Department of the Army Justification for an Exception to Fair Opportunity - Brand Name Order under CHESS Multiple Award Schedule

Contracting Activity: Requiring Activity- MICC USAR DOC WEST- Seaside Ca. 93955. Procuring Office- MICC Fort Sill, OK.

Description of Contract Action: Approval is sought to limit competition to those ID/IQ holders under the Computer Hardware, Enterprise Software, and Solutions (CHESS) hardware contract vehicle (ITES-2H) that can provide Liquidware Labs, VDI Essentials Flex-IO Bundle-Upgrade from Stratusphere UX Equipment. Fiscal Year 2015 (OMA) funding will be used to procure this requirement. A firm fixed price delivery order will be issued as a result of this LSJ and delivery will be required 30 days after receipt of order. The estimated value of the proposed action is____________.

This requirement is to acquire Liquidware Labs, VDI Essentials Flex-IO Bundle-Upgrade from Stratusphere UX Equipment to support DLIFLC Presidio of Monterey Ca.

Authority Cited: 10 U.S.C. 2304c (b) (2) as implemented in FAR 16.505(b) (2) (i) (B) and DFARS 216.505-70(b) (2) and FAR 11.105. Section 803 of the National Defense Authorization Act for Fiscal Year 2002 (Pub. L. 107-107), DFARs 216.505-70(b) and 8.405-6(b) (1). The supplies or services to be ordered are unique or highly specialized by brand name. However, more than one vendor under the ITES-2H contract is capable of providing the supplies required at the level of quality required. Thus, competition will be restricted to vendors with an ITES-2H contract that can quote Liquidware Labs products.

Rationale for Limiting Sources:

Background: DLIFLC has a deployment of the Virtual Desktop Infrastructure in support of 6000 student desktops. With this testing we have evaluated performance, interviewed customers and compared the market costing provided by CHESS Vendors.

Justification: Liquidware Labs software is currently being utilized in the DLIFLC Virtual Environment, and this is an enhancement to the current capabilities that were found to provide the necessary level of performance, ease of management and best value cost wise from the extensive POC conducted by the DLIFLC. The same type of servers have been purchased by DLIFLC, Therefore it is in the best interest of the government that we go forward with the procurement of this product to support the DLIFLC needs for the VMware Datacenter project. Additional time to conduct further capability testing with other products would be cost prohibited and with the time and availability of funds will not be possible at this time Liquidware Labs is an approved item the UCAPL list. The USG can achieve effective competition for this requirement through CHESS.

Impact: The impact of not procuring the hardware components of this requirement is that the DLIFLC will not be able to effectively deploy the DA and DOD mandated migration to Virtual Desktop Environments for users.

Market Research: Market research was conducted by Kevin Brink.

Liquidware Labs products are commercially available and may be purchased under numerous Government contract vehicles such as: CHESS ITES-2H, NASA SEWP contracts, DISA/DITCO contracts, and GSA. CHESS ITES-2H will be utilized for this procurement IAW AR 25-1. CHESS has multiple vendors that can supply Liquidware Labs` and effective competition can be achieved through CHESS.

Actions to Increase Competition: US Army PEO EIS, PM I3MP will periodically review DISA’s approved brand name specific products list in conjunction with the technical requirements and considers other products as viable candidates for the next generation procurement of hardware. In accordance with AFAR 5139.101-S90, the Army is required to use CHESS to procure commercial IT hardware and software and is the preferred source for services, regardless of dollar value. This procurement will be competed among all CHESS contract holders capable of fulfilling the brand name requirement.

Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. IAW with FAR 15.403-1 (c) (1) (i) adequate price competition will be obtained from two or more responsible offers. Price reasonableness will be determined from competition, comparison to available commercial price catalogs, and comparison with the certified ICGE. IAW with FAR 15.403-1

(c) (3) certified cost or pricing data will not be required as this is a commercial item.

Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief, and that the anticipated cost to the Government will be fair and reasonable. After reviewing the requirement, and the Office of Management and Budget's 1 June 2014 letter, I hereby certify to the best of my knowledge and belief that there are no alternatives available other than the use of an order limiting competition by brand name to fulfill this requirement.

Approval: Based on the foregoing justification, I hereby approve the procurement of provide Liquidware Labs, VDI Essentials Flex-IO Bundle-Upgrade from Stratusphere UX Equipment, under CHESS on a limited source basis pursuant to the authority of Section 803 of the National Defense Authorization Act for Fiscal Year 2002 (Pub. L. 107-107), subject to availability of funds, and provided that the services and/or supplies herein described have otherwise been authorized for acquisition.
