SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K

1. Agency/Contracting Activity: Mission Installation Contracting Command- White Sands Missile Range, NM.

2. Description of Action: FSS Software Maintenance

Nature: |_| New Requirement |X| Follow-On Requirement |_| Mod to Existing Purchase Order/Contract Number

Pricing: |X| Firm-Fixed Price |_| Time and Materials

Funds: |_| OMA |X| Other Funds:__RDT&E_______

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $ 144,266.00.

b. The Information Management Radio Spectrum Branch at White Sand Missile Range New Mexico has the requirement to provide software and equipment maintenance on the integrated Frequency Surveillance Systems (FSS) fixed and mobile assets here at WSMR. This equipment and software maintenance will encompass all fixed site and mobile units in the WSMR portfolio. The equipment and software maintenance shall include patches, repairs and upgrades to the FSS software and its associated frequency receivers and generators. This service is vital to the continued operation of WSMR’s legacy FSS system and only one vendor can provide the service. Its maintenance and upgrades requires knowledge of Structured Query Language (SQL) beyond that required to work in an engineering or operator position with the software.

4. Authority:

Action using Simplified Acquisition Procedures

|X| FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reason for Authority Cited: The current Frequency Surveillance System (FSS) has an integrated software package, SigMon. Maintenance of SigMon is only available from the SAT Corp. This software provides the operator interface and communicates the necessary outputs to all hardware (local and remote) to satisfy the mission requirements. The Frequency equipment must be integrated to work with the SigMon software and the computer systems.

Without this software and equipment maintenance the current FSS (SigMon) software will not work properly to support missions using the networked configuration. This would force personnel to support on-site only. By not being able to utilize the networked configuration, excessive amounts of overtime will be required and force IM to issue Data Support Limitations (DSL) on missions.

Procuring new software and equipment maintenance from another source will incur a cost of $15M to $20M not including replacing all frequency equipment that currently has the SigMon adaptors in place. Replacing the current integrated system will also take a minimum of 24 months to fully implement and the existing system will still need to be use to provide mission support or there will be no mission support.

6. Actions to Increase Competition: No other company is available to perform maintenance on the SigMon software and its integrated equipment. It is a proprietary service and software of the SAT Corporation. In the future as new technology becomes available and as currently owned equipment becomes obsolete the Government will look to other sources or suppliers of this service.

7. Market Research: This software was found to be proprietary to SAT Corp. A sole source synopsis was posted last year prior to the current contract’s renewal. There was no response from the FBO market community.

A Sources Sought was currently posted on FBO for the period of 18 December through 29 December 2014 with no results or inquires.

8. Procurement History:

Previous Purchase Orders(s) or Contract(s): |X| Yes |_| No

Purchase order or contract number: W9124Q-14-P-0004 Was action competed? |_| Yes |X| No If action was not competed, state the cited authority, summarize rationale:

FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. Supplies or services are available from only one source. No other type of supplies or services will satisfy agency requirements.

9. Additional information to support the justification: An email from SAT Corp confirming their proprietary status:

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which is included in the abbreviated J&A is accurate and complete to the best of my knowledge and belief.
