JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ORGANIZATION: The contracting organization responsible for this action is the 120th Base
Contracting Office, 2800 Airport Ave B, Great Falls, MT 59404-5570.
II. DESCRIPTION OF ACTION: The contractual action is a Sole Source Firm-Fixed Price Contract to purchase the annual ScoutCare maintenance services for the Avtec console system.
III. DESCRIPTION OF SUPPLIES/SERVICES: The Avtec console system is to provide post warranty coverage service including Telephone Support (24x7 Emergency Support), Web Based Case Management, Standard Software
Upgrades and an Annual Maintenance Class in support of the government–owned Scout Console Position Equipment, manufactured by AVTEC, Inc.
IV. AUTHORITY: The statutory authority permitting other than full and open competition for this acquisition is 10
U.S.C. 2304(c) (1) and the Federal Acquisition Regulation Part 6.302-1.
V. APPLICABILITY OF AUTHORITY: The requested service is available only from one responsible source as the equipment and software is proprietary and Avtec develops and maintains the software for the system. It would cost the
Government an estimated $250,000.00 to replace all Scout Console (emergency dispatch system) equipment if the entire system, which is less than 4 years old, were to be replaced. The purchase of the Scout Console system was advertised in accordance with agency procedures and the resultant contract was determined to be fair and reasonable. The duplication of costs is not expected to be recovered through full and open competition.
VI. EFFORTS TO OBTAIN COMPETITION: The Technical Support Services is not available from other sources.
Based on fact finding with Avtec, Inc., they are the original software developer and as such are the only known source to possess full proprietary data rights for the Technical Support Program (TSP). It should be noted that the TSP is an incidental cost to the equipment already owned by the government and if purchased separately, the software upgrades costs are well in excess of the cost of the annual TSP. Avtec, Inc. does have authorized resellers of the equipment but the resellers are not authorized to provide the maintenance and software.
VII. FAIR AND REASONABLE COST: The Contracting Officer will determine the prices to be fair and reasonable following the procedures identified in FAR 13.106-3(a)(2).
VIII. MARKET SURVEY: A search via the World Wide Web was accomplished and did not reveal any vendors that could meet this requirement. After speaking with several vendors in the industry it was confirmed that Avtec, Inc. is the only company who can provide this service to the Government.
IX. OTHER FACTS: N/A
X. STEPS TO FOSTER COMPETITION: See Paragraph VI above.
XI. CONTRACTING OFFICER’S CERTIFICATION: The Contracting Officer’s signature on the Justification Review
