ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract

Rating will be neither positive or negative.

The Government will not exercise any supervision or control over the contract service providers performing the services described herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform mowing services in parks as defined in this Performance Work Statement (PWS). The Contractor shall perform to the standards in this contract.

The Lake Office will coordinate the sequence in which the parks are to be mowed. The Contractor will receive at least forty-eight (48) hours advance notice before the work start date. Mowing services are divided into two types: Park and Periodic. Prior to commencement of mowing operations in each area, the Contractor shall survey the park and submit a Pre-mowing Report of all damage or vandalism to the Government. Any damage found thereafter by the Government that has not been previously reported by the Contractor shall be assumed to be damage caused by the Contractor's operation and shall be repaired, replaced or deducted from the Contractor’s invoice, as determined by the Government, at no cost to the Government.

The Government requires the Contractor to uniformly mow and trim vegetation between two

(2) inches and four (4) inches in height for Park and Periodic Mowing. Edging and trimming shall be performed as necessary along concrete walkways, curbs, guardrails, fencing and roads. 1.2.1.2 Lake Elevation Fluctuation: Lake Elevations will fluctuate dependent upon precipitation amounts and operations related to flood risk management and water supply missions. During extended periods of heavy rain, various parks are subject to flooding due to increased lake levels, which in turn reduces mowing areas. Depending on severity of flood event, USACE reserves the right to modify or suspend the mowing schedule. During such flood events, USACE will only pay for services performed.

1.2.1.3 Gate Complexes: Gate complexes shall include mowing, trimming and edging of all grounds designated as being part of each gate complex. This shall also include islands, gates, signs, parking areas, and other related objects or areas designated by the Typical Drawings and Mowing Maps or by the Government on the ground.

1.2.1.5 Inspections: All mowing operations required in the parks shall be completed and inspected by the Contractor's Quality Control Inspector prior to contacting the Government Quality Assurance Inspector for inspection. The Contractor shall notify the Government immediately upon completion of services so that the Quality Assurance Inspector may schedule inspection within one (1) working day of the notification. As a minimum, sufficient equipment to remedy any deficiency found shall remain available for use until work has been accepted by the Government. The Contractor shall be responsible for re-performance of any and all deficiencies discovered during the quality assurance inspection within twenty four (24) hours of report of said deficiencies at no additional cost to the Government. If re-inspections by the Quality Assurance Inspector become necessary, a re-inspection/administration cost of one hundred dollars ($100) will be applied by the Government in accordance with the Quality Assurance Surveillance Plan (QASP) as provided in ATTACHMENT 3.

1.2.1.6 Safety Meetings: The Contractor shall hold a safety meeting with all employees prior to each mowing operation and shall notify the Government of locations and time of each meeting. A copy of safety meeting reports shall be submitted to the Government prior to performing mowing.

Vegetation along concrete walkways, concrete drainage channels, curbs, parking lots, roads, around trees, sign posts, traffic barricade posts and rocks, around electrical panels, septic tank lids, water meter and valve boxes shall be neatly trimmed or edged without causing damage to such facilities. All hard surfaces such as roadways, parking lots, sidewalks, slabs, impact areas, etc. shall be free of all debris produced during mowing services.

1.2.1.8 Traffic Regulations and Safety: The work to be performed under this contract shall be within the boundaries of land administered by the U.S. Army Corps of Engineers. An observed violation of safety requirements shall be grounds for the Government to stop work. Work shall not continue until the violation is corrected.

1.2.1.9 Accident Reporting: The Contractor shall maintain an accurate record of, and shall report to the Contracting Officer in the manner and time limitations and on the forms prescribed by the Contracting Officer, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incidental to work performed under this contract. Medical expenses for Contractor personnel are the responsibility of the Contractor.

1.2.1.10 Equipment: The Contractor shall utilize equipment that equals or exceeds the quantity and quality set forth in this contract and as approved by the Government for award of the contract. If the Contractor demonstrates that the requirements of this contract can be met with less equipment or a different kind of equipment after work commences, the amount and/or type of equipment may be modified upon written approval of the Contracting Officer (KO). If the Contractor is unable to accomplish work in accordance with the requirements of this contract within the times specified, the Contractor shall immediately obtain additional equipment necessary to fulfill the requirements of this contract at no additional cost to the Government.

1.2.1.10.1 Additional Requirements: Equipment shall be sufficient to meet requirements and in compliance with Section 18 of Safety Manual. No tractors or shredders will be allowed on leach fields or inside parks. All equipment must be operated in such a manner as to not cause damage to facilities, persons or property. String trimmers may not utilize steel or other type of cord that will cause damage to trees, shrubs, wooden fence posts, wooden traffic barricade posts, building siding, etc.

1.2.1.10.2 Condition of Equipment: All equipment used to perform work under this contract must be in good operating and mechanical condition and comply with Safety Manual. A regular schedule of preventive maintenance must be followed on all equipment. All maintenance shall be conducted off Government property. The Contractor shall ensure leaking and unsafe equipment is repaired immediately and shall be responsible for containment and cleanup of leaks. The Contractor shall remove and dispose of, and restore to original condition all contaminated soils resulting from leaks or spills in accordance with Federal, State, County and Municipal laws, codes and regulations.

1.2.1.11 Safety Inspections: Prior to work commencement, all equipment shall be inspected by the Government to ensure compliance with Section 18 of Safety Manual. The Contractor shall present all equipment to the Government for inspection whenever equipment is brought to the Lake. The Contractor shall notify the Government at least two (2) days prior to bringing equipment on-site so that the time and place of these inspections may be scheduled. The Government may inspect equipment at any time it is operated on Government Property. Any equipment found deficient shall be taken out of service immediately until faulty conditions have been corrected and passed by the Government. No such removal will reduce the Contractor's obligation to perform all work required within the time scheduled under this contract. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

1.2.1.12 Vehicles: All vehicles, including the Contractor’s and any Subcontractors’ utilized under this contract shall be presentable, serviceable and shall comply with insurance and safety standards as required by the State of Texas. Vehicles shall be identified with company name or logo conspicuously displayed on door panels. Professionally prepared hand-lettering, magnetic signs or pressure sensitive decals shall be used.

1.2.1.13 Maps: Mowing Maps are provided in ATTACHMENT 5 and indicate the approximate areas where services shall be performed. Due to the large scale of service areas, actual boundaries on-site may not be discernible from the maps and delineation on-site by the Government will govern.

1.2.1.14 Reports: The Contractor shall prepare and submit Daily Activity Reports and Quality Control Reports as specified. The Contractor shall develop and provide their own reports. A Daily Activity Report shall be completed each day work is performed and shall be submitted to the Government as directed no later than the following day. A Quality Control Report shall be submitted to the Government at the end of each work week as directed. Quality Control inspectors shall ensure all reports are complete, legible and comprehensible.

1.2.1.15 Area Sizes: Mowing Maps provided in ATTACHMENT 5 and the Tabulation table provided in 1.4.6 depict mowing areas and provide acreage estimates within each park. Lake personnel will show the Contractor the service limits and requirements during an on-site visit of the areas where required mowing services shall be performed. This tabulation depicts current conditions only and does not reflect any future work such as remodeling, re-design upgrades, new construction, demolition or moving facilities within areas which may occur within required service areas during performance of contract. Government reserves the right to perform any future work at its discretion and to modify any and all Schedules within contract for any resulting impact upon the Contractor and Contractor’s required services.

1.2.1.16 Work Sequence: The Government will provide the Contractor with a preferred mowing sequence for parks.

1.2.1.17 Work Completion: The Contractor will be allowed a specified number of working days, exclusive of Saturdays, Sundays and Federal holidays to accomplish mowing dependent upon the number of geographic locations to be mowed simultaneously. All work will commence according to the schedule in 1.3. The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date the Contractor shall provide written notification to the Government and submit for Government approval of a revised schedule. Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the Contractor's control may only be allowed with the approval of the Government.

1.2.1.18 Additional Service Work Requirements:

1.2.1.18.1 Occupied Facilities: If a facility is occupied by the public at the time of the scheduled servicing, Contractor shall ask their permission to service the facility. If the public objects to the performance of the service, Contractor shall immediately record the unit (by park, facility type and number) on the Quality Control Daily Report as a non-serviced unit. If the facility becomes unoccupied while Contractor is still in the park, Contractor may service the unit as required and remove the unit from the Quality Control Daily Report. If the facility is still occupied, Quality Control Daily Report shall remain as is and shall be turned into the Government for non-payment. The Daily Activity Report must be kept current during work performance so that a unit which has not been serviced and was later rejected by the Government's Quality Assurance Inspector can be verified as non-performed because facility was occupied by the public.

A site that is confirmed as being occupied may then be counted as non-performance, rather than as a reject.

1.2.1.18.2 All Quality Control Inspectors and subcontractors, if used, shall possess as a minimum a copy of that portion of the contract which governs the work in which they are engaged. Failure to comply will result in the stopping of work and removal of employees until such time that this requirement can be met.

1.2.1.18.3 Payment: Payment will be made upon completion and acceptance of requested services.

1.2.2 Site Visit: The site visit will be scheduled at Canyon Lake Office, 601 coe Road, Canyon lake, TX 78133. Site visit will be held August 8, 2018 at 9:30 am.

1.2.3 Veterans Employment Emphasis: In addition to complying with the requirements outlined in FAR Part 22.13, FAR Provision 52.222-38, FAR Clause 52.222-35, FAR Clause 52.222-37, DFARS 222.13 and

Department of Labor regulations, U.S. Army Corps of Engineers (USACE) contractors and subcontractors at all tiers are encouraged to promote the training and employment of U.S. veterans while performing under a USACE contract.
