CLAUSES INCORPORATED BY FULL TEXT

52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.

(End of provision)

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2) The forms must be fully completed to be considered for this factor.

3) Projects must include the following elements in each:

- Dollar value of at least $200,000.00

- Experience with installation of remedial water stop systems, using urethane cylinders method, of similar size and scope with predominance of management and responsibility for the project.

6) If experience of predecessor companies, key personnel, or major subcontractors is submitted to qualify for this factor the forms must include a statement indicating their role in the project being used as experience as well as the percentage of work they will be performing in the proposed project. The Government will not consider the experience provided if it is determined the role in either project is not significant. Experience of key personnel or subcontractors may only be used to qualify for this factor so long as the offeror certifies to the Government that they shall be employed on the project once an award is made.

7) If submitting experience of a team member, describe the role they will play in the project and the percentage of work they will be performing.

8) Forms must identify the Offeror’s role in the project (i.e., as a prime or a subcontractor)

- Provide a Gantt chart reflecting the major construction activities with the completion period from the applicable contract Notice to Proceed (NTP). The proposal schedule shall be graphically presented, FOR OFFICIAL USE ONLY SOURCE SELECTION INFORMATION FAR 2.101 AND 3.104 and may be sized for a maximum paper size of 11”x17”. The schedule shall reflect the major construction milestones, and the sequence of work required for this project. The schedule shall indicate start/finish dates of events and durations. A detailed network analysis is not required as a proposal submittal item.

- The schedule must meet the project duration shown in Section 00 73 00 Paragraph 52.211-10, Commencement, Execution and Completion of Work.

- Schedule must show Government submittal review durations as contractually mandated.

FACTOR 3, PAST PERFORMANCE:

1) For each project submitted under the Experience factor that does not have an evaluation in the Past Performance Information Retrieval System (PPIRS), which includes evaluations submitted in ACASS, CCASS, and CPARS, Offerors shall forward a copy of the Past Performance Evaluation Questionnaire (PPQ) included at Attachment 3 to the points of contact responsible for monitoring performance under those projects.

2) Completed PPQs can be returned to the offeror or submitted directly to the Government’s point of contact, Kevin Anderson, via e-mail at: Kevin.S.Anderson2@usace.army.mil. Offerors are responsible for ensuring completed PPQs are received by the Government prior to the proposal closing date/time. If unable to obtain a completed PPQ for a project timely the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).

Part III. EVALUATION OF PROPOSALS

1. GENERAL ELIGIBILITY FOR CONTRACT AWARD: In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met.

2. BASIS OF AWARD: Selection for award will be determined using the Tradeoff Process in accordance with FAR 15.101-1. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal.

Evaluation Factors:

Factor 1, EXPERIENCE Factor 2, TECHNICAL APPROACH Factor 3, PAST PERFORMANCE Factor 4, PRICE

All evaluation factors other than price, when combined, are significantly more important than price.

3. EVALUATION OF THE PRICE PROPOSALS

a. Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

b. An offeror may be required to confirm its price on either a CLIN, element, or total price basis, and/or provide additional information in support of their price prior to contract award at the Government’s request and discretion.

4. GENERAL TECHNICAL CRITERIA

• Conformance with the specified format and submission requirements will be considered during the technical evaluation. Failure to comply with the format and/or the submission requirements may be seen as indicative of the type of problems that could be expected during contract performance.

• Material omission(s) may result in the offer being found deficient.

• Proposals which are generic, vague, or lacking in detail may be considered deficient. The offeror’s failure to include information that the Government has indicated should be included in the proposal may result in the offer being found deficient.

5. EVALUATION OF THE TECHNICAL PROPOSAL:

Experience and Technical Approach Ratings: The Experience and Technical Approach factors will receive one of the ratings described below:

Outstanding: Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good: Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable: Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal: Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

FOR OFFICIAL USE ONLY SOURCE SELECTION INFORMATION FAR 2.101 AND 3.104

Unacceptable: Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

FACTOR 1, EXPERIENCE

The Government will review the project experience submitted up to the limits specified to ensure the submission requirements are met.

• More than two projects completed within the past six years that are similar in scope, magnitude and complexity as the RFP requirement and meeting the submission requirements may be considered a strength.

• More than one Experience project including experience working with the USACE, including Safety Manual EM385-1-1, the 3-phase inspection process, Quality Control, and Scheduling may be considered a strength.

• More than one Experience project including experience with installation of remedial water stop systems, using urethane cylinders method, of similar size and scope with predominance of management and responsibility for the project.

FACTOR 2, TECHNICAL APPROACH

The Government will review the narrative and schedule to ensure the submission requirements are met. The narrative and schedule will be specifically reviewed for:

- an understanding of the project requirements

- a technically feasible approach to meeting the project requirements

- a commitment to accomplish all the work in accordance with the solicitation requirements

- a commitment to meet scheduling requirements and complete the project within the contract period of performance

- An adequate plan for customer service and Quality Control. An adequate plan will address the following topics: Management approach; oversight of application methods; adequacy of basic data and assumptions;

completeness of documentation; compliance with the contract specifications; and method for identifying, reporting, and resolving problems.

- Adequate construction safety procedures. Adequate construction safety procedures need to be in compliance with the USACE safety and health requirements found in EM-385-1-1 and need to address:

sanitation, medical & first aid, temporary facilities, personal protective & safety equipment; Hazardous materials, lighting, signage, fire prevention, welding, electrical, hand & power tools, load handling equipment, vehicles, and fall protection.

- Completeness and accuracy of schedule to include the critical path and completion of all construction activities within the allowed period of performance.

FACTOR 3, PAST PERFORMANCE:

Ratings: The Past Performance factor will receive one of the ratings described below:

Substantial Confidence: Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence: Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence: No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

- The Government will review the past performance information for the projects submitted for Factor 1, Experience that are recent (completed within the past six years), and relevant (contracts for installation of remedial water stop systems, using urethane cylinders method). The Government reserves the right to consider other past performance information from any source.

- If any negative past performance information is received to which the Offeror has not previously had an opportunity to respond, the Offeror will be given an opportunity to provide rebuttal.

- Recent, relevant past performance information/reports will be assessed to determine the overall quality of the work performed.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions.

The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

No information or did not apply to your contract

Rating will be neither positive nor negative.
