About this file
This document is a Justification and Approval (J&A) for a sole source contract under FAR 13.5 Simplified Procedures for Certain Commercial Items. The U.S. Army Mission and Installation Contracting Command (MICC) - Fort Sam Houston is seeking a firm-fixed-price, non-personal services contract to provide a network of Exceptional Family Member Program (EFMP) Respite Care Providers (RCPs) who will offer temporary rest periods for family members responsible for the regular care of persons with severe disabilities or diagnoses. The current contract expires on 28 September 2024, and this 6-month bridge contract, valued at $2,887,038, will provide continued services while the government procures a new long-term follow-on contract, with an anticipated solicitation release in November 2024 and award in March 2025. This requirement supports the Army's EFMP program and the Department of Defense's mandate to provide respite care services to eligible service members and their families.

The Government projects award in September 2024 and fiscal year 2024, Operations and Maintenance, Army (OMA) funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The IMCOM, G-9, Army Community Service (ACS), has an ongoing mission requirement to provide temporary rest periods for Family members responsible for regular care of persons with severe disabilities or diagnoses. In accordance with DoDI 1342.22, Military Family Readiness, EFMP Respite Care (RC) may be provided as part of the overall Exceptional Family Member Program. This requirement will provide a network of Exceptional Family Member Program (EFMP) Respite Care Providers (RCPs) who will provide Respite Care Services, including temporary rest periods for Family members responsible for regular care of persons with disabilities. The current contract, W9124J-19-C-0031, expires on 28 September 2024 and there is a need for continuation of services with the incumbent while the Government continues work on procuring a new, long-term follow-on contract.

5. Reason for Authority Cited:
a. Background. There are currently 56,000 family members enrolled in the Armys EFMP. Approximately 350 (.625%) of the enrolled individuals qualify for RC Services.
These Exceptional Family Members (EFMs) have special needs that require special care considerations. Finding credentialed providers and paying for specialized services can present significant challenges to military families. Consequently, there is a need to maintain an Army-wide special needs RC program for family members enrolled in the EFMP. In addition, the DoD Office of Special Needs (OSN) requires the Services to provide Respite Care support to military members assigned to their installations who meet the prescribed eligibility criteria.
In accordance with the National Defense Authorization Act (NDAA) 2021 Section 582 (b)(5) and Department of Defense Instruction 1315.19, Exceptional family Member Program, all Services are to provide Respite Care support to eligible Soldiers and Family members. Respite Care is a short term, temporary care designed to provide relief to the Solider and Family member. It allows the Solider to take a break from their caregiving responsibilities, while ensuring the individual needing care receives the necessary support and assistance. Respite Care Support is a Congressionally mandated service for active-duty military and their Family members with special medical conditions who are enrolled in the EFMP and who meet the medical eligibility criteria for services.
Respite Care enhances mental health support and provides clarity to decision making in their military role. Caregiving can lead to stress and burnout. Providing care for special needs family members creates additional stressors that could potentially lead to family violence, child abuse, and or neglect. Respite Care offers the Soldiers/caregivers, opportunities to create work life balance and improves mental health, ultimately, benefiting the service. Access to Respite Care helps build resilience in military personnel and their families, ensuring they are better prepared to handle the challenges of military life. Department of the Army has provided Respite Care Support services to Soldiers and Families for over fifteen years without a break in service.
There is a continuing requirement to provide a network of EFMP RCPs who will provide Respite Care Services, including temporary rest periods for Family members responsible for regular care of persons with disabilities. The requirements documentation for the follow-on contract is currently undergoing extensive revisions, that then need reviews and approvals of the revised documents as well as the completion of market research in support of this requirement. This has delayed completion of a complete set of requirements documentation for the contracting office to use in processing the follow-on requirement. An interim 6-month bridge contract will provide sufficient time for completion of the requirements documentation, conduct of sufficient market research, and competition of a substantive performance-based service contract to support Army Soldiers and their dependents. Presently, the release of the solicitation is slated for November 2024 and award is projected for March 2025.
b. Alternatives. Although there are multiple contractors with the potential to provide these services, an opportunity to compete this Bridge Action does not exist due to the need to provide continuation of services. If this bridge action were competed, or offered to an alternate other than the incumbent, there would be a break in service due to the amount of time it would take a new contractor to hire personnel, emplace personnel, and reach a point of full mission capability. The nature of this requirement precludes a break in service for any period and the requiring activity and contracting office will mutually address this timeline with the follow-on requirement by implementing a minimum of a 30-day phase in/phase out period, should an offeror other than the incumbent win the follow-on award. These services are also unable to be met with in-house Government personnel. Unfortunately, due to the global scope of this requirement, there do not currently exist, enough qualified Government employees to provide the required services
