(End of provision)
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (MAR 2020)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.
Additional copies will be issued for a fee.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) Reserved.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(1) The acquisition is being conducted as a Small Business set-aside using the Best Value Tradeoff (BVTO) source selection process for award. Award will be made to the offeror whose proposal is determined to present the best value to the Government with consideration of cost and non-cost factors.
(2) The Government intends to make an award without discussions, but reserves the right to conduct discussions should discussions prove to be necessary or advantageous to the Government. Because the Government does not intend to hold discussions, offerors are encouraged to include their best pricing in their initial proposal.
(3) All proposals received will stand alone and be considered complete and final. The Government will not consider any information or data incorporated by reference or otherwise referred to. The successful offeror(s) will be selected solely on the basis of the evaluation factors set forth below. Accordingly, proposals submitted in response to this solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors.
Elaborate proposals, color brochures, and other excesses are discouraged.
(4) Joint Ventures (JV). A joint venture is defined as a legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements such as “teaming agreements” or “strategic alliances,” which are not recognized as bona fide joint ventures for the purposes of this solicitation. An offeror that is a joint venture shall submit a copy of its legally binding joint venture agreement signed by an authorized officer from each of the firms comprising the joint venture with the chief executive of each entity identified. If submitting a proposal as a joint venture, the experience and past performance of each of the joint venture partners can be submitted for the joint venture entity. The experience for each joint venture partner will be considered the experience of the joint venture entity.
B. Evaluation Factors.
The Government will evaluate proposals using the following factors:
Past Performance (Factor 1) Technical Capabilities (Factor 2) Response Time (Factor 3) Price (Factor 4) mailto:staff@rcesupport.com
Factors 1 and 2 are approximately equal in importance to one another. Factor 3 will be evaluated on an acceptable/unacceptable basis, and will not be considered in the tradeoff analysis. A proposal must be found acceptable under Factor 3 to be considered for award. Factors 1 and 2, when combined, are significantly more important than price.
The Government will use the following definitions when evaluating proposals:
Deficiency – A material failure of a proposal to meet a Government requirement or a combination of weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
Significant Weakness – A flaw a proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
Weakness – A flaw in a proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.
Strength – An aspect of a proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Significant Strength – An aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
Volume I – TECHNICAL (Non-Price) SUBMISSION REQUIREMENTS AND EVALUATION METHOD
A. Past Performance (Factor 1)
Submission Requirements
The offeror shall submit information for up to five (5) projects* that best demonstrates the offeror’s experience on projects that are similar in size, scope, and complexity to this project, as described in the RFP’s Statement of Work (PWS). Note: To be considered, the project must have been completed by the offeror, i.e., not the offeror’s subcontractor.
To be evaluated, each project must have been completed or must be substantially complete** by the offeror within five years of the date that proposals are due.
*A maximum of five projects will be evaluated. If an offeror disregards these instructions and submits more than five projects, only the first five projects will be evaluated. Offerors should describe each project with enough detail to ensure that the Government can meaningfully assess the projects against the evaluation criteria described in the RFP.
**Substantially complete is defined as being 50% complete by the date that proposals are due. If an offeror submits a project that it represents is “substantially complete,” the offeror must reasonably explain why the project is considered at least 50% complete. If an offeror submits an ongoing project without providing an accompanying reasonable explanation that explains how the project is at least 50% complete, the Government reserves the right to reject the project.
For each project submitted, the offeror shall provide a project description using the “Offeror Experience Form” provided as Attachment A (or a document that addresses all of the information included in Attachment A).
The offeror must address all items included on Attachment A.
Note: The project description submitted for each project shall not exceed two (2) pages per project.
For each project submitted, the offeror also shall provide past performance information:
• If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, submit it with the proposal.
• If there is not a completed CPARS evaluation, submit a completed Past Performance Questionnaire (PPQ) for the project. The standard PPQ for USACE is Form PPQ-0 (9/30/11) and it is provided as an attachment to this solicitation. Offerors are advised to ensure correct phone numbers and email addresses are provided for the client point of contact. Do not submit a PPQ when a completed CPARS evaluation is available.
o If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Megan Acord, via email at megan.l.acord@usace.army.mil, prior to proposal closing date.
Offerors shall instruct the clients to refer to the solicitation number in the subject line.
o PPQs are source selection materials. All successfully submitted PPQs will receive an email confirmation upon receipt. If the offeror does not receive the confirmation, it is the offeror’s responsibility to follow up to ensure the Government has received the information.
Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror.
In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including CPARS, using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror.
Evaluation Method
The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements. The evaluation method that the Government will use with respect to Factor 1 – Past Performance is detailed below.
There are three aspects to the past performance evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information).
The first aspect is to evaluate the recency of the offeror’s past performance. For this solicitation, recent projects are those completed or substantially completed (as defined above) within five (5) years of the date that proposals are due.
The second aspect is to determine how relevant a recent effort accomplished by the offeror is to the work required by this RFP. There are four levels of relevancy as shown in the Table below.
mailto:megan.l.acord@usace.army.mil
Past Performance Relevancy Ratings
Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Present/past performance effort involved some of the scope and magnitude Relevant of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
In determining the relevancy of each submitted project, the Government will consider the following:
• The extent to which the submitted project meets or exceeds the expected dollar value of task orders to be issued under this contract, which is estimated to average between $40,000 and $200,000.
• The extent to which the submitted project involved hydrometeorological programming or software.
• The extent to which the submitted project demonstrates experience in multiple areas described in Section
3.2 of the PWS.
The third aspect of the past performance evaluation, quality, is to determine how well the offeror performed on its past performance projects.
A final Performance Confidence Assessment rating will be given for this factor based on the assessment of recent and relevant past performance information and the assessment of the quality of past performance on prior contract efforts. The Government will review the past performance information and determine the quality and usefulness as it applies to the performance confidence assessment. In conducting a performance confidence assessment, each offeror shall be assigned one of the ratings using the Table below.
Performance Confidence Assessments
RATING DESCRIPTION
Substantial Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the Offeror will be able to successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
In the case of an offeror without a record of relevant past performance or for which information on past performance is not available, the offeror may receive a Neutral Confidence rating which is neither favorable nor unfavorable; it is considered neutral.
B. Technical Capabilities (Factor 2)
Submission Requirements
Key Personnel – The offeror shall submit one résumé for the individual whom the offeror will provide to fulfill each of the following key personnel labor categories described in Section 6.5 of the PWS:
• Software Analyst/Programmer

(6) Relevant technical experience.
Note: Each résumé submitted shall not exceed two (2) pages.
Initial Task Order Work Plan – Concurrently with the award of this contract, the Government will award an initial task order (TO) under the contract. In order to permit the Government to evaluate the offeror’s technical capabilities, the offeror shall submit its work plan for the initial TO.
The Performance Work Statement (PWS) for the TO is attached to this RFP as Attachment C. The offeror’s work plan shall describe how the offeror plans to identify, detail, and schedule appropriate tasks, how it will maintain necessary lines of communication between the offeror and the appropriate Government agencies, and how it will conduct coordination among technical disciplines. It is the offeror’s responsibility to affirmatively document these qualities in its work plan after reviewing the PWS for the initial TO.
The offeror’s work plan must include, but is not limited to, the following:
(1) Information on project organizational structure. Include a description of each employee’s roles and responsibilities on this project. Include all review personnel. To the extent that the offeror’s listing of personnel includes key personnel positions as described above, those personnel must match the personnel whose résumés are provided for key personnel.
(2) A plan of how the offeror will meet the overall project objective as stated in the TO PWS, and how the offeror will meet each identified task in the TO PWS.
(3) A project schedule based on all requirements within the TO PWS. The schedule shall identify all critical activities to demonstrate the offeror’s understanding of the requirements. These activities should include review processes requiring Government responses, and all coordination activities.
(4) Data collection and analysis methods for all objectives and tasks identified in the TO PWS.
(5) Specific services, data, and assistance required from USACE for completion of the TO.
(6) The plan must include a breakdown of all personnel required for this TO, to include the total amount of labor hours for each of the labor categories the offeror proposes to use to complete the TO.
Note: The work plan submitted shall not exceed four (4) pages.
Evaluation Method
This factor is designed to measure the offeror's understanding of the requirement, to include the offeror’s plan to address challenges inherent in the work. The offeror must demonstrate that it understands the Statement of Work and has the capability to perform the required work. This factor will be evaluated as one factor addressing the following two areas:
Key Personnel – The Government will evaluate the experience and qualifications of the offeror’s key personnel to meet the requirements of the contract. In determining strengths and weaknesses, the Government will consider the following:
• Key personnel qualified in multiple labor categories. The Government will more favorably evaluate proposals with key personnel demonstrating qualifications in multiple labor categories.
• The extent to which the résumés of the offeror’s proposed key personnel exceed the minimum education and experience requirements set forth in Section 6.5 of the PWS.
o NOTE: At a minimum, the résumés submitted for key personnel must demonstrate that the offeror’s key personnel satisfy the minimum education and experience requirements set forth in Section 6.5 of the PWS.
• The extent to which the résumés of the offeror’s proposed key personnel demonstrate significant and progressively responsible duties related to the labor category for which they are proposed.
Initial Task Order Work Plan – The Government will evaluate the initial TO work plan provided by the offeror and evaluate the technical expertise represented in the plan. In determining strengths and weaknesses, the Government will consider matters such as:
• How the offeror proposes to staff the project, including cross-functional staffing approaches and review personnel;
• How the offeror proposes to meet the overall project objective as stated in the TO PWS, and how the offeror will meet each…
