Questions and Answers, W9126G-09-R-0096

The following Questions and Answers are posted for viewing and are provided for informational purposes only to keep all bidders on equal footing. If the solicitation specifications need to be revised as a result of the Questions and Answers, a formal written amendment will be issued to that effect. The solicitation specifications, terms and conditions will remain as written unless a formal written amendment is issued.

Inquiry made by e-mail and phone:

Per the wage determinations provided and subsequently updated through Amendment #4 (Section 00 73 46-12) the solicitation states “Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses”. We do not believe that the labor classes provided meet the requirements for a hazardous material worker. Is there a labor class provided that should be used of this scope?

Response:

If the employee is handling/disposing of any hazardous type materials the employee would be considered a Hazardous Material Removal Worker and should be classified and paid as listed in the applicable wage determination for the area in which the work is being performed.

A common laborer is considered an entry level worker with no specialized skills and do not use specialized tools or equipment, a person that cleans and prepares the jobsite and remove excess materials after the job is completed.

Question?

Would a common laborer have knowledge how to dispose of any hazardous type materials?

At the end of any Davis-Bacon wage determination it states, "Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii))."

The requirement is that the contractor would have to submit a Standard Form (SF) 1444, Request for Authorization of Additional Classification and Rate.

This form must be submitted to me for review. Then I will make a decision whether it can be tentatively approved or disapproved, provided the form is completed correctly, signed by the appropriate individuals and all the supporting documentation is provided.

Then it will be forwarded to the Department of Labor in Washington, DC for a final decision (if tentatively approved).
