About this file
This is a Justification and Approval (J&A) document authorizing other than full and open competition for Siemens Desigo and Apogee Building Automation System (BAS) equipment as part of the GPO and NASA Building 9101 renovations at Stennis Space Center, MS. The document cites authority under 10 U.S.C. 3204(a)(1) and FAR 6.302-1(a)(2) for sole source procurement since Siemens is the only responsible source that can meet the requirements.
The project involves renovating approximately 49,000 SF of Building 9101 to expand GPO operations, including 25,000 SF of administrative offices, plus roof replacement covering 300,000 SF. The BAS must integrate with existing Siemens systems that have been in place since the 1990s and serve 50 structures at Stennis Space Center. A Notice of Intent was posted to SAM.gov on December 12, 2024 with response date of December 30, 2024, but received no responses. The procurement will be executed as a firm-fixed-price design-bid-build contract with a 545-day period of performance from Notice to Proceed. The work will be funded through the Government Publishing Office Business Operations Revolving Fund.

Justification and Approval (J&A) For
Other Than Full and Open Competition
1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Directorate of Contracting, Mobile Regional Contracting Center, P.O. Box 2288, Mobile, Alabama 36628-0001.
2. Description of Action: This Justification and Approval (J&A) is to specify Siemens brand name Desigo and Apogee Building Automation System (BAS) in Solicitation W9127824R0052 for the Government Printing Office (GPO) and National Aeronautics and Space Administration (NASA) Building 9101 Expansions, Interior Upgrades, & Roof Replacement, at Stennis Space Center, MS. This construction project will be a Firm Fixed Price Design Bid Build (DBB) Contract, using no year funds 04 4505 Government Publishing Office Business Operations Revolving Fund, Government Publishing Office. The anticipated Period of Performance (PoP) is 545 calendar days from Notice to Proceed (NTP).
3. Description of Supplies/Services: This procurement is a single requirement for the GPO and NASA Building 9101 Expansions, Interior Upgrades, & Roof Replacement, at Stennis Space Center, MS. The project involves the renovation of approximately 49,000 SF (1st floor is 43,000 SF and 2nd floor is 6,600 SF) of an unused portion of Building 9101 in order to expand GPO operations. The Administration Offices for GPO at this location will be renovated as well, totaling 25,000 SF. In addition to the expansion, the roof, covering 300,000 SF, will be replaced at Building 9101. Additional electrical supply will be needed for this expansion. Supporting activities include site development, utilities and connections, lighting, information systems, signage, fire protection, fire alarm and BAS. The BAS/Energy Monitoring Control System must be fully compatible with the existing Siemens Desigo and Siemens Apogee, connections to the existing Energy Monitoring Control System (EMCS), Antiterrorism and Force Protection requirements, and energy/sustainability requirements. The BAS must comply with the existing Siemens Apogee devices and Desigo system in Building 9101. Stennis Space Center optimized operations and maintenance costs by standardization of control systems. The system shall be fully integrated with the Stennis Space Center controls systems and headend equipment at the Energy Management Workcenter. The controls will serve all chillers, boilers, pumps, air handlers, variable air valve, variable frequency drives, and other ancillary equipment involved in the expansion of the facility. Status of all systems shall be made available at B9101 and remotely through internet protocol virtual local area network at Stennis. Contractor is expected to provide detailed designs in accordance with the project plans and specifications. Installation of the system shall require all equipment to comply with the contract documents and be fully integrated with the Stennis controls network. The expansion into the unused portion of the building must tie into the existing BAS. Most buildings, including Building 9101, use the Siemens Apogee and Desigo. It is intended that Siemens Apogee and Desigo System will be used. The Rough Order of Magnitude estimate for the entire project is For the brand name specifications, the Governments estimate for the BAS is $
4. Authority Cited: The statutory authority permitting acquisition of this requirement by other than full and open competition is 10 U.S.C 3204(a)(1), as implemented by FAR 6.302-1(a)(2), Only One Responsible Source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: As set forth in FAR 6.302-1(a)(2), when the supplies or services required by the agency are available from only one source, or for DoD, National Aeronautics and Space Administration (NASA), and the Coast Guard, from only one or a limited number of sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided. This authority is applicable to the brand-name descriptions in accordance with FAR 6.302-1(c). Additionally, FAR 6.302-1(c)(ii)(A) & (B) state the J&A approval/threshold requirements are only applicable to the portion of the acquisition specific to the brand-name specification, and the J&A should indicate that the use of such descriptions in the applicable portion of the acquisition are essential to the Governments requirements, thereby precluding consideration of a product manufactured by another company.
a. Background: This project supports the renovations and interior expansion of GPO activities at Building 9101. Space is required for the expansion of printing operations into an unused portion of Building 9101. There are no other facilities at Stennis Space Center that meet this requirement.
b. Justification: The brand name specification for the BAS is essential to the Governments requirement because it is the only product capable of meeting the communication requirements mandated by NASA at Stennis Space Center. Stennis Space Centers BAS currently serves 50 structures throughout the property, consisting of Siemens and their components. Siemens has provided maintenance and upgrades to its systems since the system was installed facility-wide in the early 1990s. The BAS is critical to the mission and sustainment of GPOs operations at Stennis Space Center. Siemens retains its proprietary rights to the BAS software and is the only brand for the expansion at building 9101. Installation of a different brand would result in an ineffective piece of equipment, as it would not be able to integrate with the existing system at Building 9101.
The CESAM Engineering Design Branch found there were no other similar products that could meet the characteristics above. In addition, a notice of intent to utilize the brand name specifications was posted to the System for Award Management (SAM). The notice yielded zero responses.
c. Alternative: The Notice of Intent yielded zero responses and supports the Governments conclusion that there are no alternatives available to the Government for this requirement.
Siemens alone possesses the proprietary equipment necessary to integrate with the current systems in place at Building 9101. Application of the BAS is essential to meeting the Governments requirements, thereby precluding consideration of another product. The only alternative would be utilizing a different brand. However, this would require purchasing more than just the component, but also purchasing new software and licensing for maintenance. It would also mandate the need to ensure that the BAS and fire alarm system (FAS) communicate with each other during an emergency event, as well as the BAS communicating automatically with the Stennis Space Center Fire Station. Therefore, the use of the Siemens brand for the singular component offers the only solution that will meet the project requirements while also allowing the user to meet their mission requirements in accordance with how they have been funded for both the project and their mission.
d. Impact: If this J&A is not approved, USACEs construction activites at Building 9101 will not be executed in accordance with user requirements. Co-operating access control systems which are not integrated with each other would require introduction of new products/technology, accessibility of local service, compatibility of software/hardware upgrades, and availability of spare parts. Manufacturer support for the FAS/BAS is a major concern as a life, health, and safety system for this project. The GPO and NASA mission have not been funded nor has the Building 9101 Expansions, Interior Upgrades, & Roof Replacement project been funded to add a new system to the building. A new system would require additional appropriated funds.
6. Efforts to Obtain Competition:
a. Effective Competition: The Contracting Officer published the notices required by FAR 5.201, as described below, and any bids or proposals shall be considered. In accordance with FAR 5.2, Synopses of Proposed Contract Action, a NOI under NAICS 334512, Automatic Environmental Control Manufacturing for Residential, Commercial, and Appliance Use, to include the brand name specifications for Siemens Desigo and Apogee BAS was posted to SAM.gov on 12 December 2024 with a response date of 30 December 2024. No responses were received.
b. Subcontracting Competition: Due to the system itself being proprietary and designed to integrate, the Siemens BAS must be purchased. The subject equipment will be procured by a competitively selected small business prime contractor performing the GPO and NASA Building 9101 Expansions, Interior Upgrades, & Roof Replacement, at Stennis Space Center, MS. In accordance with FAR 19.702, subcontracting plans are not required.
7. Actions to Increase Competition: There are no known actions to be taken to increase competition. Another NOI would be completed for future procurements to increase competition for similar future procurements that would not result in increased project costs, reduced efficiencies, and increased overhead costs.
8. Market Research: A special notice under Notice ID W9127824R0052 was posted to SAM.gov on 12 December 2024 and requested responses by 30 December 2024. The special notice stated the intent was to use a brand name specification for the BAS and requested interested parties to submit their qualifications. No responses were received to this special notice.
9. Interested Sources: This J&A will be posted with the issuance of the solicitation in accordance with FAR 5.102(a)(6).
