4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. The United States Army Recruiting Command has been using the services provided by TAIS Performance Systems Inc. for over a decade. TAIS is the owner of The Attentional and Interpersonal Style (TAIS) Inventory, a 144-item questionnaire assessing concentration and communication skills, and various related performance concepts used to improve those skills. TAIS is utilized around the world by professional service providers to identify, develop, and train individuals, teams and organizations who must consistently perform at high levels under challenging conditions
b. TAIS has authorized and fully supports Winning Mind, LLC to be the exclusive and sole distributor of TAIS to Military and Emergency Services organizations. While TAIS cannot guarantee that no other entities are utilizing and selling TAIS, no other organization except for Winning Mind has the contracted and exclusive rights to do so.
The Recruiting Command has used the TAIS surveys exclusively, and has utilized their training services in the past to train Soldiers, General Schedule (GS) employees and Contractor’s on their concentration and communication skills, and various related performance concepts used to improve those skills.
c. Awarding this contract to a vendor other than Winning Mind would be detrimental to the continued and future success of the US Army Recruiting Command’s recruiting efforts. Winning Mind has the exclusive rights to the TAIS surveys that the command has been using for over a decade that focuses on a recruiter’s strengths and potential weaknesses when placed in stressful situations. Without utilizing this particular training program there is an increased chance some Soldiers and civilians would start taking shortcuts in the recruiting process therefore putting themselves and the applicants at risk. Additionally there is the possibility of an increase in suicides and domestic violence events if individuals find themselves succumbing to the high stress and daily rejection when attempting to recruit today’s warfighters.
