Will the entire team that is awarded this IDC contract be allowed to also bid on the associated design build work?

On: Apr 15 2021.

It depends on the situation, but this is an example using the fictitious A-E, "Jones A-E, Inc."

-Design-Bid-Build (A D-B-B is 2 separate contracts, 1 for Design, 1 for

Construction): If Jones A-E, Inc. designs a project, then Jones A-E, Inc.

would be the Designer of Record. As the DOR, Jones A-E, Inc. cannot bid on the construction project, but that does not preclude any of the sub-contractors on their IDC from bidding on it. Jones A-E, Inc. could however provide the Construction Phase Services (submittal review, transition planning, commissioning, etc.).

Additional Important Information - Example:

On a Design-Build (1 contract for Design & Construction), the

Construction Contractor is awarded a D-B, then they hire Jones A-E, Inc. as the Designer of Record on the project. Jones A-E, Inc. could NOT provide the Construction Phase Services. This would be a conflict of interest, as the Government cannot have Jones A-E, Inc. submitting designs, while also being responsible for reviewing those designs on behalf of the

Government. In this example, the Government would award a contract for

Construction Phase Services to a different A-E. On: Apr 15 2021
