AMC-LEVEL PROTEST PROGRAM
If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters (HQ), Army Materiel Command
(AMC). The HQ AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government
Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the HQ AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below. All other agency-level protests should be sent to the contracting officer for resolution.
A Protest to HQ AMC shall be filed either by regular mail, email or fax at:
Headquarters U.S. Army Materiel Command
Office of Command Counsel- Deputy Command Counsel
4400 Martin Road
Rm: A6SE040.001
Redstone Arsenal, AL 35898-5000
Fax: (256) 450-8840 or e-mail: usarmy.redstone.usamc.mbx.protests@mail.mil
The AMC-Level Protest procedures are found at: https://www.amc.army.mil/Connect/Legal-Resources/
If internet access is not available, contact the contracting officer or HQ, AMC to obtain the HQ AMC-Level Protest
Procedures.
AMENDMENT TO FAR 52.212-1 (c) INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers.
QUANTITIES
Quantities are estimated only, based on the best information currently available to the government. Payment will be made for actual quantities received and accepted.
CHANGES
Changes in or deviation from the scope of work shall not be effected without a written modification executed by the contracting officer. Only the contracting officer may approve any changes.
INVOICES
On a monthly basis, the contractor shall submit a detailed invoice to the Government Point Of Contact (POC) no later than the third work day of the month following the month in which services were performed. The contractor shall obtain signature of the Government POC and shall make a copy of each for his/her records. The contractor's monthly invoice shall indicate the total number of meals provided for each service code for pre (applicant) and for each service code for post (shipper).
PAYMENT
The government will pay the contractor monthly for services performed during the preceding month, upon submission of proper invoices, the prices stipulated in this contract for actual services received and accepted, less any deductions provided in the contract.
QUOTE FORMAT AND CONTENT
The offeror shall and government will:
1. Ensure all required documents are included with the quote:
a) Standard Form 1449, duly executed by an official authorized to bind the offeror;
b) The unit prices in the price schedule (NOTE: failure to quote on all items will render the quote non-compliant and the quote may not be considered. Prices in the quote shall be completed using the CLIN (bid) schedule in the RFQ;
c) One copy of any required subcontractor agreement, fully executed by both the prime contractor and the subcontractor (if any portion of the effort is to be subcontracted); and
d) One legible copy of the state or local government health inspection report for the proposed food service preparation facility, if required by state or local regulations. The offeror shall submit a current health inspection report with its proposal submission. The facility must have received a score of “A” or “B”; 85 or above” or “pass”, if pass/fail inspection system is used. The score must be clearly annotated on the report. Failure to provide an acceptable health inspection report at proposal submission will render the quote non-compliant.
2. Failure to submit all required documents will render the offeror's quote non-compliant and the quote will not be considered;
3. Evaluate price of those offers found to have an acceptable performance record. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the base period.
Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half
(represents six month period) of the offeror's final option period price to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option and 1/2 of the 4th option. Offerors are not required to enter a price for the six-month period.
4. In the event an offeror is found to be unacceptable in past performance pursuant to FAR 19.6 “Certificates of
Competency and Determinations of Responsibility”, the Contracting Officer may seek a Certificate of
Competency (COC) prior to making an award decision.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
5. Sanitarily Approved Sources: The San Antonio Military Entrance Processing Station (MEPS) is located on a military installation. In accordance with AR 40-657, contractors delivering and serving food on a military installation shall pass a Veterinary Service Food Protection Audit to be a sanitarily approved source. The successful offeror shall furnish products from an approved food preparation facility. The approval shall be obtained prior to contract award. Food establishments located on the military installation are inspected locally by veterinary inspection personnel. The government (MICC - Fort Knox) will notify the apparent successful offeror to coordinate a request to schedule an audit or obtain local approval of the food preparation facility. Failure to obtain approval will render the apparent successful offeror ineligible for award.
BASIS OF AWARD
The government will award a single contract to the responsible offeror with acceptable past performance who proposed the lowest evaluated price.
