SUMMARY OF CHANGES

SECTION A - SOLICITATION/CONTRACT FORM

The required response date/time has changed from 17-Oct-2017 02:00 PM to 30-Aug-2018 02:00 PM.

RESPONSES TO TECHNICAL QUESTIONS RECEIVIED:

QUESTION 1: Page 8 of the Combined Synopsis Solicitation, it says "STEEL CORE FABRICATION to be produced in the United States."

Does this mean that the production of the steel itself (melting of raw materials) needs to have taken place in the US or does it mean that only the fabrication (rolling of the buoy core) needs to have taken place in the US?

GOVERNMENT RESPONSE 1: Section C of the solicitation, the statement “to be produced in the United States” is hereby deleted. For Clarification: 41 U.S.C. Chapter 83, Buy American, provides a preference for domestic end products for supplies acquired for use in the United States. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for an end product that is Commercial Off the Shelf (COTS) item (See 12.505(a)(1)).

QUESTION 2: Also, would it be possible to have another extension of a few days? Local suppliers have indicated that it will take 2-3 more days to come up with pricing for the materials, particularly the core.

GOVERNMENT RESPONSE 2: YES, AS STATED IN SECTION A ABOVE, THE REQUIRED

RESPONSE DUE DATE IS 28 AUGUST 2018, 2:00 PM (CDT).

QUESTION 3: 1) To summarize, what's required is to provide the equipment to offload, as well as the equipment operator for offloading, correct?

GOVERNMENT RESPONSE 3: Provide the equipment and equipment operator to offload the buoys.

QUESTION 4: 2) The last paragraph states that, "The tractor-trailer assembly, "18-wheeler", will transport a total of five (5) mooring buoys to the Brazos River Flood Gates during each delivery." Will the buoys need to be offloaded and then transported? Or are the buoys offloaded at the final destination?

GOVERNMENT RESPONSE 4: Buoys are to be offloaded at the final destination.

SECTION C – DESCRIPTION OF SPECIFICATIONS

Product Description For Procurement, Delivery and Offloading Mooring Buoys at

Brazos River Flood Gates, Freeport, Texas

Contractor shall furnish all necessary supervision, labor, material, equipment and accessories to deliver and offload commercial "off-the-shelf' or newly constructed mooring buoys, ready for installation at the Brazos River Flood Gates (BRFG) located at 4335 East Flood Gate Road, Freeport, Texas 77541. The filament wraps shall be evenly distributed in the inner 80% to 90% of the coasting thickness. The outer 10% to 20% of elastomer shall have no filament reinforcement. The elastomer and filaments shall be applied in a continuous manner to assure adhesion between the various layers. There shall be a least one wrap for every 0.116 in (2.9 mm) of skin thickness (rounded to the nearest complete wrap). The buoy skin shall extend along the entire longitudinal length of the buoy, over the ends of resilient foam layer, and onto the steel portion of the internal core. The buoy skin shall be bonded securely to the steel of the internal core. The buoy skin shall be repairable if minor damage occurs.

• Outer layers of buoy skin shall be a marine grade aliphatic urethane to minimize color fading and urethane skin degradation and decomposition from UV exposure.

• SKIN FILAMENT REINFORCEMENT:

o FILAMENT WRAP: Construct each filament-reinforcing wrap of continuous filaments applied in a helical pattern, at a helix angle of 45° to 60° to the longitudinal axis of the fender. A wrap shall consist of two such filament helixes of equal but opposing helix angles. The spacing between the filaments in the same helix shall be no more than 0.125 in (3.2 mm), measured in a direction parallel to the longitudinal axis of the buoy. Each wrap shall extend along the entire longitudinal axis of the buoy and shall also encircle and encase the buoy, for the purpose of distributing impact loads over the surface and conducting the forces of impact loads to the central strength member.

o FILAMENT REINFORCEMENT: The reinforcing filaments in the outer skin shall be nylon tire cord of 2,520-denier (0.280 g/m) weight with the following properties:

(1) [ ___ ] Are, [ ___ ] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(4) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
