DEPARTMENT OF THE ARMY

LITTLE ROCK DISTRICT, CORPS OF ENGINEERS

Post Office Box 867

LITTLE ROCK, ARKANSAS 72203-0867

REPLY TO

Contracting Division Control No. SWL-14-11

Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity: U.S. Army Corps of Engineers, Southwestern Division, Little Rock District.

2. Description of Action: Request for quotations, firm-fixed-price service contract for rebuild of 6-yard Anvil/Hawco clam bucket used on the M/V Shorty Baird Manitowoc crane; estimated value - $40,000;

funding source - Civil Works O & M; vendor - Anvil Attachments, Slaughter, Louisiana.

3. Authority Cited: FAR 13.106-1(b) - Soliciting from a single source.

4. Reason for Authority Cited: This rehabilitation is required to extend the useful life of the 6-yard clam bucket which is used for daily and emergency dredging operations. Using the original equipment manufacturer (Anvil) provides for exact match of rollers, bearings, teeth, and attachments and also assures that off-the-shelf replacement parts are readily available for overnight shipment should repairs be required during emergency situations. This limits risk of failure for a major piece of Government equipment. Anvil also provides a six-month warranty on all parts, service, labor, and materials.

5. Market Research/Efforts to Obtain Competition: The price of a new clam bucket was quoted from Anvil at $73,000. A quote was obtained from TVA for rebuild at $70,000. A local welding firm was contacted, but they stated that they would use hardened steel on the jaw-knife edge only and mild steel elsewhere, which does not conform to plans and specifications; they could not provide a firm delivery schedule and were uncertain where to find replacement bearings and teeth. Anvil provides the best value to the Government in terms of cost and quality.

6. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Price will be evaluated based on government cost estimate.

Certified cost and pricing data will not be requested.
