JUSTIFICATION REVIEW DOCUMENT

FAR PART 6 JUSTIFICATION AND APPROVAL FOR OTHER THAN

FULL AND OPEN COMPETITION

1. Contracting Activity: Mission and Installation Contracting Command (MICC) – Fort Hood-White Sands Missile Range (MICC-FH-WSMR) 3600 Darnall Loop, Fort Hood, Texas 76544-5025.

2. Description of Action: The information Management Directorate, White Sands Missile Range, (WSMR), NM is requesting a firm-fixed-price modification to extend contract W9124Q-14-C-0002 with Vista Science Corporation, 600 Montana Ave STE A, Las Cruces, NM 88001-4246. The Government projects award for 22 April 2019. FY 2019 NEC 2040 RDT&E fund will be used for this procurement.

This acquisition is for a six month extension of service to contract W9124Q-14-C-0002.

3. Description of Supplies/Services: The incumbent shall provide all management, tools, material, services, provide personnel with the appropriate levels of training, education, and experience necessary for telecommunication support services to include: telephone installation, moves, and disconnects;

operator services; switch technician support; work order processing; wireless communication services minor maintenance services as required;

and cleanup of fiber and Cat 5 communication wiring and position assignments in Commo closets.

Work under this PWS will support the mission of White Sands Missile Range, NM with highly reliable telecommunications support services. The contractor must operate and maintain all equipment and systems in accordance with (IAW) the original equipment manufacturers technical manuals and specifications, Department of Defense (DOD) and US Army policy and regulations, and applicable federal, state, and local regulations. The six month extension does not decrease or increase the scope of the current contract.

4. Authority Cited: The statutory authority permitting other than full and open competition is Title 10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement

5. Reason for Authority Cited: As described at FAR 6.302-2 (a)(2), “When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency ispermitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.”

a. Background: The current contract was an 8(a) direct award for a Base with four one year options and an evaluated option -8 to extend. FAR Clause 52.217-8 was exercised for a 6 month option that ends on 21 April 19. The current contract is vital for WSMR to continue Telephone services for government, contractors, and mission personnel. The current telephone contract is ending on 21 April 2019.

Control No: 2019-4

b. Alternatives:

1) In house government personnel. The government does not at this time have the personnel required to accomplish the scope of this contract and the current governmental functions required to keep the telephone services above a degradable level. This contractor uses 8 people to maintain all the required telephone functions, provide help desk support for 12,000 telephones on WSMR that includes, five tenant organizations, three Garrison directorates, and sixteen ATEC directorates. This is not a viable alternative.

2) Competitive Bridge. While ideal to promulgate maximum competition, a shorter term competitive contract is untenable. There is insufficient time to complete the development of requirements documents, solicit, award and phase-in prior to contract expiration of 31 MAY 2019. The lead-time to develop an acquisition package, publicize the solicitation for the required timeframe for non-commercial services, combined with the evaluation of multiple proposals, document reviews and source selection decision reviews far exceeds the time the Government has to award a new contract without a break in service.

3) Suspension of Operations. As noted under the option of providing in-house resources, the suspension of operations is equally untenable. Without contractor support, WSMR is unable to maintain the telephone communication support services after the current contract expires, 21 April 2019. Contractor support is critical to WSMR’s ability to support testing and evaluation of developmental and operational weapons systems. The unique tri-service installation is dedicated to the Test and Evaluation (T&E) process, research, and the assessment of military weapon systems and commercial products through testing and training. As the largest open-air land test range in the DOD, WSMR is home to capabilities such as state-of-the-art environmental testing chambers, an extensive data collection instrumentation suite, advanced data processing, network integration, and modeling & simulation facilities. This places WSMR in a unique position to address present and future challenges facing the war fighter and to readily support the Global WAR on Terrorism (GWOT). Without telephone communication support for these critical elements, failure to have this method of communication could severely curtail test missions and would without a doubt could cause mission failures.

4) Extend the Current Contract on a Non-Competitive Basis. Negotiating an interim extension with the incumbent is the only viable option to provide continuity of operations and support without jeopardizing WSMR’s mission. Award to any other source, would result in unacceptable delays in fulfilling the agency’s requirements and would not be in the best interest of the Government.

6. Efforts to Obtain Competition: IAW PGI 206.302-1(d) a Request for Information (RFI) to inform potential offers of this contract action was posted on FedBizzOps for a period of 15 days; 8 to 22 Mar 2019.

7. Actions to Increase Competition: As indicated above, this is an interim action to allow continued performance with the incumbent contractor on a sole-source basis for continuity of service. The Requiring Activity is proceeding with the procurement of an ISOSS follow-on contract that will be a five-year competitive, Firm-Fixed-Price, Woman-Owned Small Business set-aside award. The anticipated award date is 30 June 2019. There will be a Phase-In with full performance commencing 1 Aug 2019.

8. Market Research: Due to the urgency, no additional market research was conducted for this action.

9. Interested Sources: There were no responses from RFI notice posted 8 March 2019.
