No separate payment will be made for stockpiling stone, and

SECTION 01 22 00.10 Page 6 the cost in connection with stockpiling will be included in the Contract unit price.

1.4.4.2 Measurement

Measurement paragraphs only provide the means for measuring the stone for pay purposes and are not a representation of accessibility of the site.

Other methods of measurement may be used when approved.

Where a loss of material due to stockpiling, rehandling, or hauling is possible, the Contracting Officer will have the discretion to require re-measurement prior to placement.

Stone will be measured for payment by the ton as determined by barge, vessel displacement, certified railroad weights , where direct placement into structure(s) is practicable, or by weighing by the truckload on approved scales meeting the requirements of paragraph TRUCKLOAD.

a. Truckload. Each truck load will be weighed to the nearest 0.1 ton and the final quantity rounded to the nearest whole ton. Stone will be measured for payment by weighing on approved scales before being placed in the work. Scales will be of sufficient length to permit simultaneous weighing of all axle loads and have an accuracy within

0.2 percent throughout the range of the scales. The scale's accuracy will conform to the applicable requirements of NIST HB 44 and be certified by an inspector of the State Inspection Bureau charged with scales inspection within the state in which the project is located prior to weighing any stone. The scales are to be capable of printing a weight ticket including time, date, truck number, and weight. If commercial scales are readily available in close proximity (within 10 miles ) of site of work, documentation is to be submitted certifying that the scales meet the requirements of the specification. Furnish the scales and weigh the stone in the presence of the Contracting Officer, who will read and record the weights thereof, who will certify the correctness thereof. The Contracting Officer may elect to accept certified railroad weights or weight certificates furnished by a public weighmaster in lieu of scale weights at the jobsite. Quarry weights will not be accepted. Scales will be checked and certified before hauling stone and after each 50,000 tons increment of stone weighed under this contract.

1. The original printed certified scale tickets or a certified copy prepared in ink or indelible pencil is to be furnished to the Contracting Officer promptly after a car or truck is weighed and before the stone is placed in the areas to be protected. The report of weight for each carload or truckload is to show the gross, tare, and net weights, and erasures or changes on a report will be explained by a memorandum made on, or attached to, the report and be signed by the Weigh. If deemed advisable, the Government will employ an Inspector at the scales, in which event necessary facilities are to be furnished to the inspector for observing the weighing and for recording the scale weights and stenciled light weights on the cars or trucks. Expense of weighing stone and testing scales will be borne by the Contractor. Other methods of measurement may be used when approved.

2. The weight of sideboards, stakes, and skips, if any, will be determined by actual weighing or by estimates, mutually agreed upon by the Contracting Officer and the Contractor, and the weights so

SECTION 01 22 00.10 Page 7 determined, together with the tare weight of the car or truck, will be deducted from the gross weight to determine the net weight of stone delivered.

b. Barge Load

1. Gauges. The barge (carrier) for stone delivery is fitted by the Contractor at his own expense with GAUGES or other facilities for accurately determining displacement. Six gauges graduated to 0.1 ft or other suitable units should be placed near the ends and midpoints of both sides.

2. Gauging Tables. A gauging table is prepared by an accredited agent satisfactory to the contracting officer. The table shows the cargo weight in tons for each linear unit of draft. If the lines of the carrier are such that displacement in cubic feet for each measured unit of draft can be accurately calculated, the gauging table is based upon 62.4 lb/cu ft in fresh water and 64 lb/cu ft in salt water.

3. Reading Gauges. The Contracting Officer should have the opportunity to be present at all draft readings. All measurements for determining gauging tables and for calculating loads should be made in still water close to the work. The Contractor should be required to place the carrier where such measurement can be accurately made.

(1) If delivered by barge, stone will be measured for payment by the Contracting Officer by weight determined by barge displacement.

Furnish the Contracting Officer a barge displacement table not less than 10 work days prior to unloading the stone from any barge. Each table submitted will show the name and/or number of the barge owner, the name of the fabricator, and the certification and date of certification of the person or firm preparing the table. Furnish with the barge displacement tables a drawing or sketch of each barge, dimensioned in sufficient detail to permit checking of the tables. The drawings are to show, as a minimum, the length, width, depth of the barge, and dimensions of the rake or rakes. Each such table is to have its accuracy certified by a person or firm, other than the Contractor, customarily performing this service. Each table submitted will contain, in parallel columns, the freeboard of the barge in feet and tenths from zero to the full depth of the barge and the corresponding gross displacement to the nearest ton. Each barge is to be suitably marked with three displacement gaging locations on each side near each end of the barge and two amidships on opposite sides. Each gaging location is to be marked by a line perpendicular to the edge of the barge, 4 inches wide and 1 foot long, on both the deck and side of the barge and two amid ship on opposite sides.

Barges with rakes shall have the displacement gaging lines placed at each corner of the box section between the rakes. If a barge has a box end or ends, the gaging locations are to be placed approximately 4 feet from the box end(s). The freeboard will be measured at the six gaging locations and the displacement determined by the use of "STANDARD BARGE TABLES" from the average of these measurements. The displacement will be determined before and after being unloaded and the difference between these values shall be the quantity delivered. Submit the Gaging Table Data , stone hauling vessel, gaging tables and a copy of the data and calculations used for the preparation of the tables. Barges are to be loaded so that the readings taken at the gaging locations do

SECTION 01 22 00.10 Page 8 not vary more than 1.5 feet port to starboard fore and aft and do not vary more than 0.5 feet port to starboard. If such is not the case, trim the carrier by shifting the stone until this limit is reached, before the measurement will be accepted. The draft will be determined from the average of all six readings weighting the readings of the middle gage at double those of the end gages.

(G1 + G 2 + 2xG 3 + 2xG 4 + G 5 + G 6) divided by 8 = average draft.

All carriers used in transporting stone are to be free of leaks such as would render accurate gauging difficult. Facilities for inspecting the hold of each carrier to determine whether leakage is occurring shall be provided. Each carrier shall also be provided with adequate pumping facilities, and if water is found to be accumulating in the hold, the carrier shall be pumped dry before each gaging, both before and after unloading. Lightening by pumping or by transfer of crew or supplies will not be permitted while stone is being transferred. Rejected stone and unacceptable material shall be left aboard the barge until after the final readings have been taken.

(2) If barge tables are furnished for fresh water and if it is believed that barge displacement measurements made within the contract limits of the work are being taken in water that has salinity, the Contractor has the option of obtaining water samples and determining densities or unit weights of these samples. These water samples shall be taken in accordance with ASTM D3370 (Practice A - Grab Samples) at depths of 4 and 8 feet in the area where measurements are made. Water sampling shall be performed when the barges are measured for quantities, both when fully loaded and when empty. Take water samples, as witnessed by the Contracting Officer, with the use of "Polypro" 2000 ml water sampler, or equal. Densities shall be determined as specified in ASTM D1429 (Method D-Hydrometer Method). Testing shall be done for the Contractor by a certified testing laboratory, and test results certified by the laboratory. After review and approval of the test results by the Contracting Officer, the average of the densities obtained at 4 and 8 feet will be used as the suitable salt water conversion factor. In all calculations, the unit weight of 62.4 pounds per cubic foot will be used for fresh water.

3. Before and after displacements, due to load, shall not differ more than 10 percent from their mean for the determination of tonnage of each barge load of stone ready for placement. In determining the tonnage of cargo, the change in Gage readings due to discharge of the cargo will be used.

4. The Contractor will be required to provide barge displacement charts to the Contracting Officer for review. The Contractor will pump the water from the barges when so requested but no pumping of a barge will be done between the time it is Gaged loaded and light to determine the amount of a barge load.

5. Repairs or additions made to the barges during the progress of the work shall be promptly reported to the Contracting Officer.

During the progress of the work, if the Contracting Officer considers it advisable or necessary, each barge shall be re-measured at the expense of the Contractor and under the supervision of the Contracting Officer. No barge shall be used which is not in a seaworthy condition or which leaks excessively.

The barges used shall be so constructed that when loaded they do

SECTION 01 22 00.10 Page 9 not bend or warp so that the Gages are unreliable. Each barge load shall contain only one class of stone.

6. To determine the load, measurements will be taken immediately before a barge starts for its point of unloading and immediately after it returns from that point. The Gages shall be read by the Contractor in the presence of the Contracting Officer. The calculation performed by the contractor shall be provided to Contracting Officer for review. Disagreements on the part of the Contractor as to the weight of stone will be reported to the Contracting Officer in writing within 10 calendar days of their occurrence. Disputes will be handled in accordance with the CONTRACT CLAUSE entitled DISPUTES. To ensure the use of the proper weight of surrounding water in calculating the weight of stone from the barge Gage readings, hydrometer measurements will be made along side each barge when it is Gauged loaded and light.

Other methods of measurement may be used when approved.

As-built drawings are developed and maintained by the Contractor and depict actual conditions, including deviations from the Contract Documents. These deviations and additions may result from coordination required by, but not limited to: contract modifications; official responses to Contractor submitted Requests for Information; direction from the Contracting Officer; designs which are the responsibility of the Contractor, and differing site conditions. Maintain the as-builts throughout construction as red-lined hard copies on site. These files serve as the basis for the creation of the record drawings.

1.2.2 Record Drawings

The record drawings are the final compilation of actual conditions reflected in the as-built drawings.

1.3 SOURCE DRAWING FILES

Request the full set of electronic drawings, in the source format, for Record Drawing preparation, after award and at least 30 days prior to required use.

1.3.1 Terms and Conditions

Data contained on these electronic files will not be used for any purpose other than as a convenience in the preparation of construction drawings and data for the referenced project. Any other use or reuse is to be at the sole risk of the Contractor and without liability or legal exposure to the Government. The Contractor will make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. The Contractor will, to the fullest extent permitted by law, indemnify and

SECTION 01 78 00.00 45 Page 2 hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.

These electronic CAD drawing files are not construction documents.

Differences may exist between the CAD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CAD files, nor does it make representation to the compatibility of these files with the Contractor hardware or software. In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished Source drawing files, the signed and sealed construction documents govern. The Contractor is responsible for determining if any conflict exists. Use of these Source Drawing files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project. If the Contractor uses, duplicates or modifies these electronic source drawing files for use in producing construction drawings and data related to this Contract, remove all previous indicia of ownership (seals, logos, signatures, initials and dates).

1.8 HAUL ROADS

The haul road between the borrow areas and the dike shall be located and constructed within approved limits. Haul roads shall be constructed to maintain the intended traffic, be free draining, and be maintained in good condition throughout the Contract period. A haul road which crosses a creek or drainage channel shall be constructed and maintained so it will not flood either upstream areas by restricting stream flows or flood downstream areas by the release of stored water if the crossing fails for any reason. Costs associated with these haul roads will be considered a subsidiary obligation of the Contractor.

SECTION 35 41 00.01 45 Page 4

1.9 STOCKPILING

When the excavation from borrow sources progresses at a faster rate than placement in the fill is being accomplished, such excavated material shall be stockpiled at approved locations adjacent to the work until its use is authorized. No payment will be made for such stockpiling nor for the reloading and hauling of this material to its final position in the containment dike.

1.10 QUANTITY SURVEYS

(1) Quantity surveys are to be conducted, and the data derived from these surveys will be used in computing the quantities of work performed and the actual construction completed and in place.

(2) The Contractor is to conduct the original and final surveys and surveys for any periods for which progress payments are requested.

These surveys will be conducted under the direction of a representative of the Contracting Officer, unless the Contracting officer waives this requirement in a specific instance. The Government will make the computations that are necessary to determine the quantities of work performed or finally in place. The Contractor is to make the computations based on the surveys for any periods for which progress payments are requested.

(3) Promptly upon completing a survey, the Contractor is to submit the originals of field notes and other records relating to the survey or to the layout of the work to the Contracting Officer, who will use them as necessary to determine the amount of progress payments.

Field notes for original and final surveys and surveys for any periods for which progress payments are requested will be provided to the Contracting Officer in an ASCII data file format in the form, point name, easting, northing, and elevation. The Contractor is to retain copies of the material submitted to the Contracting Officer.

1.11 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work will be as set forth in the CONTRACT CLAUSE entitled PERMITS AND RESPONSIBILITIES.

However, if in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for these repairs will be made at the applicable Contract unit or lump sum price as fixed and established in this Contract. If, in the opinion of the Contracting Officer, there are no Contract unit or lump sum prices applicable to any part of this work an equitable adjustment pursuant to the CONTRACT CLAUSE entitled CHANGES of this Contract, will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable Contract unit or lump sum prices. Except as herein provided, damage to all work, including temporary construction; utilities; materials; equipment; and plant shall be repaired and approved at the Contractor's expense regardless of the cause of this damage.
