FDO/ MICC Control No. 15-0006
JUSTIFICATION DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
Dining Facility Attendants for Fort Stewart and Hunter Army Airfield
1. CONTRACTING AGENCY: MICC-Fort Stewart
2. DESCRIPTION OF ACTION:
This action is requesting approval to issue a two (2) month purchase order with the potential of an additional month depending on circumstances, to extend the services currently being performed on an existing Firm-Fixed Price, single award, purchase order, W9124M-15-P-0002. The two (2) month purchase order has an estimated value of approximately $500,000.00. The current purchase order extended the now expired Dining Facility Attendants fixed priced requirements contract, W911SE-08- D-0010.
This purchase order is required to maintain continuity of services and will be used to allow the minimum amount of time to complete evaluations of the proposals submitted in response to solicitation W9124M-14-R-0001 and award the follow on contract with sufficient time for successful Offeror to begin providing dining facility attendant services.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The work associated with this requirement shall provide all labor, personnel, equipment, materials, supplies, supervision, and other items and services necessary to provide Dining Facility Attendants (DFA) Service when applicable on Fort Stewart and Hunter Army Airfield HAAF), Georgia in accordance with the Army Food Service Program, applicable regulations and the Performance Work Statement (PWS).
This purchase would extend the current services, maintaining the status quo of services currently provided, two (2) months through 28 February 2015. This is the time anticipated to complete the procurement process for the on-going competitive follow-on requirement. The overall scope of the work to be provided will remain unchanged during this extension with the exception of any reductions in service required by new policy.
Fort Stewart’s mission is to serve as a force projection platform for the 3rd Infantry Division, tenant units, and associated units at Hunter Army Airfield (HAAF). The Logistics Readiness Center (LRC) has the mission to provide maintenance, supply and transportation services to the 3rd Infantry Division, tenant units, and DOD activities within their geographical area of responsibility. The LRC is required to maintain dining facilities across the installations on a permanent and temporary basis to support an array of units and agencies. This requirement stems from that need. The dining facility operations are a basic and vital necessity to support the constant flow of units’ training across the installation. The contractor services provided in this contract supports the readiness of the installation and provides the necessary augmentation to staff these facilities to ensure the proper level of operation and supports the overall Army readiness by increasing the quality of life for Soldiers and families.
Currently, Fort Stewart consistently operates an average of five (5) Dining Facilities, monthly, as a part of this contract. This includes one (1) being operated at HAAF.
These services are crucial to the mission of the 3rd Infantry Division and play a critical role in the success of the mission.
4. AUTHORITY CITED:
This action is authorized under the provisions of 41 U.S.C. 1901 and section 4202 of the Clinger-Cohen Act of 1996 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.5, Test Program for Certain Commercial Items. Under the test program, contracting officers may use any simplified acquisition procedure in FAR Part 13, subject to any specific dollar limitation applicable to the particular procedure for the acquisition of commercial items in amounts that do not exceed $6.5 million.
In accordance with FAR 13.106-1(b)(1)(i), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
5. REASON FOR AUTHORITY CITED:
In the interest of cost savings and avoiding unacceptable delays, this follow-on requirement is available from the incumbent contractor for services described above and that the original contract award was completed using adequate competition. As the incumbent contractor, Wolf Management Services is currently in place and performing in an acceptable manner.
This is a follow-on contract as the incumbent has been providing the same services at this installation since the period of performance began on the current contract, 1 February 2008. Previously, the “Option to Extend Services” clause was used to extend the contract. Bridge purchase orders have been issued to continue services.
The efforts to complete the follow on, competed requirement have been met with several delays. Requirement re-writes, use of borrowed military manpower, uncertainties created by sequestration, ever-changing nature of dining facility operations, and all contributed to delays in the acquisition process to complete the competitive dining facilities requirement.
Trying to obtain a replacement contractor to cover this period would incur operational challenges. Specifically, this requirement is under the purview of AR 30- 22, Army Food Program and as such has many requirements for health and safety.
Based on the results of Market Research, other contractors would be capable of providing similar services. However, the time available to compete the short-term extension period and the time necessary for a transition period, make it unrealistic to solicit services and make an award. The result would be substantial costs associated with the work that would not be recovered through competition for this short performance period. This effort has already taken place and been paid for by the Government in the performance of the current contract and would not be repeated as a result of this extension.
It is recommended that a two (2) month purchase order at the current prices be approved and executed as this is categorized as a follow-on contract and mission failure would result if any other procurement method is used. The incumbent contractor, Wolf Management Services, continues to perform in an acceptable manner and the overall scope of the requirement remains unchanged at the moment. Substantial delays have occurred with the re-procurement; however, delaying the services until the follow-on procurement occurs would mean mission failure and would be unacceptable.
6. EFFORTS TO OBTAIN COMPETITION:
A sources sought and notice announcing the intent to award this extension on a sole source basis was posted to Army Single Facing Interface (ASFI) and FedBizOpps (FBO) on 24 October 2014 and closed on 29 October 2014.
7. ACTIONS TO INCREASE COMPETITION:
The solicitation posted for the follow on requirement has closed.
8. MARKET RESEARCH:
Market research was conducted using previous acquisition databases, the SAM database, the installation contracting database, the Small Business Administration (SBA) website, and the results of a sources sought notice posted to FBO. Based on the market research performed, there is a reasonable expectation that two or more offers will be received from Service Disabled Veteran Small Business concerns.
Multiple offers were received for the large follow on requirement for which award is pending. However, it would not be cost efficient for the Government to pursue a new contractor at this juncture in the procurement cycle.
9. INTERESTED SOURCES:
Two responses were received to the sources sought that closed 29 October 2014.
The interested parties provided capabilities statements, but did not indicated whether they could mobilize and be ready to provide the services by 1 November 2014. In addition, a notice was posted on FBO detailing the Government’s intent to proceed with a sole source for the period of 1 January 2015 through 28 February 2015. No responses have been received to date.
10. TECHNICAL/REQUIREMENTS CERTIFICATION: I certify that the supporting data under my cognizance included in this Justification are accurate and complete to the best of my knowledge and belief.
11. I have reviewed this justification and have no Small Business concerns.
Local Small Business Specialist (if value exceeds $150K)
Legal counsel reviewed the J&A and found it to be legally sufficient.
12. FAIR AND REASONABLE COST DETERMINATION: It is determined that the anticipated price for this contract action will be fair and reasonable. The techniques identified at FAR 15.404-1(b)(2)(v) were used to ensure award will be at fair and reasonable prices. The Contracting Officer used a comparison of industry cost for similar work. The Independent Government Cost Estimate (IGCE) will primarily be an analysis of the contractor’s proposed cost. Additionally, the techniques identified at FAR 15.404-1(b)(2)(ii) were used to further ensure award will be at fair and reasonable prices. Certified cost and pricing data will not be obtained.
13. Contracting Officer’s Approval: I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
