ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

has not yet identified corrective actions.

The contractor’s proposed actions appear only marginally effective or were not fully implemented.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

PWS

PERFORMANCE WORK STATEMENT (PWS)

Herbicide and Pesticide Services Lavon Lake, Collin County, Texas

1. GENERAL: This is a non-personal services contract to provide herbicide and pesticide services at Lavon Lake. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, permits, supervision, and other items and non-personal services necessary to perform herbicide and pesticide services as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2. Scope: Contractor shall provide all labor, permits, tools, equipment, materials, and chemicals required to mix, transport, and apply herbicides and pesticides as specified in this contract. Services include spraying/applying herbicides and pesticides and shall be performed as specified, to the limits shown, on individual Ordering Letters and project maps (See Section 1.9.3 Technical Exhibit 3), as directed. In general, herbicide and pesticide services shall be applied at various locations throughout the government property boundaries surrounding the locations identified below (including, but not limited to flood control prime facilities/dam embankments and recreation/park facilities). The Contractor shall possess a valid State of Texas Commercial Applicator’s License and shall comply with the conditions specified in the sub-paragraph 3-3e and 3-4 in ER 1130-2-540. A copy of the Contractor’s Applicator License must be provided to the Contracting Officer (KO) before an award will be made. The Contractor shall ensure that a certified applicator is on the job at all times to supervise all contract operations. The Contractor shall give, in writing, any such supervisor, authority to act in his/her behalf. The Contractor or the designated supervisor, while supervising the work will at all times be in possession of a copy of this contract and a copy of their individual Commercial Applicator’s License.

1.2.1 Payment: All work must be inspected and accepted by the Lake Manager, or Contracting Officer’s Representative (COR), as applicable, or designated Quality Assurance (QA) Inspector before any payment can be made. Inspections will be made by the Lake Manager, COR, as applicable, or QA Inspector after each application is completed. No payment will be made until the areas treated have been inspected and accepted by the inspector. Inspections may take up to two weeks after the completion of any Ordering Letter so results can be seen.

Any work that is rejected as unsatisfactory by the inspector (less than 90% kill) will be redone by the Contractor at the Contractor’s expense.

1.2.2 Application Treatment Specifications: Applications will be done at a time when, according to the label, satisfactory results can be expected. The type of herbicide or pesticide will be determined by the Contractor; colored dye will be added to the herbicide (not pesticide) to show coverage of application. The herbicide applications will be for herbaceous (annual and perennial grasses, broadleaf weeds), and woody vegetation. Normally, two applications will be performed annually: spring and fall applications (dependent on lake elevations and park closures). The exact date of when an application will be performed will be determined by weather conditions. When conditions such as excessive moisture, potential rainfall, wind speed, or other factors prevail to such an extent that satisfactory results cannot be obtained, no applications should be made.

Work should resume only when desired results can be obtained. If work cannot be commenced or completed by the specified dates in an individual Ordering Letter, the Contractor shall provide written notification to the Lake Manager, or COR, as applicable. Delays in service requiring an extension to the completion date of any Ordering Letter due to inclement weather or conditions beyond the Contractor’s control may only be allowed with the written authorization of the Lake Manager, or COR, as applicable. The specifications are split into 3 major categories and relate directly to the legend on the maps.

1.2.2.1 Herbicide (Paved)

1.2.2.1.1 Roads and Road Shoulders - This application treatment will be for an area a minimum of three-foot (3’) wide along each edge of the roadway, boat ramp, parking lot, pullout, or pull-through. Any vegetation that is growing up in between the edges shall also be treated.

Maps are included to show these areas in further detail.

1.2.2.1.2 Boat Ramp Rip-Rap - This application treatment of

herbicide will occur on all rip-rap associated with the boat ramps.

1.2.2.1.3 Stilling Basin Steps and Fishing Platform - This

application shall cover a minimum of three-foot (3’) wide strip along the steps and platform.

1.2.2.2 Herbicide (Area)

1.2.2.2.1 This application treatment of herbicide will occur on all rip-rap associated with the dam (upstream of the dam, around stilling basin), on the outlet works to include u-channels, weep-holes, and at other areas related to dam operation. Maps are included to show these areas in further detail. This would include both broad application and spot treatment.

1.2.2.2.2 The area in Caddo Park includes the treatment of aquatic plants in and around the 3 fishing ponds.

1.2.2.2.3 This application treatment of herbicide will occur on all rip-rap associated with shoreline erosion control at Lavonia and Pebble Beach Parks.

1.2.2.2.4 This also includes a miscellaneous line for non-routine spraying. This would primarily be an application to target specific invasive or noxious broadleaf or woody plants. The grassy area below the dam is an example of where the application might be used to reduce broadleaf weeds on the downstream embankment.

1.2.2.3 Pesticide
