8. BASIS FOR AWARD
The Government intends to award a single, firm-fixed-price construction contract to the responsible bidder who submits the lowest responsive bid conforming to the solicitation requirements. To be eligible for award, bids must conform in all material respects to the solicitation requirements provided in Section 00 21 13, Instructions To Bidders. Failure to price any individual CLIN will render the bid non-responsive and ineligible for award.
8.1 Determination of Lowest-Priced Bid and Award of Option CLINS
The Government will calculate a bids total evaluated price (TEP) by adding the base CLIN price and the total of all Option CLINS. The lowest-priced bid is determined by the bidder submitting the lowest TEP. Please note that the evaluation of Option CLINS for award purposes does not obligate the Government to exercise them. Evaluating these Option prices upfront preserves the Government's legal right to exercise these Options after the initial contract award.
Additional Quantities at Award (RFO 52.217-4):
Should sufficient funding be available at the time of contract award, the Contracting Officer may choose to award the Base CLIN along with any combination of evaluated Option CLINs. The low bidder will still be determined by the TEP as indicated above.
Additional Quantities Post-Award (RFO 52.217-7):
Option CLINS not made at time of award may be exercised within the specified time constraints provided in this solicitation.
8.2 Fair and Reasonable Price Determination
The Government will not award a contract unless the price is determined to be fair and reasonable.
Pricing Techniques: The Contracting Officer will utilize price analysis techniques outlined in RFO
15.406 (as referenced by RFO 14.306-2(b) and DFARS Part 214) to verify price reasonableness.
This may include the following:
Comparison of competitive bids received in response to the solicitation.
Comparison of competitive bids with historical prices paid for the same or similar items.
Comparison of bid prices with the Independent Government Estimate (IGE).
Inadequate Competition / Single Bid Received: If only one responsive bid is received, the price analysis and negotiation procedures under DFARS 214.305-70 and DFARS 215.371 ("Only One Offer") will apply. The Contracting Officer may require the submission of certified cost or pricing data or data other than certified cost or pricing data to determine price reasonableness.
8.3 Unbalanced Pricing
The Government will compare individual contract line item prices among all bidders and against the Independent Government Estimate (IGE) to identify if there are any significantly overstated or understated CLIN pricing. In accordance with the principles of RFO 15.404-6, the Government may reject a bid if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government, or if the bid is so grossly unbalanced that it fails to represent a fair and reasonable price for the work as a whole.
8.4 Responsibility Determination
Consistent with the standards of RFO Subpart 9.1 and RFO 14.306-2(a)(1), the Contracting Officer will perform a responsibility determination prior to award. Failure to meet these minimum standards of responsibility will result in a determination of non-responsibility, and the bid will be excluded from award consideration.

Bids will be opened at 1:00 PM CDT. This delay is necessary to allow time to prepare Bid Report information and download all bids from PIEE. The Bid Opening Official or Contract Specialist may open electronic documents before the bid opening to prepare for the bid opening, but will not record or communicate bid prices with any other individual until the bid opening. No Government officials will open electronic documents until the independent government estimate is finalized and received by the Bid Opening Official.

During the bid opening, the Bid Opening Official will read the bid totals in the order received electronically. The Bid Opening Official will then read the total amount of the independent government estimate and announce the apparent low bidder. If requested, the Bid Opening Official may read the line item prices of the apparent low bidder. The Contract Specialist will record the bid opening results which will be posted to www.SAM.gov as quickly as practicable following the bid o pening.
To preserve conference line stability, bidders are asked to limit the number of individual calls to the conference line to the minimum needed for participation. The bid opening will proceed as scheduled even if individual bidders or members of the public are not able to access the telephone line at the bid opening time. Any interested party may access the results of the bid opening on www.SAM.gov shortly after the bid opening.
7.4. Post-Opening Information: Information concerning the status of the evaluation and award will be published electronically on SAM.gov at https://sam.gov/. Written unsuccessful bidder notifications will not be issued.
