FDO/ MICC Control No. 13-0056

SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K

1. Agency/Contracting Activity: Mission Installation Contracting Command- Ft. Stewart

2. Description of Action:

Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds:_________

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $49,626.00

b. Describe the Acquisition: The contractor provides all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to produce programming for Marne TV. The contractor provides services as a Producer, Director, Writer, Editor, Broadcaster, Cameraman, Grip, Sound Tech, Engineer, Graphics Editor, and News Anchor, to create television programming with a military emphasis. The programming must be sustainable with a focus on continued improvement.

The contract is essential to mission of the 3rd Infantry Division Public Affairs Office.

This requirement translates the United States Army Garrison Fort Stewart and Hunter Army Airfield, and the 3rd Infantry Division command messages and objectives into finished television programs that effectively communicate command information throughout Fort Stewart, Hunter Army Airfield, and the local communities.

This J&A is prepared to allow for a six (6) month extension of the current contract to allow for sufficient time to evaluate the budget situation and need for the requirement beyond the six (6) month period.

4. Authority:

Action using Simplified Acquisition Procedures

FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization).

FDO/ MICC Control No. 13-0056

5. Reason for Authority Cited: Current funding constraints with the sequestration may have a significant impact on this requirement, and sufficient time is required to consider how the constraints will affect the requirements for Marne Television services. The future of the services provided within this contracted requirement are in question, and a six (6) month extension will allow enough time to determine the future and define any changes that may be required due to any reduced funding.

The current contract expires on 23 September 2013, and sufficient time does not exist to solicit another source. The current Contractor is in place and satisfactorily providing these essential services. It is unlikely that another source could seamlessly step in for the relative short period of performance for this action and provide the services for which this modification is being requested at the current pricing levels. Award to any other source would result in unacceptable delays, non-recovery of procurement costs, and negatively impact the ability of the Fort Stewart Public Affairs Office to provide Marne TV and the information transmitted in the broadcasts.

This would be an unacceptable burden on the Soldiers, Families, and the community depending on these services.

Competing the short term extension would not be cost effective due to the short period of performance required. The current contract was competed less than 12 months ago; therefore, the pricing is recent and was determined fair and reasonable through competition. The contract will be extended at the current contract pricing.

6. Actions to Increase Competition: A sources sought was posted to Army Single Facing Interface (ASFI) and FedBizOpps (FBO) from 18 September 2013 through 20 September 2013.

Two responses were received stating they could provide the required services for the follow-on requirement. In addition, any future requirements for Marne Television services will be competed, and the results of the sources sought will be used to determine the correct set-asides for competition.

7. Market Research: Market research was conduct during the original procurement of this contract and is currently underway for the re-compete. A sources sought was posted to ASFI and FBO. Responses were provided from several sources, stating they could provide the services requested. However, it is not practical or feasible to solicit and negotiate a follow-on or interim contract due to the time constraints and fiscal uncertainty of the services.

8. Procurement History:

Previous Purchase Orders(s) or Contract(s): Yes No

Purchase order or contract number: W9124M-12-P-0414 Was action competed? Yes No If action was not competed, state the cited authority, summarize rationale: We would lose a key part of the commander’s command information program.
