JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN CO:MPETITION
Contracting Activity: U.S. Army Contracting Command
I
2. Description of Action:
l
Aberdeen Proving Ground, Huachuca Division DOC Operations Branch
CCAP-CCH-D
600 Augur Avenue, Building 22208 Fort Huachuca, Arizona 85613-7070
I a. The proposed action is for the award of a Cost-Plus-Fixed-Fee bridge contract for the r6, lti-functional base operations support services for the A.tmy Sustainment Command, U.S.
t~Y Garrison and assigned/attached units and activities at Fort Huachuca, Arizona. These ~e!1Vices are essential for the Logistics Readiness Center (LRC) to meet mission requirements. The ~ebod of Performance will be for six months (1 November 2013 through 31 April20 14).
CDP,erations and Maintenance, Army appropriations will be used.
I b. FAR Clause 52.217-8, Option to Extend Services, will be incorporated into the contract.
T~is option to extend will be utilized only in increments minimally necessary to maintain sefices until a task order is awarded under the Enhanced Army Global Logistics Enterprise (tJ\GLE) program. A separate J&A or J&A amendment will be issued if it becomes necessary t I . h' . to exercise t IS optiOn.
II c. The estimated value ofthe action is for a six-month bridge contract to c o,ncide with EAGLE competition milestones for order award and a 60-day phase-in period for the resulting EAGLE order.
31. Description of Supplies/Services:
I a. The contract is for reduced installation level logistics support consisting of four fpnctions: General, Transportation, Material Maintenance and Supply and Services. The General fu~ction consists of administration and management operations, Government property Jlministration and property book accounting and limited physical security. Transportation c~~sists of property traffic management services (inbound and outbound), arranging port calls fpq overseas travel, prepa~ing all ~ecessary travel_ related documents to ship, receive and store p erlsonal effects, reduced mstal!atton Transportation Motor Pool (TMP) support, reduced levels o'f post bus service, 1 imited driver testing of assigned installation personnel and the shipping and r~cfiving of supplies. Materia[ Maintenance consists of preventive maintenance, lubrication, sh1icing, limited overhaul and rebuilding of components and estimating cost of repairs. This function has decreased considerably over the last three years, due to deployment of soldiers and Ilnlited funding. The Supply and Services function consists of requisitioning, receiving, storing abd. inventory of a reduced level of Class I, II and IV supplies; storing, issuing, accounting for apd turn in of Class V through the Ammunition Supply Point (ASP); receiving and turn-in of QJJss VU items and storage, issue and turn-in of Class IX repair parts.
b. In accordance with AFARS 5153.9005, the estimated total value is for the new br dge contract.
I j· Authority Cited: 10 U.S.C. 2304(c)(2), and FAR 6.302-2, Unusual and compelling urgency.
5. Reason for Authority Cited: Pursuant to FAR 6.302-:2(a)(2), the Government would be seriously ~ured unless the agency is permitted to limit the number of sources from which it solicits bids or prbposals. Solicitation W9124A-13-R-0002 was issued on 25 January 2013. An apparent awardee ~~s announced on or about 28 August 2013. A small business size challenge was filed by one of tpe apparent unsuccessful offerors. The Small Business Administration (SBA) was to have t'e~dered a decision on or about 8 October 2013. However, the government shutdown occurred on 1 9~tober 2013 and the SBA did not return to work untill7 October 2013. Meanwhile, the EAGLE pr0gram was moving ahead at an accelerated pace with a solicitation for the services at Fort *Jachuca ready to be issued by 25 October. Award to any other source would result in substantial 4up!ication of cost to the Government that is not expected to be recovered through a competed foHow-on contract for six months. In addition to the government paying for phase-in twice, a new 1~htractor would mobilize, ramp up and begin full performance then begin phase-out 90 days later.
ljUho, during both phase-in and phase-out a 100% inventory
, would require the government to pay for inventory cost two times. This would be Jnfair to a new contractor to expend a large amount of resources to ramp up for a six -month period drberformance.
~~l proposed source is VT Griffin Services, Inc. (VTG); 10745 Westside Way, STE 300;
1lpharetta, GA 30009-7639. VT Griffin is currently performing these services under the sole spilirce bridge contract W9124A-13-C-0001, and therefore has the knowledge, experience, rrspurces, and personnel with the required skills and certifications available to continue providing these services until a new contract can be competed and awarded. Although other sources could ~otentially perform this work, it is estimated that the use of any other source would result in delays in contract performance and inabilities to perform necessary services.
Jh~s bridge contract is necessary to ensure there is no disruption of services due to the cancellation df solicitation W9124A-13-R-0002. Subject solicitation was cancelled because it is not ecdnomically or logistically feasible to award this contract for six months before the EAGLE t~sk order is awarded with full performance commencing on 21 April2014, especially in view of th~ fact that a phase-in period is necessary for transition of services. The procuring office for the ibstallation level logistics support services under the EAGLE program is scheduled to release the rbjuest for proposals on 25 October 2013 and anticipate task order award on 10 February 2014.
r{ i~ imperative the Government continue to provide logistical support for units and tenant e!elnents assigned to and deploying from Fort Huachuca, Arizona. Logistical support is a vital elebent that cannot be disrupted or delayed without serious injury to the government. The i~abiiity of Fort Huachuca to provide logistical support for the war fighter would have a. direct i~pact on the readiness level of local and deploying troops from/through Fort Huachuca, afrecting their mission, morale and safety. At a minimum, failure to award a bridge contract
1 obld have a catastrophic impact on the General, Transportation, Maintenance and Supply and
ControlNumber: HUA-14-2
S1rvices infrastructure detailed in Paragraph 3. These functional areas and the requirements that b~ist under each area would immediately cease without contractor performance. For example, ~efloyment and the redeployment of the 11 111 Theater Tactical Signal Brigade would cease. This ~nigade plays a vital role in providing communication service worldwide for the Anny.
f>isruption of these services could potentially be catastrophic to the Army's mission.
-j\~ditionally, other DOD contingency missions and aircraft refueling (addressed below) would 9erse or be delayed causing serious injury to the government. The contractor also operates the <Central Issue Facility. Without contractor support, organizational clothing and individual J~llipment could not be issued. This clothing and equipment is vital for field training exercises, f1tich, is one of the primary missions of Fort Huachuca. Consequently, troop capabilities would surer. The contractor has the primary duty to ensure the safe operating conditions of all *~nsportation equipment and government facilities under their control. The contractor is ~esponsible for the safe delivery of aviation fuel to and fi·om aircraft at Fort Huachuca's Libby t~Y Airfield, for the operation of the Hazardous Material Facility and for the mechanical rhaintenance of all firefighting equipment.
~~taining the current contractor during the issuance of a solicitation for a task order under the EAGLE Basic Ordering Agreement (BOA) will protect the high levels of services needed for the rb~lti-functional base operations support services for the U.S. Army Garrison and ~sJigned/attached units and activities. Continuing with the current contractor would be the most 9of: e!fective u~e of the Govem~entresources invested thus ~ar in co~tinued mis~ion success by av01dmg a considerable loss ofttme and unacceptable delays ttl fulfilimg the requirement.
JJe to the accelerated implementation of the EAGLE task order and the delays in awarding a c:ortract as a result of the small business size challenge, itis not in the Government's best interest to compete this short term requirement. The solicitation preparation and evaluation would also r~dult in a duplication of effort and costs on the part of Government personnel, as well as P,rJposal preparation effort on the part of the competing vendors for a contract with a
I 1f' . d f . h ~e~ ormance per10 o stx mont s.
Solicitation W9124A-13-R-0002 was cancelled on 21 October 2013 and a notification letter was sbrlt to each offeror on the same day. A solicitation cancellation notice was posted to ASFIIFBO o'nl24 October 2013.
J ~fforts to Obtain Competition: Efforts to obtain competition for this action are not feasible nor is i~ in the Government's best interest. It is anticipated that several BOA holders will propose when t~dnew EAGLE solicitation is released.
7!.1Actions to Increase Competition: This action is required while preparing to release a new Et1JGLE solicitation. The government is currently fmalizing the required paperwork in order to rbl~ase the new EAGLE solicitation on 25 October 2013.
sl ~arket Research: Not Applicable. The new solicitation will be issued under the EAGLE p1rdgram out ofthe ACC-RI contracting office.
9. Interested Sources: In accordance with FAR 5.202(a)(2), this contract action is not required t6 6e posted. Unusual and compelling urgency precludes competition to the maximum extent pr cticable and the Government would be seriously injured if the agency complies with the time
~eriods specified in FAR 5.203.
