b. Reduce the contract price to reflect the reduced value of the services performed.

c. If the Contractor fails to promptly re-perform the services, or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may:

6.9 Standard. Recurring defects are not permitted for any of the above service items. For example, if the COR discovers litter left in the vicinity of dumpster area covered under the contract, the contractor is required to correct the defect through re-performance. No defect is recorded against the contractor's performance.

However, if this same situation occurs again during the contract period, a defect will be recorded and reported to the Contracting Officer for appropriate action in accordance with FAR 52.212.4, Contract Terms and

Conditions-Commercial Items.***

6.10 Work Scheduling. Contractor’s work schedule shall indicate the location and time the required service is provided. This work shall result in a minimum conflict between the Project and Contractor’s employees. Work Schedule shall indicate

Contractor’s activity on the project at least ten days in advance and shall be subject to adjustment upon notification by the COR that a conflict with necessary project maintenance work has developed.

The COR will notify the Contractor of necessary schedule changes two business days in advance where possible. The normal working hours on BLD shall be 0700 to 1700 hours Monday – Thursday without prior written approval by the COR. The COR maintains the authority to adjust the working hours to meet

Government needs.

6.13 Interference with Government Operations. The Contractor and the Contractor’s employees shall perform all work in such a way as to not interfere with regularly scheduled Government operational activities.

6.14 Services During Repair Activities. It is expected during the period of this contract that occasional repairs may have to be made by electricians, plumbers, carpenters, or other maintenance personnel within BLD.

Dumpsters during these times may be temporarily relocated. The COR will notify the contractor in writing

(via email or other agreed correspondence method) if a dumpster has to be relocated.

7.3 The Contractor shall determine those areas and activities in which possible safety hazards exist during the on-site visit of the BLD and note such information on the Activity Hazard Analysis (example in EM-385-1).

When completed, the Contractor shall identify hazards in each phase of services performed, what preventative measure the contractor proposes to take to prevent such accidents and then return to the COR to retain on file.

7.4 The COR and the Project’s Environmental Compliance Coordinator shall approve all cleaning and maintenance products. The contractor shall use only environmentally friendly cleaning products. Employees shall be briefed in hazardous communication – proper labeling and storage, MSDS Sheets, etc. – by the

Environmental Compliance Coordinator. This shall be conducted at the Pre-Work Meeting.

7.5 Accidents. The Contractor and its employees shall report any circumstances of needed repair of the facility or any area which may affect the performance of the work. In the event an accident or injury occurs to

Contractor personnel, the Contractor shall first notify the COR or alternate COR, and the Control Room
