ADDENDUM TO FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
The Government will award a contract resulting from this solicitation to the responsible offeror submitting the Lowest Priced, Technically Acceptable offer that satisfies all terms and conditions of this solicitation.
Award will be made to the responsible Offeror submitting the Lowest Price Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
(b) The following ratings will be used in evaluating all non-price factors and subfactors:
Acceptable Proposal clearly meets the minimum requirements of the solicitation Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation
The following ratings will be used in evaluating Past Performance:
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (See note below).
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/ unacceptability, “unknown” shall be considered “acceptable.
FACTOR 1 – Technical Capability: This factor evaluates the offeror’s technical capability and qualifications to perform the requirements of this contract.
Subfactor 1: Prime Contractor Qualification: The offeror shall be evaluated for submitting evidence or descriptive literature that the contractor is authorized dealer to perform maintenance on SEM Shredder Model No.
23/5 and DS2424.
FACTOR 2 - Price: Proposed price will be evaluated in accordance with FAR 13.106-2 – Evluation of Quotation or Offers. Price analysis will be conducted for each proposal to ensure completeness, realism, and reasonableness.
Pricing shall be included for all CLINs. Price analysis will be performed to determine the total evaluated price to support the selection of the lowest priced technically acceptable offeror.
(1) Completeness. The offeror shall complete the pricing information for all CLINs/Sub-CLINs identified for base period plus three (3) options (four (4) years). Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.
(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offerors.
(3) Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, complete, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period of four (4) years from the date of award. Price must include all CLINs and
SUBCLINs as listed on the Price Schedule. The Government intends to evaluate offers and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
FACTOR 3 - Past Performance: Past performance will be evaluated for the responsibility determination IAW FAR 9.104. This factor evaluates the offeror’s past performance within last five (5) years performing maintenance service on shredder from the closing date of the solicitation.
The offeror shall provide a list of at least two (2) current or previous customers/clients who the Government can contact for past performance information on the offeror. The following information must be included for each client reference:
• Title of the contract/project
• A brief description of work completed
• Amount of contract
• Length of contract/project (year/month/date – year/month/date
• Complete name of point of contact at client organization
Past performance will be evaluated in the following manner:
(a) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.
(b) Reference will be contacted by phone to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(c) The Government reserves the right to obtain past performance information from any reasonable source available, including Government databases in order to evaluate past performance.
