52.211-10)
The Contract shall be required to:
(a) Commence work under this contract within 10 calendar days after the date of acknowledgement of Notice to Proceed,

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys.
(b) Weather Conditions. Under ordinary conditions, the mean tidal range is about 1.0 foot. The height of tide is largely dependent on the force, direction,and duration of the wind. Strong northerly winds may depress the water surface as much as, and in some instances more than
1.0 foot below Mean Lower Low Water (MLLW), while southerly winds may raise the water surface as much as, and in some instances more than 3.0 feet above MLLW.
(c) Transportation Facilities. The proposed site is accessible by water from Port Lavaca, Port O'Connor Texas and other coastal ports.
Rail highway connections are available at the City of Port Lavaca, and Point Comfort, Texas.
(d) Condition of Channel. The general shape of the existing section of channel to be dredged is shown by cross sections on the Contract drawings.
(e) Channel Traffic. Channel traffic consists of ocean going vessels and small boats of various sizes, fishing vessels, ferries, tugs, tows consisting of a tug and one or more barges. Traffic will interfere with dredging operations to some extent.
1.3 LIQUIDATED DAMAGES - CONSTRUCTION (SEPT 2000) (FAR 52.211-12)

(2) The remaining forty (40) percent upon completion of demobilization.(2) The remaining forty (40) percent upon completion of demobilization.
(b) The Contracting Officer may require the Contractor to furnish cost data to justify this portion of the bid if the Contracting Officer believes that the percentages in Paragraphs (a)(1) and (2) of this Clause do not bear a reasonable relation to the cost of the work in this contract.
(1) Failure to justify such price to the satisfaction of the Contracting Officer will result in payment, as determined by the Contracting Officer, of
(i) Actual mobilization costs at completion of mobilization;
(ii) Actual demobilization costs at completion of demobilization;
and
(iii) The remainder of this item in the final payment under this Contract.
(2) The Contracting Officer's determination of the actual costs in Paragraph (b)(1) of this Clause is not subject to appeal.(b)

Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(See 28.305(c) for treatment of contracts subject to the Defense Base Act.)

The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

PROCESSING DAVIS-BACON ACT CERTIFIED LABOR PAYROLLS (April 2011)
The contractor is encouraged to use a commercially-available electronic system to process and submit certified payrolls electronically to the Government. This durable record copy of data from the electronic Davis-Bacon payroll processing system shall be provided to the Government during contract closeout.
All contractor-incurred costs related to the contractor's provision and use of an electronic payroll processing service shall be included in the contractor's price for the overall work under the contract.
