7.102(a) provides that agencies shall conduct market research for all acquisitions, and FAR Part 10 contains procedures for conducting such.
A technique for conducting market research includes contacting knowledgeable individuals in Government regarding market capabilities to meet requirements (ref FAR 10.002(b)(2)(i)). The PM, Brett Sichmeller, has knowledge of the industry and the requirements needed by the customer. The National Cemetery Administration has invested hundreds of thousands of dollars with its existing irrigation system to include training, spare parts and storage.
9. Interested Sources: At this time, there are no known other interested sources.
However, the Other Than Full and Open Competition notice will be posted for a minimum of 30 days and this paragraph will be revised based upon review of any response to that posting.
10. Technical Certification: “I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.”

11. Requirements Certification: “I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.”

12. Fair and Reasonable Price Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. The basis for this determination will be based on the Independent Government Estimate.
Certified cost or pricing date will not be required due to the response of the sources sought, it is reasonable to expect two or more responsible offerors to respond to this solicitation, FAR Part 15.403-1(c)(ii).
