About this file
This document is a Limited Source Justification for the purchase and installation of electric vehicle charging stations at Fort Novosel, Alabama. The U.S. Army Mission and Installation Contracting Command (MICC)-Fort Novosel is seeking a Firm-Fixed-Price Task Order under the General Services Administration (GSA) Federal Supply Schedule (FSS) Program with Alabama Power Company (APC) to provide turnkey installation services, including labor, parts, equipment, materials, and software, for 24 charging station locations. The total value of the contract is $1,997,247.00. The justification cites FAR 8.405-6(a)(1)(i)(B), stating that APC is the only vendor capable of providing the required services and maintaining standardization with the previously installed charging stations. The procurement will be awarded against GSA contract GS00P15BSD1133, with a period of performance from September 2024 to September 2025. An acquisition plan is not required for this procurement.

Limited Source Justification FAR Part 8
1. Contracting Activity: U.S. Army Mission and Installation Contracting Command (MICC)-Fort Novosel, 453 Novosel Street, Bldg. 5700, Rm 380, Fort Novosel, AL 36362
2. Description of Action: The Directorate of Public Works requests a Firm-Fixed-Price Task Order under the General Services Administration (GSA) Federal Supply Schedule (FSS) Program with Alabama Power Company (APC). The Government will execute this action against FSS contract GS00P15BSD1133. The award is projected for September 2024 and Fiscal Year 2024, Operations and Maintenance, Army funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The contractor will provide turnkey installation including all labor, parts, equipment, materials, and software to install and activate vehicle charging stations at 24 locations on Fort Novosel, Alabama and surrounding Airfields and Stagefields. The contractor will also provide a 5-year warranty on the new charging stations and provide a new 5-year warranty on the existing Chargepoint chargers.
In fiscal year 2022, a Limited Sole Source Justification was approved using the authority of (FAR 8.405-6(a)(1)(i)(B)), to award task order W9124G22F0044 to APC to install Level 2 Vehicle Chargers on the installation.
Period of Performance: 30 September 2024 to 29 September 2025
Total Value: $1,997,247.00
4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (Title 41 U.S.C. 251, et. Seq) and Title 40 U.S.C. 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by the following: FAR 8.405-6(a)(1)(i)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
5. Reason for Authority Cited:
a. Alabama Power Company (APC) is not the only vendor who could install the stations nationwide, but per the Area-wide contract, APC is the only vendor capable in the Fort Novosel service area to provide utility service and would have to provide the electrical service and connectivity if another vendor provided the charging stations;
thereby requiring involvement from multiple vendors. In accordance with FAR 41.204, GSA Area-Wide Contracts are negotiated with utility service suppliers for the provision of service within the supplier's franchise territory or service area. This will also maintain standardization of the new charging stations on the installation with those installed two years ago by APC. This standardization of charging stations allows using the same ChargePoint account, which includes all chargers covered by the same 5-year warranty.
This standardization will help the installation more effectively manage the charging stations for usage, maintenance, and billing purposes.
By using the GSA Area-Wide Contract with the utility service supplier in Alabama, the Government can take advantage of the administrative time and monetary savings inherent through the use of contracting vehicles that have already been awarded. The Contracting Officer conferred with the Directorate of Public Works and has determined this requirement is within scope of the GSA Area-Wide Contract No. GS-00P-15-BSD- 1133 between the United States of America and Southern Company Services, INC., as designated agent for Alabama Power Company.
b. Alternatives: There is no evidence that another vendor showed any interest in the procurement. The previous electrical charging stations were purchased and installed through APC, and APC is providing Fort Novosel with the required services for these electrical charging stations as per their GSA Area-Wide Contract.
c. Impact if Justification not approved: The electrical infrastructure to support electric vehicle charging stations has been awarded and is currently under construction by Alabama Power through our privatization contract. By not awarding the chargers under the Area Wide contract, Fort Novosel and the mission will be negatively impacted considerably. First, the mission will suffer considering the installation has received 50 electric fleet vehicles, with more on order, and as of right now no reliable source of charging said vehicles. Completed critical maintenance tasks could suffer, which will adversely impact operations and the training of the warfighters. DPW is already receiving multiple ICE comments regarding both the inadequate number of available charging stations and the poor reliability of the BEAM charging stations we currently have.
Secondly, as mentioned above, the infrastructure portion to support these charging stations has been awarded and is already under construction by Alabama Power.
Starting the bid process over will take a considerable amount of time and will ultimately require coordination with Alabama Power Company, our privatized utility partner, as it pertains to their system. The funding available for these charging stations are FY24 appropriations and are subject to being de-obligated, leaving the project half completed and unusable.
6. Actions to Increase Competition: In accordance with FAR 41.204, GSA Area Wide Contracts are negotiated with utility services suppliers for the provision of service within the suppliers franchise territory or service area.
7. Market Research: Market Research was done for this requirement through a Google Search, and a request for information (RFI) posted on GSA. The RFI was posted on GSA on 7 August 2024 with a closing date of 13 August 2024. Only one
Contractor responded with their capability statement but did not specify if they are able to install and provide the warranty services requested. They also do not have the NAICS of 221122.
There was also a Dynamic Small Business Search (DSBS) quick search for NAICS 221122 which resulted in six (6) SDVOSBs and one (1) HUBZone company. There was also a DSBS search which resulted in 29 companies with that NAICS. Of those 29, none of their Capabilities Narrative stated anything referencing electric vehicle charging stations.
This requirement will be accomplished using a GSA certified Vendor/Contractor. It will be awarded to Alabama Power Company.
