Contract W9124J-20-C-0012 was executed as a sole source award under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Justification and Approval control number MICC 2020-80). The Government’s projected award date is 28 January 2021. (2) Award a competitive contract: A re-compete effort is currently underway to award a new competitive contract (Solicitation W9124J-20-R-0015), however there is not sufficient time to complete the process by 27 January 2021. The inclusion of six additional months under the current bridge contract will provide the necessary time to award the follow-on contract utilizing best value trade-off source selection procedures.

(3) Perform with Government staff: There is not a sufficient amount of current Government personnel available on staff to provide the necessary services.

e. Impact if not approved: Failure to implement a modification to extend the current term of the bridge contract with Indtai, Inc., will result in a break in these essential educational services and would impact current and future career opportunities for Soldiers, effect Army readiness, and negatively affect leader development.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201.

a. Effective Competition: There is adequate competition for this requirement as evidenced by the data included in the market research report for solicitation W9124J- 20-R-0015 (ACES follow-on contract). Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: As this requirement is currently a WOSB set aside, a subcontracting plan is not required in accordance with FAR 19.702(b)(1).

7. Actions to Increase Competition: There is adequate competition for this requirement as evidenced by the data included in the market research report for solicitation W9124J-20-R-0015 for the ACES follow-on contract.

8. Market Research: Market research was initially conducted in support of Solicitation W9124J-20-R-0015 on 4 December 2019, and was re-validated on 7 May 2020. This market research is considered recent and valid.
