JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING AGENCY - Department of Army
US Army Corps of Engineers Contracting Division Fort Worth, Texas 76102
2. DESCRIPTION OF ACTION: A new, sole source Indefinite Delivery-Indefinite Quality (IDIQ) contract with the Center for Advanced Decision Support for Water and Environmental Systems (CADSWES) at the University of Colorado at Boulder using Civil O&M funds for programming services to enhance/maintain the reservoir system simulation software package RiverWare. Task orders will be issued as Firm Fixed Price (FFP). RiverWare is used as part of the Corps Water Management System (CWMS).
U.S. Army Corps of Engineers (USACE) is currently a primary sponsor (or user) of the reservoir control software and as such provides funding for the maintaining of USACE code. CADSWES provides an unlimited number of licenses for RiverWare to all USACE Division and District Offices. Currently, the RiverWare license is used in the following USACE offices:
Fort Worth District (SWF)
Tulsa District (SWT) Little Rock District (SWL) Galveston District (SWG) Software is available to other districts as they identify their need.
This will be an Indefinite-Delivery Indefinite-Quantity contract consisting of one 1-year base period and two 1-year option periods..
3. DESCRIPTION OF SUPPLIES/ SERVICES:
This contract is for USACE and is managed by the Fort Worth District (SWF) Reservoir Control Office (CESWF-EC-HL). This is a service contract for CADSWES to continue providing software modifications, enhancements and maintenance of USACE code with RiverWare. . This contract will continue the ongoing work to enhance RiverWare for USACE and cooperating agencies with USACE SWF modeling needs. The scope of the contract includes the following components:
• Enhancements to RiverWare will be made according to USACE modeling needs in accordance with task of each year’s scope of work and funding level.
• Preserving the long-term usefulness of RiverWare for the USACE.
• Updating and modifying RiverWare to execute on existing and new operating systems and operating system levels which the USACE currently or may in the future choose as a platform for RiverWare.
• Establishing a project team to perform the enhancement to RiverWare.
• Appointing a team leader(s) to serve as the primary point of contact for the enhancements.
• Making RiverWare more efficient and easy for USACE personnel to use.
• Assisting the USACE team in the formation of RiverWare basin models to be used for testing the enhancements.
• Assisting the USACE team in the interpretation of the RiverWare model results.
• Documentation describing enhancements.
Estimated value of this contract is $650,000.00. O&M funds are available for this contract action. The previous contracts’ capacity proved to be insufficient to meet our needs. The $500K contracts were set up to meet “immediate” needs when time wasn’t available to go through the much longer process of awarding a larger dollar contract.
4. AUTHORITY CITED - 10 USC 2304(c)(1), as implemented by FAR 6.302- 1(a)(2)(iii) and DFARS 206.302-1; follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost or unacceptable delay..
5. REASON FOR AUTHORITY CITED - Reservoir system simulation using the RiverWare program is critical to the USACE mission to operate the almost 300 flood control reservoirs. Local, regional and national interests, including congressional, commonly exert pressure to modify operating rules and or reallocate flood storage on USACE reservoirs. RiverWare is a critical tool to evaluate requests to modify operating rules, reallocate or evaluate “what-if” scenarios. In addition, USACE No Cost License Agreement with CADSWES for RiverWare allows for free license access to RiverWare software for all USACE districts. USACE does not pay for licenses for the use of RiverWare; however, USACE does pay through contracts the maintenance cost to maintain USACE code within RiverWare. CADSWES is the developer of RiverWare and the sole owner of the code. Only CADSWES has access to the code for enhancement, modification, and/or maintenance.
6. EFFORTS TO OBTAIN COMPETITION – This project will be synopsized and posted to the Federal Business Opportunities (FBO) website. The postings to FBO for previous contracts have not produced any qualified applicants. (See para 8, below.)
7. ACTIONS TO INCREASE COMPETITION –No other firms were found during a search of web sites in January 2012 and there is no way to increase competition as this firm owns the software and their firm is the only one that can provide this service. The Corps signed an agreement with RiverWare acknowledging the Licensed Software and Documentation are proprietary products of and shall remain the property of University or its third party providers.
8 MARKET RESEARCH – On 22 February 2013, a Sources Sought was posted on FedBizOpps with responses due 4 March 2013. No responses were received.
9. INTERESTED SOURCES – To date, no other sources have expressed an interest.
The notices required by FAR 5.201 shall be published, and any bids or proposals received shall be considered.
10. OTHER FACTS – Since 2001, RiverWare has replaced the legacy program SUPER.
SUPER is a system of computer programs developed by Southwestern Division to simulate the daily sequential regulation of a multiple purpose system of reservoirs and the corresponding hydrologic and economic impacts. The majority of these algorithms within this system of computer programs have been programmed into RiverWare by CADSWES through contractual process with USACE. RiverWare is now the core modeling tool used in the day-to-day, mid-range, and long-term reservoir operation studies of the USACE SWD. Riverware was originally developed by CADSWES.
CADSWES programmed into RiverWare the algorithms from the legacy SUPER model that the Corps requested through contracts to be built into RiverWare. In addition, it is the key resource by which data and information in support of critical, politically sensitive, and high-visibility water management decisions by high-level USACE officials is obtained.
