(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representations.
(1) The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.
(2) After conducting a reasonable inquiry for purposes of this representation, the offeror represents that it [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror(s) whose offer(s) conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The government intends to award one contract to the Offeror whose proposal meets all of the technical criteria and offers the lowest evaluated price. The following factors listed below shall be used to evaluate offers. The basis for award is lowest price technically acceptable offer.
The two (2) non-price factors Technical Approach and Past Performance will be evaluated on an Acceptable or Unacceptable basis. In order to be considered technically acceptable, offers must be rated as Acceptable for both non-price factors: Technical Approach and Past Performance.
Ratings: Those Offerors whose proposals meet the requirements of the specifications will be considered acceptable. Those Offerors whose proposals do not meet the requirements of the specification will be considered unacceptable.
FACTOR 1 – TECHNICAL APPROACH
Offerors will demonstrate their technical approach/plan in narrative format for the following work:
1. Supply and Installation of 8, 480 V Motor Control Centers
2. Installation of 480 V Panel Board
Offeror must indicate if/when subcontractors are planned to be used.
Ratings: Ratings for this factor will be either Acceptable or Unacceptable
Evaluation Standard:
A Rating of ACCEPTABLE will be given if the Proposal clearly meets the minimum requirements of the solicitation in regards to supply, removal, and installation of 480V Motor Control Centers and panelboards.
A Rating of UNACCEPTABLE will be given if the Proposal does not clearly meet the minimum requirements of the solicitation in regards to supply, removal, and installation of 480V Motor Control Centers and panelboards.
FACTOR 2 – PAST PERFORMANCE
Offeror must submit documentation on up to 3 projects showing work experience similar in scope and complexity to this RFP. Projects must have been completed within the past five years to be considered.
The result of this review will either be an Acceptable or Unacceptable rating as described below. Past performance will be evaluated on work that is on-going (at least 50% complete) or recently completed (within the last 5 years) that is relevant, in terms of similarity and complexity, to the work described in the Statement of Work. The offeror must submit past performance demonstrating acceptable functionality of the supply, removal, and installation of 480V Motor Control Centers and panelboards.
The offeror will complete a Proposal Data Sheet (Attachment 1) for each past performance example submitted. The offeror must have had a satisfactory review of the work completed. Contact information for the customer of the past performance example is required.
The Government reserves the right to obtain past performance information from other sources. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.
Ratings: Ratings for this factor will be either Acceptable or Unacceptable
Evaluation Standard:
Acceptable – Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (see note below).
Unacceptable – Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note – In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
PRICE
The Government will evaluate the price proposal for the project to determine whether the offered price is fair and reasonable. The contract line items will reflect a clear understanding of the Statement of Work requirements.
a. Reasonableness of an Offeror’s proposal is evaluated through cost or price analysis techniques as described in FAR Subpart 15.305(a)(1) and 15.404-1(b). For a Price to be reasonable, it must represent a price that provides the best value to the Government when consideration is given to prices in the market, (market conditions may be evidenced by other competitive proposals) and the technical and functional capabilities of the Offeror.
b. Price proposals that are unrealistically high or low in price when compared to the Government estimate and market conditions evidenced by other competitive proposals received may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the proposal being considered unacceptable.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
