(5) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(6) The Government intends to evaluate offer and award a contract without discussions with offeror.
Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(7) Availability of requirements documents cited in the solicitation and in the attached performance work statement.
Section M - Evaluation Factors for Award
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability; (ii) Price; and (iii) Past Performance
2. This best value source selection Lowest Priced Technically Acceptable (LPTA) methodology will be conducted in accordance with the policies and procedures under the Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, in conjunction with FAR Subpart 13.5, Simplified Procedures for Certain commercial Items, and FAR 19, Small Business Program, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror who is deemed responsible in accordance with the FAR, whose proposal conforms to the solicitation requirement (to include all stated terms, conditions, and all other information required by the solicitation), is determined to be fair and reasonable, and whose proposal, judged by an overall assessment of the evaluation criteria and other consideration specified in this solicitation, represents the LPTA offer.
3. Award for All of the Work. The Government intends to award one contract as a result of this solicitation. Offers received for less than the stated number of items listed in the Bid Schedule will be considered ineligible for award.
The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer if the lowest offer is rated unacceptable; and waive informalities and minor irregularities in offers received. After responses have been received, MICC– Fort Jackson may request clarifications.
EVALUATION FACTORS:
Evaluation criteria consist of the following factors and sub-factors. The proposals will be evaluated under three (3) evaluation factors:
Factor I - Technical Capability Factor II – Price Factor III - Past Performance
Factor I: Technical Capability
1. The Government’s technical evaluation team will evaluate proposals to determine each offeror’s technical capability. The proposal must demonstrate a practical/functional approach that meets the requirements of the PWS.
2. Offerors level of understanding and detail will be evaluated to ensure an in-depth understanding of the contract requirements.
3. The Offeror’s lines of communication, management control system, and scheduling approach will be evaluated to determine if they represent a sound, comprehensive and feasible approach.
