SECTION C

DESCRIPTION/SPECIFICATIONS/WORK STATEMENTS

C.1 General The purpose of this contract is to provide training support for the Assistant Secretary of the Army (Installations and Environment) (ASA(I&E)) Army Traffic Safety Training Program (ATSTP) which is managed by the U.S. Army Combat Readiness Center (USACRC), Fort Rucker.

Training courses supported under this contract:

Remedial Driver Training (RDT) Intermediate Driver Course (IDC) Motorcycle Basic Rider Course (BRC) Advanced Rider Course (ARC)

Support services include but are not limited to:

providing programmatic planning and support providing project level planning and support provide onsite end user training and education coordination of training requirements with stakeholders providing onsite and offsite technical expertise managing course documentation and revisions based on Agency policies briefing leadership on mission execution and compliance status preparing reports on program compliance status and corrective action measures ensure training courses are compliant with applicable regulations/requirements implement best training practices to fill gaps and deficiencies developing training materials and media for classroom and remote training sessions execute training curriculum via classroom, virtual, DCS (Defense Collaboration Services), and/or other computer-based training media conduct surveys and gathering classroom feedback to facilitate updates for training programs provide information technology configuration and audio-visual support for training courses

C.2 Scope of Work The time frame and specific procedure for each item of work will be described in the individual task order. The individual task orders will be firm fixed price task orders that will clearly define the tasks and more importantly the milestone deliverables that are required by the agency programs.

C.2.1 ATSTP Support. Program support includes all work necessary to provide training instruction to U.S. Army soldiers and civilians for the RDT, IDC, BRC, and ARC courses in accordance with requirements established by the Department of Defense and the Department of the Army. Support locations includes the locations listed in the contract Bid Schedule. The contractor and the contractor’s subcontractors and suppliers shall perform all work in full compliance with applicable Federal, State, and Local safety laws and regulations. The contractor shall have knowledge and demonstrable experience in the implementation and application of various laws, statues, and regulations, including but not limited to: Department of Defense Instruction (DODI) 6055.1 and 6055.04; Army Regulation (AR) 385-10, AR 600–55, and AR 190–5; Occupational Safety and Health Act; International Standard for Organization 14001; Joint Ethics Regulation 5500.7.R; and Executive Orders involving Environmental Health and Occupational Safety.

C.2.2 Commands supported under the ATSTP program include:

U.S. Army and all subordinate commands U.S Army Reserve (USARC) National Guard Bureau (NGB) Army National Guard (ARNG)

The contractor shall furnish all materials, equipment, supplies, personnel, and all other services required to perform the purpose services outlined in this statement of work and as specifically identified in the Scope of Work for individual task orders. The number of class seats for each class type and location will be identified in the subsequent firm fixed price task orders.

C.3 Administrative Requirements Progress Reports and Payment Request: A progress report shall be submitted to the Mobile District Project Manager (a specific Project Manager will be assigned for each task order) once each month during each task order period.

The report shall describe the work completed during the reporting period and give the project status on a percentage basis of the total amount of work completed. The report list all project deliverables, the overall project schedule, and the work accomplished to date. A task order payment invoice shall also be submitted to the Mobile District once each month. The percent claimed for payment shall coincide with the progress report. The progress report and payment request should be mailed to the POC indicated in the task order.

C.4 Government Furnished Information

Specific Government furnished information for each item of work will be described in the individual task orders.

C.5 Task Orders

C.5.1 As the needs of the Corps of Engineers are defined, the Contracting Officer will notify the Contractor of a need through the issuance of a Request for Proposal (RFP) Letter. A Scope of Work attached to the RFP Letter will provide the Contractor with a description of the services to be provided for the prospective task order. The Contractor shall then prepare the proposal for accomplishing the task by preparing and submitting sufficient documentation (including identifying all subcontractors and associated costs) to assure that the Contractor has provided sufficient planning to accomplish the required task. The proposal provided by the Contractor shall utilize the costs listed in the contract’s bid schedule. The time required for receipt of the Contractor's proposal will be identified in each RFP Letter. Upon receipt of the Contractor's proposal the Corps of Engineers will review the proposal documents for adequacy and completeness. If required, the Corps of Engineers will then negotiate the proposed effort, the fixed-price cost for performing the work, and the time period for performing the work with the Contractor.

C.5.2 Work will only be ordered through the issuance of individual task orders. All task orders issued will be for the services specified therein and will be in accordance with the fixed rates specified elsewhere in this contract. The cost of work that is not covered by the fixed rates in this contract will be negotiated on an individual task order basis.

C.5.3 The Contracting Officer Representative(s) named in the task order will be responsible for the administration of task orders placed hereunder. The Contracting Officer Representative does not have authority to modify any provision of this contract. Any request for deviation from the terms of this Contract or any task orders issued hereunder must be submitted to the Contracting Officer for contractual action.

C.5.4 The Contractor shall notify the Contracting Officer upon completion of each individual task order. The Contractor shall give advance notice of the date the work will be fully completed and ready for final inspection.

C.5.5 A Form SF1449 or similar will be issued for each task order. Each task order will include:

(1) Date of task order; contract number; task order number; task order price or performance data; accounting and appropriation data; and any other pertinent information. Delivery or performance shall be specified in each task order issued hereunder.

(2) The specific Scope of Work related to the work covered by the task order and any other special technical requirements, instructions, or clearances.

C.6 Training Course Requirements

C.6.1 TRAINING DELIVERY. The contractor shall provide training for service members in accordance with DoDI

6055.04 and AR 385-10. The contractor shall ensure licensed and experienced instructors provide a mixture of hands on and classroom instruction in accordance with this PWS. Motorcycle course instructors shall be currently certified IAW DoDI 6055.04.

C.6.2 HOURS AND DAYS OF OPERATIONS. The contractor shall establish work schedules which will provide adequate staffing to meet all requirements of this contract. At a minimum, the contractor shall be expected to deliver courses of instruction anytime between 0600 and 1800 hours local time (6:00 AM and 6:00 PM), Monday through Friday, with the exception of official Federal holidays. Hours of instruction will be determined by the schedule established through the Army IMCOM Registration System (AIRS) and coordinated with the respective local COR. In no case will the contractor be required to perform training more than 8 hours in any given day.

Motorcycle and Remedial Driver Training may be required during non-duty hours including Saturdays.

C.6.2.1 The following is a list of recognized Federal Government holidays:

New Year’s Day, January 1 Martin Luther King Jr’s Birthday, 3rd Monday in January Presidents Day, 3rd Monday in February Memorial Day, Last Monday in May Juneteenth, June 19 Independence Day, July 4 Labor Day, 1st Monday in September Columbus Day, 2nd Monday in October Veteran’s Day, November 11 Thanksgiving, 4th Thursday in November Christmas Day, December 25

C.6.2.2 When a Federal holiday falls on a Sunday, the following Monday will be considered a holiday. When a Federal holiday falls on a Saturday, the preceding Friday will be considered a holiday. When a Federal holiday falls on a working day, a Commander declares a training holiday, or a Day of No Scheduled Activity while a course is being conducted, the class days will be extended in order to satisfy the time-period required by the Program of Instruction (POI).

C.6.3 REMEDIAL DRIVER TRAINING (RDT). The contractor shall provide classroom instructional services for a behavior modification/aggressive driving course with appropriate POI for personnel identified in the class roster registration certified by the local Technical Monitor (TM) within 10 working days of certification for OCONUS locations and within 7 working days of certification for CONUS locations. The intent of the remedial driver training is to effect a behavioral change in participants which results in reduction of motor vehicle accidents and related loss of life and limb. The most critical salient characteristic of this training is that it uses behavior modification-based techniques to lead participants to address their individual driving patterns, i.e., to recognize and acknowledge their high-risk behaviors, to develop countermeasures to reduce negative driving habits and attitudes, and to develop and strengthen positive driving habits and attitudes in participants.

C.6.3.1 The desired outcome of the training is that students will become more analytical about traffic situations, recognize how behavior and choices can influence situations, and understand facts and solutions about common factors affecting unsafe behavior, e.g., driving under the influence, anger, inexperience, fatigue, medications, etc. Class size for this training may accommodate up to 30 registered students or a minimum number of 12 registered students to conduct a class. In the event that an Installation does not have 12 students register for a RDT class within a 30-day period, the local TM may then request that the COR approve a RDT class for less than 12 students.

C.6.4 INTERMEDIATE DRIVER COURSE (IDC). The contractor shall provide 2.5 hours of intermediate traffic safety training with appropriate POI that reinforces the Introduction to Driver’s Training provided separately to service members during their Advanced Individual Training. The IDC will reinforce a positive attitude toward driving, individual responsibility, correct response to routine and emergency driving situations, and sharing the road safely with other road users. Class size for this training may accommodate up to 30 registered students or a minimum number of 12 registered students to conduct a class. In the event that an Installation does not have 12 students register for an IDC class within a 30 day period, the local TM may then request that the COR approve an IDC class for less than 12 students.

C.6.5 MOTORCYCLE BASIC RIDER COURSE (BRC). The contractor shall provide both classroom and hands-on Motorcycle training for service members IAW DoDI 6055.04 within 10 working days of the local COR certifying the class roster for OCONUS locations and within 7 working days of certifying the class roster for CONUS locations. Classroom instruction and riding exercises in a controlled environment provide a complete introduction to motorcycling safety.

C.6.5.1 The classroom session may accommodate up to twelve (12) students with a minimum number of 5 registered students to conduct a class. The range portion of instruction shall include for one Instructor, no more than 6 registered or a minimum of 5 registered students and for two Instructors, a maximum of 12 registered or a minimum of 11 registered students. In the event that an Installation does not have 5 students register for a BRC class within a 30-day period, the local TM may then request that the COR approve a BRC class for less than 5 students.

C.6.5.2 The contractor shall conduct an inspection for unsafe range conditions before each class. Any discrepancies will be reported immediately to the local TM for resolution. The contractor shall ensure students dress in compliance with the motorcycle Personal Protective Equipment (PPE) requirements as outlined in AR 385-10. The contractor shall provide DOT approved helmets and gloves for BRC students.

However, students may at their discretion provide their own DOT approved helmet and gloves upon verification by the contractor that the items are consistent with the criteria as outlined in AR 385-10.

C.6.5.3 The contractor will provide for student use training motorcycles, helmets, and gloves that meet the Department of Transportation (DOT) and DoDI 6055.04 standards for the number of students registered for BRC in AIRS who do not provide their own equipment. The contractor shall be responsible for all storage, transportation, maintenance and expenses associated with the training motorcycles. All provided training motorcycles used for the BRC training will be maintained by the contractor IAW the manufacturer’s specifications to ensure safe operations by the students. The Government will provide no logistics to maintain these items.

C.6.6 ADVANCED RIDER COURSE (ARC). The contractor shall provide both classroom and hands-on Motorcycle ARC training for service members who own and/or operate standard, touring and cruiser or sport motorcycles in accordance with commercial practice. Training will be provided within 10 working days of the local TM certifying the class roster for OCONUS locations and within 7 working days of certifying the class roster for CONUS locations. The student will provide his/her own street legal standard, touring, cruiser or sports motorcycle and shall have completed a BRC IAW DoDI 6055.04 prior to attending this course.

C.6.6.1 The classroom session may accommodate up to twelve (12) students with a minimum number of 5 registered students to conduct a class. The range portion of instruction shall include: for one Instructor, no more than 6 registered or a minimum of 5 registered students and for two Instructors, a maximum of 12 registered or a minimum of 11 registered students. In the event that an Installation does not have 5 students register for an ARC class within a 30-day period, the local TM may then request that the COR approve an ARC class for less than 5 students.

C.6.6.2 The contractor shall conduct an inspection for unsafe range conditions before each class. Any discrepancies will be reported immediately to the local TM for resolution.

C.6.6.3 The contractor shall ensure students dress in compliance with the motorcycle Personal Protective Equipment (PPE) requirements as outlined in AR 385-10. Students will provide own PPE.

C.6.6.4 All students who previously completed the Basic Rider 2 Course (BRC2) or Level II course are grandfathered and do not have to go back and take the ARC.

C.6.7 Scooter Training in BRC/ARC. Students may ride their own scooter for the BRC and ARC under the following conditions:

Students that ride a scooter for the BRC will be required to ride a scooter for the ARC.

Students that ride a cruiser or sport bike for the BRC may also ride a scooter for the ARC.

Students that ride a scooter in the BRC will not ride a cruiser or sport bike for the ARC without taking the BRC on an approved motorcycle. Students that ride a scooter for the BRC will have their rider cards stamped, “Scooter Only”. See DoDI 6055.04 for the definition of a motorcycle. Mopeds are excluded and will not be ridden in a motorcycle training course.

Scooters will not be provided.

C.6.8 TRAINING SCHEDULING, REGISTRATION AND RECORDS MANAGEMENT. The Army IMCOM Registration System (AIRS) provides on-line registration and management of traffic safety training courses for the Army Traffic Safety Training Program (ATSTP). AIRS generates reports detailing the number of students registering, unit information, cancellations, completions, and no-shows.

C.6.8.1 The Government will make available AIRS or an equivalent data base and the local TM will ensure contractor personnel have a Command Access Card (CAC) and business email address to access the system.

The local TM or designated government representative will approve and ensure students registered possess the proper credentials required for the course selected. If the TM or designated representative are not available because of furloughs, leave, emergencies, etc., the contractor personnel are authorized to assist with student registration until they return.

C.6.8.2 The contractor is responsible for annotating student no shows, completion grade or PASS/NO PASS/Incompletes in AIRS or current data base in use.

C.6.8.3 The contractor shall ensure that each student completes an end of course critique prior to issuing a completion certificate/ card. All completed critique forms shall be forwarded to the local TM within two working days of course completion. The contractor staff will perform in a professional and business-like manner and maintain an overall average satisfactory rating each month on the ATSTP student feedback survey.

C.7.1 General:

(a) When work is performed at a Federal, State, or local installation or facility, the Contractor shall comply with all security requirements of that installation or facility. The installation/facilities will honor all reasonable requests for entrance clearances of essential contractor staff members working at installations, conditioned only upon presentation of proper credentials and in conformance with the installation security regulations. All access shall be conducted in a manner so as to minimize interference with military operations at the installation/facility.

(b) If necessary, to complete a task, the Contractor shall obtain permission to access government network or stand-alone computers in accordance with AR 25-2. AR 25-2 which states any individual who requires information technology (IT) access to government systems must meet the security standard for the level of access required.

C.7.2 Access and Clearances:

(a) Unless otherwise determined by the USACRC, work performed under this Task Order is unclassified.

(b) The Contractor shall comply with (1) the Security Agreement (DD Form 441), including the National

Industrial Security Program Operating Manual (DOD 5220.22-M); and (2) any revisions to that manual, notice of which has been furnished to the Contractor.

(c) All contractor personnel working at a DoD facility must have a current favorable National Agency Check with Inquiry (NACI), in accordance with AR 380-67.

(d) All users accessing government IT systems require an IT-III level access at a minimum. IT-III access requires initiation of a NACI (for civilians) or NAC (for military and contractors), as appropriate or favorable review of SF85.

C.8. Contractor Manpower Reporting Application

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for any Department of Defense service/component (e.g. Army, Air Force, Navy, OSD, etc.) via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 01 through September 30. While inputs may be reported at any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2015. Contractors may direct questions to the help desk at: http://www.ecmra.mil/.

C.9 Defense Base Act (DBA) Insurance Coverage

The A-E shall procure coverage required under the DBA, as applicable. The DBA of 1941 mandates that U.S.

government contractors provide and maintain workers' compensation insurance coverage for personnel working on service contracts outside the U.S. More information is available on from the Department of Labor’s website at https://www.dol.gov/owcp/dlhwc/lsdba.htm.

C.10 General SOFA Requirements and SOFA for Korea

C.10.1 Status of Forces Agreement (SOFA): The A-E shall comply with the provisions of the host nation SOFA agreements. The contractor shall acquire and review the applicable SOFA for each applicable host nation to understand employees' entitlement to benefits; the documentation required to comply with verification of employee status and legal residency by the host country; terms relating to mobility and access to government-sponsored and private transportation; exemptions from laws and regulations of the host country with respect to terms and conditions of employment and labor laws; employee tax obligations and the tax treatment of income received as a result of service with or employment by the U.S. armed forces; and the application of customs and import taxes on imported goods.

C.10.2 ROK Status of Forces Agreement (SOFA): INVITED CONTRACTOR OR TECHNICAL

REPRESENTATIVE STATUS UNDER U.S. - REPUBLIC OF KOREA (ROK)

Invited Contractor (IC) and Technical Representative (TR) status shall be governed by the U.S.-ROK Status of Forces Agreement (SOFA) as implemented by United States Forces Korea (USFK) Reg 700-19, which can be found under the “publications” tab on the US Forces Korea homepage http://www.usfk.mil

(a) Definitions. As used in this clause—

“U.S. – ROK Status of Forces Agreement” (SOFA) means the Mutual Defense Treaty between the Republic of Korea and the U.S. of America, Regarding Facilities and Areas and the Status of U.S. Armed Forces in the Republic of Korea, as amended

“Combatant Commander” means the commander of a unified or specified combatant command established in accordance with 10 U.S.C. 161. In Korea, the Combatant Commander is the Commander, United States Pacific Command.

“United States Forces Korea” (USFK) means the subordinate unified command through which US forces would be sent to the Combined Forces Command fighting components.

“Commander, United States Forces Korea” (COMUSK) means the commander of all U.S. forces present in Korea. In the Republic of Korea, COMUSK also serves as Commander, Combined Forces Command (CDR CFC) and Commander, United Nations Command (CDR UNC).

“USFK, Assistant Chief of Staff, Acquisition Management” (USFK/FKAQ) means the principal staff office to USFK for all acquisition matters and administrator of the U.S.-ROK SOFA as applied to US and Third Country contractors under the Invited Contractor (IC) and Technical Representative (TR) Program (USFK Reg 700-19).

“Responsible Officer (RO)” means a senior DOD employee (such as a military E5 and above or civilian GS-7 and above), appointed by the USFK Sponsoring Agency (SA), who is directly responsible for determining and administering appropriate logistics support for IC/TRs during contract performance in the

ROK.

(b) IC or TR status under the SOFA is subject to the written approval of USFK, Assistant Chief of Staff, Acquisition Management (FKAQ), Unit #15289, APO AP 96205-5289.

(c) The contracting officer will coordinate with HQ USFK/FKAQ, IAW FAR 25.8, and USFK Reg 700-19.

FKAQ will determine the appropriate contractor status under the SOFA and notify the contracting officer of that determination.

(d) Subject to the above determination, the contractor, including its employees and lawful dependents, may be accorded such privileges and exemptions under conditions and limitations as specified in the SOFA and USFK Reg 700-19. These privileges and exemptions may be furnished during the performance period of the contract, subject to their availability and continued SOFA status. Logistics support privileges are provided on an as-available basis to properly authorized individuals. Some logistics support may be issued as Government Furnished Property or transferred on a reimbursable basis.

(e) The contractor warrants and shall ensure that collectively, and individually, its officials and employees performing under this contract will not perform any contract, service, or other business activity in the ROK, except under U.S. Government contracts and that performance is IAW the SOFA.

(f) The contractor’s direct employment of any Korean-National labor for performance of this contract shall be governed by ROK labor law and USFK regulation(s) pertaining to the direct employment and personnel administration of Korean National personnel.

(g) The authorities of the ROK have the right to exercise jurisdiction over invited contractors and technical representatives, including contractor officials, employees and their dependents, for offenses committed in the ROK and punishable by the laws of the ROK. In recognition of the role of such persons in the defense of the ROK, they will be subject to the provisions of Article XXII, SOFA, related Agreed Minutes and Understandings. In those cases, in which the authorities of the ROK decide not to exercise jurisdiction, they shall notify the U.S. military authorities as soon as possible. Upon such notification, the military authorities will have the right to exercise jurisdiction as is conferred by the laws of the U.S.

(h) Invited contractors and technical representatives agree to cooperate fully with the USFK Sponsoring Agency (SA) and Responsible Officer (RO) on all matters pertaining to logistics support and theater training requirements. Contractors will provide the assigned SA prompt and accurate reports of changes in employee status as required by USFK Reg 700-19.

(i) Theater Specific Training. Training Requirements for IC/TR personnel shall be conducted in accordance with USFK Reg 350-2 Theater Specific Required Training for all Arriving Personnel and Units Assigned to, Rotating to, or in Temporary Duty Status to USFK. IC/TR personnel shall comply with requirements of USFK Reg 350-2.

(j) Except for contractor air crews flying Air Mobility Command missions, all U.S. contractors performing work on USAF classified contracts will report to the nearest Security Forces Information Security Section for the geographical area where the contract is to be performed to receive information concerning local security requirements.

(k) Invited Contractor and Technical Representative status may be withdrawn by USFK/FKAQ upon:

(1) Completion or termination of the contract.

(2) Determination that the contractor or its employees are engaged in business activities in the ROK other than those pertaining to U.S. armed forces.

(3) Determination that the contractor or its employees are engaged in practices in contravention to Korean law or USFK regulations.

(l) It is agreed that the withdrawal of invited contractor or technical representative status, or the withdrawal of, or failure to provide any of the privileges associated therewith by the U.S. and USFK, shall not constitute grounds for excusable delay by the contractor in the performance of the contract and will not justify or excuse the contractor defaulting in the performance of this contract. Furthermore, it is agreed that withdrawal of SOFA status for reasons outlined in USFK Reg 700-19, Section II, paragraph 6 shall not serve as a basis for the contractor filing any claims against the U.S. or USFK. Under no circumstance shall the withdrawal of SOFA Status or privileges be considered or construed as a breach of contract by the U.S. Government.

(m) Support.

(1) Unless the terms and conditions of this contract place the responsibility with another party, the COMUSK will develop a security plan to provide protection, through military means, of Contractor personnel engaged in the theater of operations when sufficient or legitimate civilian authority does not exist.

(2)(i) All Contractor personnel engaged in the theater of operations are authorized resuscitative care, stabilization, hospitalization at level III military treatment facilities, and assistance with patient movement in emergencies where loss of life, limb, or eyesight could occur. Hospitalization will be limited to stabilization and short-term medical treatment with an emphasis on return to duty or placement in the patient movement system.

(ii) When the Government provides medical or emergency dental treatment or transportation of Contractor personnel to a selected civilian facility, the Contractor shall ensure that the Government is reimbursed for any costs associated with such treatment or transportation.

(iii) Medical or dental care beyond this standard is not authorized unless specified elsewhere in this contract.

(3) Unless specified elsewhere in this contract, the Contractor is responsible for all other support required for its personnel engaged in the theater of operations under this contract.

(n) Compliance with laws and regulations. The Contractor shall comply with, and shall ensure that its personnel supporting U.S Armed Forces in the Republic of Korea as specified in paragraph (b)(1) of this clause are familiar with and comply with, all applicable—

(1) United States, host country, and third country national laws;

(2) Treaties and international agreements;

(3) United States regulations, directives, instructions, policies, and procedures; and

(4) Orders, directives, and instructions issued by the COMUSK relating to force protection, security, health, safety, or relations and interaction with local nationals. Included in this list are force protection advisories, health advisories, area (i.e. “off-limits”), prostitution and human trafficking and curfew restrictions.

(o) Vehicle or equipment licenses. IAW USFK Regulation 190-1, Contractor personnel shall possess the required licenses to operate all vehicles or equipment necessary to perform the contract in the theater of operations. All contractor employees/dependents must have either a Korean driver’s license or a valid international driver’s license to legally drive on Korean roads.

(p) Evacuation.

(1) If the COMUSK orders a non-mandatory or mandatory evacuation of some or all personnel, the Government will provide assistance, to the extent available, to United States and third country national contractor personnel.

(2) Non-combatant Evacuation Operations (NEO).

(i) The contractor shall designate a representative to provide contractor personnel and dependents information to the servicing NEO warden as required by direction of the Responsible Officer.

(ii) If contract period of performance in the Republic of Korea is greater than six months, non emergency essential contractor personnel and all IC/TR dependents shall participate in at least one USFK sponsored NEO exercise per year.

(q) Next of kin notification and personnel recovery.

(1) The Contractor shall be responsible for notification of the employee-designated next of kin in the event an employee dies, requires evacuation due to an injury, or is missing, captured, or abducted.

(2) In the case of missing, captured, or abducted contractor personnel, the Government will assist in personnel recovery actions in accordance with DOD Directive 2310.2, Personnel Recovery.

(3) IC/TR personnel shall accomplish Personnel Recovery/Survival, Evasion, Resistance and Escape (PR/SERE) training in accordance with USFK Reg 525-40, Personnel Recovery Procedures and USFK Reg 350-2 Theater Specific Required Training for all Arriving Personnel and Units Assigned to, Rotating to, or in Temporary Duty Status to USFK.

(r) Mortuary affairs. Mortuary affairs for contractor personnel who die while providing support in the theater of operations to U.S. Armed Forces will be handled in accordance with DOD Directive 1300.22, Mortuary Affairs Policy and Army Regulation 638-2, Care and Disposition of Remains and Disposition of Personal Effects.

(s) USFK Responsible Officer (RO). The USFK appointed RO will ensure all IC/TR personnel complete all applicable training as outlined in this clause.

ADDL REQUIREMENTS

CONTRACTING OFFICER AUTHORITY

"Only Warranted Contracting Officers (either Procuring Contracting Officer (PCO), or an Administrative Contracting Officer (ACO)), acting within their appointed limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer. Proceeding with any work not authorized by the Contracting Officer will be at the contractor’s own risk."

CONTRACTOR PERSONNEL

Contractor personnel must identify themselves as contractors at all times, such as when attending meetings, answering Government telephones, or working in situations where their actions could be construed as official government acts. The contractor must display his or her name and the name of the company while in the work area, wear and display a building pass, if required by security procedures, and include the company's name in his or her email display.

U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH REQUIREMENTS MANUAL, EM 385-1-1

This paragraph applies to contracts and purchase orders that require the contractor to comply with EM 385-1-1 (e.g., contracts that include the Accident Prevention clause at FAR 52.236-13 and/or other safety provisions). EM 385-1-1 and its changes are available at:

The Contractor shall be responsible for complying with the current edition and all changes posted on the web through the date that is 10 calendar days prior to the date offers are due. If the solicitation is amended to extend the time set for receipt of offers, the 10 calendar days rule stated above shall be applied against the amended date. (For example, if offers are due on 10 April, all changes posted on or before 31 March shall apply to the contract. If the time for receipt of offers is extended from 10 April to 20 April, all changes posted on or before 10 April shall apply to the contract.)

REQUIRED INSURANCE

The contractor shall procure and maintain during the entire period of his performance under this contract the following minimum insurance in accordance with the Contract Clause entitled "Insurance-Work on a Government Installation."

Workmen's Compensation and Employers' Liability Insurance:

Workmen's Compensation and Occupational Disease Coverage in accordance with statutory limits. Employers' Liability Coverage with a minimum limit of $100,000. (The Contractor shall verify with the State Board of Workers Compensation for each state in which performance is required in connection with this contract, to determine his or her own applicability with respect to this provision.)

Comprehensive Automobile Liability Insurance:

Bodily injury coverage with minimum limits of $250,000 per person and $500,000 per occurrence. Property Damage Coverage with a minimum limit of $25,000 per occurrence.

Comprehensive General Liability Insurance:

Bodily injury coverage with minimum limits of $1,000,000 per occurrence.

At all times during performance, the Contractor shall maintain with the Contracting Officer a current Certificate of Insurance showing at least the insurance required above, and providing thirty (30) days written notice to the Contracting Officer by the insurance Company prior to cancellation or material change in policy coverage. Current Certificate of Insurance shall be furnished to the Contracting Officer within five (5) days after award of contract.

MINIMUM GUARANTEE

The minimum guaranteed obligation amount is $2,500.00 for the life of the contract; therefore, $2,500.00 is the maximum amount for which, the Government shall be liable, regardless of how many options are exercised. This amount may be met by issuance of the first task order.

If the Government's requirements for services set forth in the solicitation do not result in orders beyond the amount described as “minimum obligation”, the event shall not constitute the basis for an equitable price adjustment under this contract. If the Government's requirements for services set forth in the solicitation do not result in orders in the amount described as "estimated maximum", the event shall not constitute the basis for an equitable price adjustment under this contract. The Government is not obligated to award any option periods.
