BINDING RATES
BINDING LABOR RATE SCHEDULE
The rates proposed are legally binding and will be the maximum rates that the offeror will use for all firm-fixed price task orders issued within the 5-year performance period of the contract.
Lower rates may be offered at the task order level. The offeror shall provide proposed labor rates for each year. There will be no renegotiation of rates annually based upon the current Consumer Price Index.
Offerors must include the burdened hourly rate for each labor category to include overhead and profit. The offeror’s labor rates shall contain all the offeror’s costs inclusive of profit, all overhead (to include home office and field overhead), cost escalation, labor burden, insurance, general and administrative expenses, subcontractor mark-up, and all other costs in the single, firm-fixed price, rate offered. For individual task orders written against the contract, the appropriate Department of Labor Wage Determination will be provided.
All delivery orders or task orders awarded in a calendar year are subject to that respective year’s binding labor rates.
If performance of a delivery order or task order occurs during multiple calendar years, the binding labor rates from the first calendar year of performance shall apply to the delivery order or task order as a whole.

52.212-1 ADDENDUM
SUBMISSION OF PROPOSALS
A. Administrative Details and General Instructions: Proposals are due no later than the time and date specified in Block 8 of Standard Form 1449.
(1) Offeror shall submit its proposal through the FedBizOpps (FBO.gov) system. The requirements and procedures for offer submission are found in the FBO Vendor User Guide located on the FBO webpage at:
https://www.fbo.gov/downloads/FBO_Vendor_Guide.pdf.
(2) The proposal submittal method used for this solicitation is the electronic response via document upload method.
(3) The electronic proposal shall be Portable Document Format, filename extension: “.pdf” and suitable for viewing in Adobe Reader. Offerors shall bookmark and label each electronic PDF to afford easy identification from the proposal table of contents.
(4) Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Propriety information shall be clearly marked. DO NOT cross reference past performance information. It is acceptable to repeat data, project information or experience in more than one non-price area as long as it satisfies the requirements of the factor. Extraneous information provided in the proposals will not be considered in the evaluations; therefore, the offeror should only provide information that satisfies the solicitation requirements. Merely restating the performance work statement or evaluation criteria without sufficient elaboration demonstrates a lack of understanding of the requirement.
(5) The offeror must confine the proposal to relevant information and documentation sufficient to provide an adequate basis for evaluation.
(6) The Offeror’s proposal shall consist of two (2) volumes; Volume I – Technical Proposal and Volume II – Price Proposal. The use of hyperlinks in proposals is prohibited.
a. Technical Proposal, Volume I: Volume I shall consist of information for the three (3) technical factors, as stated in FAR clauses 52.212-1:
i. Key Personnel (Factor 1)
ii. Experience (Factor 2)
1. Subcontractor Letter(s) of Commitment, if applicable
iii. Past Performance (Factor 3)
b. Price Proposal, Volume II: Volume II shall be prepared in accordance with the following and must include:
i. SF 1449 – Solicitation The Offeror shall complete the SF 1449 Blocks 17a, 30a, 30b, and 30c and have it signed in Block 30b by an official that is authorized to bind the company. The offeror shall also provide and acknowledge all amendments in accordance with the instructions on the SF 30, if applicable.
ii. Price: Binding Rate Schedule
The offeror shall complete the Binding Rate Schedule found in the solicitation, which has identified the labor categories that are required under the contract. The offeror shall enter the proposed labor rate for each labor category for each calendar year, and use the estimated annual hours provided to calculate the total proposed price.
Offerors must include the burdened hourly rate for each labor category to include overhead and profit. The offeror’s labor rates shall contain all the offeror’s costs inclusive of profit, all overhead (to include home office and field overhead), cost escalation, labor burden, insurance, general and administrative expenses, subcontractor mark-up, and all other costs including but not limited to preparation of reports, correspondence and documentation required by law or the contract specifications, tax law, and costs necessary to interface with government representatives, and coordination with occupants and other contractors when required.
iii. Representations, Certifications, and other Statements of Offerors.
The offeror shall complete all representations and certifications within FAR 52.212-3 Alt 1, and also ensure current registration and completed/updated Annual Representations and Certifications on the System for Award Management (SAM) website, www.sam.gov.
(7) Offerors should enter a description for every file uploaded. For files over 10 megabytes (MB) the "Large
Upload (JAVA)" button must be used. The combined file size limit for upload using "Large Upload (JAVA)" is 100MB. If needed, the offeror can break single files over 100MB into smaller files or use the upload utility multiple times if files exceed the 100MB size limit.
(8) Once the Offeror's proposal is submitted, it can be systematically revised prior to the solicitation response deadline. Refer to Paragraph 4.3.2 of the FBO Vendor Guide titled "Reviewing / Editing an Electric Response" for detailed guidance on completing a revision to an electronic proposal submission. Note: the FBO bid response system will send an email to the email address on file for the user confirming the electronic submission.
(9) Note: the Offeror must be logged into the system to be able to submit / revise electronic responses.

(11) Do not assume submission will be instantaneous. File size and number of files to be uploaded will be factors to consider. Offeror/Teammate/Subcontractors should allow adequate time for submission completion because the entire proposal (i.e. Offerors submission and all Teammate/Subcontractor(s) independent submissions) must be received by the due date and time for the proposal to be considered.
(12) To avoid rejection of an offer, the Offeror must make every effort to ensure its electronic submission is virus-free. Proposals, or portions thereof, submitted with the presence of a virus or which are otherwise unreadable will be treated as unreadable pursuant to FAR 15.207(c).
B. Bidder Inquiries
All inquiries regarding this solicitation must be submitted via the ProjNet Bidder Inquiry System. Telephone and email inquiries will not be accepted. Bidder Inquiry is a web-site that allows offerors to post questions regarding the solicitation and view all questions by other offeror and the responses by USACE. ProjNet can be accessed at:
https://www.projnet.org
To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment /question will receive an acknowledgement of their comment/question via email. Another email to the same address will notify the prospective vendor once the reply is available for viewing.

To submit and review bid inquiry items, bidders will need to be a current registered user or self-register into system.
To self-register go to web page, click BID tab select Bidder Inquiry, select agency USACE, enter Key for this solicitation listed below, and you e-mail address, click login. Fill in all required information and click create user.
Verify that information on next screen is correct and click continue.
Specific Instructions for ProjNet Bid Inquiry Access:
1. From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.
2. Identify the Agency. This should be marked as USACE.
3. Key. Enter the Bidder Inquiry Key listed above.
4. Email. Enter the email address you would like to use for communication.
5. Click Continue. A page will then open saying that a user account was not found and will ask you to create one using the provided form.
6. Enter your First Name, Last Name, Company, City, State, Phone, Email, Secret Question, Secret Answer, and
Time Zone. Make sure to remember your Secret Question and Answer as they will be used from this point on to access the ProjNet system.
7. Click Add User. Once this is completed you are now registered within ProjNet and are currently logged into the system.
Instructions for Entering Questions:
1. After you are logged in click on the "post new inquiry", it is on the left side of the window under the Word "Submit"
a) This is the window where you will enter your questions.
b) Comment Classification: Click on the down arrow to the right of the words “Please select from below”, select “Public”.
c) Discipline: This is where you select who this question should be directed to. There may be dropdowns based upon the discipline selected to narrow down the topic of your question.
d) Question. Enter your question here.
Specific Instructions for Future ProjNet Bid Inquiry Access:
1. For future access to ProjNet, you will not be provided any type of password. You will utilize your Secret
Question and Secret Answer to log in.
2. From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.
3. Identify the Agency. This should be marked as USACE.
4. Key. Enter the Bidder Inquiry Key listed above.
5. Email. Enter the email address you used to register previously in ProjNet.
6. Click Continue. A page will then open asking you to enter the answer to your Secret Question.
7. Enter your Secret Answer and click Login. Once this is completed you are now logged into the system.
Only one question will be allowed per inquiry. If multiple questions are included in a single inquiry, only the first question will be answered. All others will remain unanswered until entered in a single inquiry.
Bidders will receive acknowledgement of their question via email, followed by an answer to their question after it has been processed by our technical team.
The Bidder Inquiry System will be unavailable for new inquiries 5 days prior to the proposal due date in order to ensure adequate time is allotted to form an appropriate response and amend the solicitation, if necessary.
Offerors are requested to review the solicitation in its entirety, and review the Bidder Inquiry System for answers to questions, prior to submission of a new inquiry.

No response will be posted to inquiries after the Close of Business on the seventh (7th) business day preceding the solicitation due date (Nov 12th). All prospective offerors will be held to have reviewed the questions and responses in ProjNet prior to proposal submission. Nothing in the solicitation is changed unless a solicitation amendment is sent out.
C. Proposal Format:
a. Format: The submission shall be clearly indexed and logically assembled. Each volume shall be clearly identified and shall begin at the top of a page. All pages of each volume shall be appropriately numbered and identified by the complete company name, date and solicitation number in the header, footer or both.
A Table of Contents should be created using the Table of Contents feature in MS Word. MS Word (.doc) files shall use the following page setup parameters:
Margins – Top, Bottom, Left, Right – 1” Gutter – 0” From Edge – Header, Footer – 0.5” Page Size, Width – 8.5” Page Size, Height – 11”
The following additional restrictions apply:
Each volume shall be submitted electronically. Any portion of the proposal that is changed (as a result of negotiations or proposal revisions) should be annotated and dated.
Each paragraph should be single spaced, and shall be separated by at least one blank line. A standard business, 12-point minimum font size applies. Arial or New Times Roman fonts are required. Tables and illustrations may use a reduced font size no less than 8-point and may be produced in landscape mode.
b. Content Requirements: All information shall be confined to the appropriate tab. The offeror shall confine submissions to essential matters, sufficient to define the proposal and provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of each proposal. Each file of the proposal shall consist of a Table of Contents, Summary Section, and Narrative discussion. The Summary Section shall contain a brief abstract of the file. Proprietary information shall be clearly marked.
c. Technical Proposal – General: No materials shall be incorporated by reference, but references from one area to another are permissible, to avoid unnecessary duplication of information. Clear and specific responses to each solicitation item are required. The Technical Proposal shall be incorporated and made part of any subsequent contract.
As the Technical Proposal shall describe the capability of the Offeror to participate in this effort, it should be specific and complete in every detail.
SUBMISSION REQUIREMENTS FOR EVALUATION CRITERIA
A. FACTOR 1 (TAB 1) – Key Personnel Submit one resume, no longer than two (2) pages, for each individual whom the offeror proposes to fulfill the following key personnel labor categories described in section C.1.3 of the PWS:

NOTE: The contractor shall obtain the consent of the Contracting Officer prior to making key personnel substitutions. Replacements for key personnel must possess qualifications equal to or exceeding the qualifications of the personnel being replaced, unless an exception is approved by the Contracting Officer.
At a minimum, each resume shall include the following:
Name of individual;
Labor category the individual will perform under;
Current Employer;
Total years of experience in the labor field;
Education (degrees and/or specialization);
Relevant experience, to include the dates experience performed; and Professional registrations, certifications, and licenses (as applicable).
NOTE: At a minimum, resumes must demonstrate that the individual proposed to perform the identified labor category meets the minimum qualification requirements for that position as outlined in the PWS.
B. FACTOR 2 (TAB 2) – Experience The Offeror shall submit information on up to five projects completed or currently ongoing that are similar in size, scope, and complexity to the tasks outlined in the solicitation PWS. Offeror shall submit no more than 10 pages. Documentation that exceeds 10 pages will not be considered by the Government.
Information submitted for each project must include the information outlined in Attachment A, Offeror’s Experience Form.
To be evaluated, each project must have been completed or must be substantially complete within 10 years of the date that proposals are due.
A maximum of five projects will be evaluated. If an Offeror disregards these instructions and submits more than five projects, only the first five projects will be evaluated. Offerors should describe the project with enough detail to ensure that the Government can meaningfully assess how well the project submitted meets the evaluation criteria outlined below.
A project is defined as work performed under a stand-alone contract or task order. An IDIQ contract or other similar ordering vehicle is not considered a “project;” however, a single task order issued under an IDIQ or other similar ordering vehicle may be considered a “project” under this evaluation factor.
Substantially complete is defined as being 75% complete by the date that proposals are due. If an offeror submits a project that it represents is “substantially complete,” the offeror must reasonably explain why the project is considered at least 75% complete. If an offeror submits an ongoing project without providing an accompanying reasonable explanation that explains how the project is at least 75% complete, the Government reserves the right to reject the project.
Past Projects of Key Personnel – To demonstrate its experience in categories for which the prime offeror does not have company experience, the offeror may submit past projects of the following key personnel if those individuals will be performing supervisory roles under the awarded contract:

Past Projects of Subcontractors – To demonstrate its experience, the offeror may submit past projects of the subcontractors it plans to perform work under the IDIQ. However, subcontractor projects will only be considered if the project is accompanied by a written letter of commitment, signed by the prime offeror and proposed subcontractor. In addition, the offeror must also clearly indicate which specific tasks the subcontractor will be performing on the IDIQ.
FACTOR 3 (TAB 3) – Past Performance
Submit past performance information for each project listed by the offeror under Experience – Factor 2.
If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, submit it with the proposal.
If there is not a completed CPARS evaluation, submit a completed Past Performance Questionnaire
(PPQ) for the project. The standard PPQ for USACE is Form PPQ-0 (9/30/11) and it is provided as Attachment B to this solicitation. Offerors are advised to ensure correct phone numbers and email addresses are provided for the client point of contact. Do not submit a PPQ when a completed CPARS evaluation is available.
o If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).
o Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Kevin Flores, via email at kevin.d.flores@usace.army.mil, prior to proposal closing date. Offerors shall instruct the clients to refer to the solicitation number in the subject line.
o PPQs are source selection materials. All successfully submitted PPQs will receive an email confirmation upon receipt. If the offeror does not receive the confirmation, it is the offeror’s responsibility to follow up to ensure the Government has received the information.
Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror.
In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including CPARS, using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror.
PERFORMANCE WORK STATEMENT
DESCRIPTIONS/SPECIFICATIONS/WORK STATEMENT
PLANNING AND ENVIRONMENTAL STUDIES MATOC
C.1 GENERAL
C.1.1 General Information
The Government intends to award at least two (2) but a target of (5) Indefinite-Quantity, Indefinite-Delivery (IDIQ) Multiple Award Task Order Contracts (MATOCs) for Planning and Environmental Studies with a total maximum capacity of $10,000,000.00. The professional services will be provided for the U.S. Army Corps of Engineers (USACE) Northwestern Division (NWD) Portland District (NWP), Walla Walla District (NWW), and Seattle District (NWS). The objective is to award individual Firm Fixed Price (FFP) contracts, each containing a five year base. The Performance of work will be authorized by issuance of task orders by the Government Contracting Officer for the Contractors to perform studies and analyses and preparing reports and supporting documents related to the USACE planning and environmental processes for Civil Works program studies and projects, within the USACE NWP, NWW, NWS boundaries.
Specific services and task activities are listed in Paragraph C.2. The description of work stated herein provides a general understanding of the Contractor functions to be performed. Work will be executed under individual Task Orders (TO) using Performance Work Statements (PWS).
C.1.2 Performance Work Statement (PWS)
The Contractor shall furnish all personnel, materials, and services to perform planning and environmental services required in support of water resource studies and projects. Services are anticipated to accomplish the breadth of Planning and Environmental Studies that are under the authorities of the U.S. Army Corps of Engineers that would include General Investigation authority, the Continuing Authorities Program, Construction General, and Operations and Maintenance activities. Planning Authorities include ecosystem restoration, navigation, water supply, flood risk management, Planning Assistance to States and Tribes, Reallocation Studies, Major Rehabilitation Studies, Major Maintenance Reports, post authorization change reports, dredge material management plans, and environmental investigations, reports and documents demonstrating compliance with applicable federal cultural and environmental laws, regulations and executive orders. These services could include the following:
C.1.2.1 Plan Formulation. In accordance with federal water resource planning principles and procedures (primary guidance being ER 1105-2-100, Planning Bulletins, and Planning Primers 1 and 2, Risk Informed Planning Manual), conducting a wide range of planning studies and analyses of problems and opportunities, inventory and forecast (defining existing and future without project conditions), developing evaluation and screening criteria, formulating measures and alternative plans, evaluating and comparing alternatives, making recommendations regarding project implementation, and justifying plans based on the 4 decision criteria: completeness, acceptability, efficiency and effectiveness in order to select the plan that meets National Economic Development (NED) and/or National Ecosystem Restoration (NER). The alternatives development, evaluation and selection process often require utilization of models and model outputs from multiple disciplines to include Engineering, Economics, and Environmental. Examples include HEC-RAS, HEC-FDA, HarborSym, HEP/HSI, IWR-Planning Suite, at Risk, and others. Lead team meetings to demonstrate to internal and external customers the iterative nature of the six step planning process in water resources projects.
C.1.2.2 Planning Documents. Preparing partial or complete planning documents such as initial appraisals, feasibility, post-authorization and other reports that are policy compliant and follow agency processes.
This includes preparatory materials for interim milestone meetings with higher headquarters and decision-makers. Feasibility reports will be integrated with environmental compliance documentation, for example an integrated Feasibility Report and Environmental Impacts Statement (FR/EIS).
C.1.2.3 Economics. Conducting water resource economic analyses and modeling using Corps guidance and procedures found in ER 1105-2-100 and ER 1105-2-101, and the latest Economic Guidance Memoranda, Planning Guidance Letters, Engineering Pamphlets, Manuals, Circulars, Guidance Memos and Planning bulletins located in the Planning Community Toolbox. The economic analysis determines federal interest for investment in water resources infrastructure and identifies the National Economic Development (NED) or National Ecosystem Restoration (NER) Plans to include cost benefit ratios.
C.1.2.4 Environmental Compliance. Conduct and assist the Government in preparing required environmental compliance investigations and documents to comply with federal laws, regulations, executive orders, and policies including state and local requirements, as applicable to federal actions. Consistent with Corps policies and regulations for conducting environmental compliance requirements for civil works projects.
C.1.2.5 NEPA Documents. Preparing partial or complete documents relating to compliance with the National Environmental Policy Act (NEPA). Documents should be prepared in compliance with agency regulations and policies found in 33 CFR 230 and ER 200-2-2 and Council on Environmental Quality (CEQ) regulations at 40 CFR 1500-1508 and CEQ policies and guidance.
C.1.2.6 Cultural Resources. Conducting cultural resources studies and analyses and preparing documents under the National Historic Preservation Act and related laws and regulations.
C.1.2.7 Technical Analysis. Conducting, compiling, data compilation and documenting, for the purposes of planning studies, engineering analyses such as hydrology, reservoir operations, hydraulic, flood plains, civil designs, geotechnical analyses, seismic analyses, geo-technical borings and analyses and other technical information needed for the decision documents. This analysis includes preliminary engineering designs to support evaluation and plan selection and cost estimates for making recommendations to Congress for appropriations. Cost Estimating in support of comparison, evaluation, selection and determination of cost-benefit ratios and total projects costs.
C.1.2.8 Habitat Evaluation. In accordance with federal water resource planning principles and procedures.
Researching, selecting, developing, conducting and documenting ecosystem habitat surveys and modeling. Includes formulating ecosystem restoration plans as part of item 2.1.1 and for any mitigation requirements of unavoidable impacts on civil works studies and projects.
C.1.2.9 Monitoring and Adaptive Management Plans. In accordance with Implementation Guidance for Section 2039 of WRDA 2007 recommended projects for ecosystem restoration or other types of projects that require mitigation must include monitoring for the success of the project. Monitoring plans must include the rationale for monitoring, including key project specific parameters to be measured. They must include estimated costs for the monitoring. An adaptive management plan will also be developed and needs to include costs for implementing the plan if deemed necessary.
C.1.2.10 Hazardous, Toxic, and Radiological Waste (HTRW). Conducting and documenting Phase I and Phase II environmental site assessments to document the existence of HTRW within a study or project area.
C.1.2.11 Geographic Information Systems (GIS). Using GIS, create, store, access, and display data and mapping information.
C.1.2.12 Technical and Other Review. Provide necessary documentation and support for responding to technical review comments on products, public review comments, and quality assurance and policy reviews. In addition will be responsible for tracking and organizing all comments received during concurrent reviews as well as assignment and tracking of responses to comments and ensuring all comments are resolved and closed.
C.1.3 Performance Based Contract Task Orders (TO)
Work will generally fall under TOs using Performance Work Statements (PWS). A performance based schedule of services structures all aspects of an acquisition around the purpose of the work to be performed and does not dictate how the work is to be accomplished.
The description of work stated herein provides a general understanding of the Contractor’s functions to be performed; individual TOs will contain the specific performance based requirements and the evaluation criteria. The evaluation criteria will be identified in each TO as lowest price technically acceptable or trade-off.
TOs issued under this Contract may be Firm-Fixed Price, Time and Materials, or Labor Hour.
Specific objectives, milestones, and pricing information under this contract will be included in each TO. The Government will require some level of detail to properly analyze the pricing on a TO by TO basis so that the USACE KO can document that the price is fair and reasonable. The level of detail may vary depending on the level of complexity of the project.
C.1.4 Contract Deliverables
The majority of task order deliverables will be in the form of written reports. The contractor will submit draft and final reports in accordance with the direction provided in the individual TO PWS. The Contractor will provide clear, well written, and concise reports. Any documents not so written will be returned to the Contractor for correction.
The Government will review the reports and provide written comments to the Contractor, which the Contractor must address. The Government will not provide acceptance of any reports until the Contractor has fully and adequately responded to each Government comment, as well as made any necessary revisions to the report.
C.1.5 Studies and Technical Reports
The Contractor shall perform and prepare reports, investigations, and studies as required to meet the scope of work in each TO and to submit the report, investigation and/or study as directed within the TO. Documents will be reviewed and comments provided by the Government typically within 30 days of receipt of the deliverable, unless otherwise specified in the TO.
C.1.6 Use of Government Information
The Contractor will be given and use a variety of cost data, aerial photography, satellite imagery, GIS data, and computer programming to complete the work for each deliverable. All Government Furnished Information and information collected by the Contractor for the Government remains the property of the U.S. Government. The Contractor may not use datasets or other materials relating to this contract or developed from this contract for publication without the expressed, written consent of the Contracting Officer. The Contractor may not release information procured under this contract without prior written approval of the contracting officer. The Contractor shall make available to the contracting officer draft copies of any publications, based on work conducted or data collected under this contract, for review and comment at least thirty days prior to planned release.
C.1.7 Requirements/Performance Standards Each TO shall use the standard Quality Assurance Plan (QASP) requirement for service contracts as set forth in FAR Subpart 37.6, and the government reserves the right to modify these documents for each project. The QASP is a document used to ensure that systematic quality assurance methods are used in the administration of the Performance Based Contract (PBC) or TO. The QASP details how and when the Government will survey, observe, test, sample, evaluate and document Contractor performance according to the PWS. A Performance Requirements Summary (PRS) details how the Government will monitor the Contractor’s performance. The Governments QASP and the Contractor’s Quality Control Plan work together to ensure that all project performance standards are met.
The QASP focuses on the quality, timeliness, etc. of the performance outputs to be delivered by the Contractor and not on the individual steps required or procedures used to provide the product or services. The QASP should highlight key quality control activities or events that the COR will use to determine and assess progress toward and/or completion of milestones.
C.1.8 Contractor Antiterrorism/Operations Security Requirements
Access and General Protection/Security Policy and Procedures: All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
Will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas: All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas
C.2 TASKS
The Contractor, operating as an independent Contractor and not as an agent of the Government, shall provide all labor, materials, facilities, and equipment and perform all work identified in each individual TO. The Contractor may be required to perform work under multiple TOs at different sites simultaneously. The Contractor shall be cognizant of all appropriate laws, regulations, and guidance for each site. The Contractor shall ensure that all work activities performed by its personnel, subcontractors, and suppliers are executed as required by these laws and regulations. Any incident of noncompliance noted by the Contractor shall immediately be brought to the attention of the KO and/or the Contracting Officer’s Representative (COR) by written notice. Nothing in this contract shall relieve the Contractor of its responsibility to comply with the U.S. laws and regulations. The following types of Tasks have been identified for possible execution under this contract as TOs. The Contractor may be required to provide one or more of the following services:
C.2.1 Preparation of Planning Studies: Working with a multi-disciplinary team and the Non-Federal Sponsor(s), the planning lead is responsible for preparing partial or complete planning studies and integrated reports for water resource projects involved with aquatic ecosystem restoration, flood risk management and coastal storm protection (structural and non-structural solutions), water supply and reallocation, navigation (inland and deep draft), shoreline protection, dredge material plans, and watershed planning in accordance with ER 1105-2-100, Planning Bulletins, ER 1110-2-1150 and other pertinent guidance, laws and regulations applicable to the USACE 6 Step Planning Process, SMART Planning principles and framework, risk-informed planning processes, and EC 1165-2-217 review requirements. Planning studies and reports shall include the following efforts and activities:
a) Identifying problems, opportunities, constraints and objectives;
b) Inventorying, forecasting, and analyzing future with- and without-project conditions;
c) Formulating measures and alternative plans including development of the evaluation and selection criteria;
d) Establishing qualitative and quantitative project outputs (monetary and non-monetary benefits) and cost estimates to implement alternative plans;
e) Evaluating and comparing alternative plans against future without project conditions as well as each other and completing trade-off analysis;
f) Recommending plans for implementation based on federal interest and NED/NER analysis, the 4 Principles and Guidelines (P&G) Criteria, Regional Economic Development Benefits (RED), Other Social Effects (OSE), and Environmental Quality (EQ), as well as Cost – Benefit analysis;
g) Preparing draft and final reports and related engineering and technical appendices; interim documents and products, read-ahead materials for briefings, vertical team milestone decision meeting documents, and materials for public, stakeholder, or other types of meetings.
Documents should be written for multiple types of audiences (public, other agencies, technical reviewers, the vertical team, ASA (CW), OMB, and Congress), be policy-compliant, clear and concise and utilize risk informed decision-making and SMART Planning processes.
C.2.2 Ecosystem Restoration: Conducting ecosystem restoration modeling and analysis including benefit cost analysis, cost effectiveness and incremental cost analyses using habitat evaluation procedure (HEP) or other habitat models that are certified or will go through certification, Institute for Water Resources (IWR) Plan program and/or other USACE accepted analysis tools in adherence with the Planning Guidance Notebook (ER1105-2-100) other Corps policies and processes. See the IWR website to locate IWR Plan software and procedures, or IWR Report 94-PS-2, Cost Effectiveness Analysis for Planning: Nine Easy Steps, dated October 1994 for reference material and general requirements and information for completion of this task.
C.2.3 Fish and Wildlife Habitat: Conduct monitoring, site preparation, field investigations and/or species specific surveys to determine the presence/absence, distribution, and/or abundance of fish and wildlife in the project area, and associated habitat types such as wetland delineations. Qualified biologists and/or botanists may be required to carry out fish and/or wildlife habitat evaluations and wetland delineations. The Contractor will need to adequately describe habitat types, ecological condition, amount, extent, and quality of habitat within the project area and prepare reports or other documentation as appropriate. Contractor biologists shall have experience employing standard aquatic and upland habitat measurement methods and fish and wildlife assessment and survey methods.
C.2.4 Biological Assessments. Prepare biological assessments according to Endangered Species Act guidelines.
C.2.5 Natural Resource Inventories. Using existing information and site visits, conduct literature searches and interviews, and identify existing natural resources within the project area, including identifying any natural resources with cultural importance. Types of reports or documentation required under this task includes Natural Resource Inventory (NRI) 1 and 2. Contactor shall follow guidance found in ER 1130-2-540.
C.2.6 Cultural Resources Management Plans and Historic Properties Management Plans. EP 1130-2- 540 contains guidance and policies related to the preparation of Historic Properties Management Plans.
C.2.7 Effects Analysis. Determine potential effects to natural and cultural resources posed by the proposed Federal action; including evaluation of indirect, direct, and cumulative effects.
C.2.8 Survival Benefit Analysis: The Government shall provide the Contractor with the Expert Regional
Technical Group (ERTG) template and the Survival Benefit Unit (SBU) calculator work sheets, or proxy rating/assessment system. The Contractor shall use the SBU calculator to complete SBU scores and complete the ERTG template.
C.2.9 Biological Modeling: Conduct and complete Environmental Benefits Outputs Model using the Habitat Evaluation Procedure (HEP) and associated Habitat Suitability Indices (HSIs) or other certified/approved habitat models for each alternative under consideration and for the future without project conditions. If a new model is required, the contractor will be responsible for all documentation required to get the model approved by the Ecosystem Restoration Planning Center of Expertise (ECO- PCX). The Contractor shall use metric and methodology limited to selected primary species of interest and include only variables the actions will affect. Prepare reports and technical appendices discussing results, analyses, and conclusions.
C.2.10 Other Biological Services:
C.2.10.1 Fish Passage: Conduct laboratory or field investigations to assess the biological response of aquatic organisms to physical conditions associated with passage through structures such as dams, tide gates, and culverts.
C.2.10.2 Statistics and Study Design: Prepare scientifically defensible field and laboratory study plans and reports of study results. To accomplish this, the Contractor shall have capability and experience in applied statistics and experimental design for research efforts; scientific credibility in the field of biostatistics; experience in related fields of studies relevant to fish, wildlife and habitat assessment.
C.2.11 Environmental Compliance: Assist the Government in preparing required environmental compliance investigations, documents, and permits to comply with federal laws, regulations, executive orders, and policies where studies and projects are located (included are state or local requirements where there is a federal nexus). This task order may include any necessary field work and data collection to accomplish the task. This task would support compliance with the following laws, associated regulations, and executive orders:
National Environmental Policy Act (NEPA)
Endangered Species Act (ESA)
Magnuson-Stevens Fishery Conservation and Management Act (MSA)
National Historic Preservation Act (NHPA)
Clean Water Act (CWA)
Coastal Zone Consistency Management Act (CZMA)
Clean Air Act (CAA)
Marine Mammal Protection Act (MMPA)
Fish and Wildlife Coordination Act (FWCA)
Bald and Golden Eagle Protection Act (BGEPA)
Marine Protection, Research and Sanctuaries Act (MPRSA)
Migratory Bird Treaty Act (MBTA) and Executive Order 13186, Migratory Birds
C.2.11.1 National Environmental Policy Act (NEPA): Prepare all or part of NEPA documentation including, Categorical Exclusions (CE), Environmental Assessments (EA), Findings of No Significant Impacts (FONSI), Environmental Impact Statements (EIS), and Records of Decision (ROD). Contractor may be tasked with preparing any technical studies and reports that are necessary to support of the preparation of the NEPA document. NEPA documents may be integrated into single report as referenced in 2.1.2. The Contractor shall evaluate the environmental impacts of proposed projects by preparing environmental documents that evaluate a range of reasonable alternatives, including a no action alternative. In compliance with the USACE plan formulation processes and all applicable laws, the Contractor may be tasked with developing all aspects of the NEPA documentation, including developing purpose and need statement, assisting the Government in defining and developing the range of alternatives to be evaluated and preparing any supporting reports and studies. The Contractor shall participate in internal and external meetings and site visits and regularly coordinate with other sections and disciplines. Contractor will be expected to support public outreach efforts and may be tasked with the development of public outreach materials, facilitation of public meetings, and assisting in summarizing and responding to public comments.
