Performance Work Statement Hidden Dam Elevator Maintenance Contract

Part A - General Information:
1. Location: The work required under this contract provides for all materials, labor, transportation, and equipment necessary to upgrade and modernize the Hidden Dam elevator at Hidden Dam, Hensley Lake. This will include updating the elevator to current ASME A17.1, updating electrical, processors, elevator car, cables, motor, and lighting. The Contractor shall furnish all labor, tools, materials, transportation, equipment, and safety documents necessary to complete the repairs, safety tests, and bring the elevator back to full service. Hidden Dam, Hensley Lake is located approximately 17 miles northeast of Madera, in Madera County, California.
2. Contractor Certification: The Contractor shall be a current Certified Conveyance Company and the person who performs the work shall be a Certified Competent Conveyance Elevator Mechanic. The Company shall also provide a Certified Qualified Elevator Inspector.
3. Authorities/Technical Direction: The Contractor shall take no direction from any Government employee or any other person other than the Government Contracting Officer that changes the terms and conditions of this contract action, the scope, or any change that impacts the cost, price or schedule. Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor acts upon those changes. The Contractor shall comply with the Changes clause of this contract when the contractor believes direction has been given from persons other than the Government Contracting Officer that equate to a change by notifying the Contractor Officer as directed by the clause. Any direction given by any Government employee or any other person outside their authority must be reported to the Contracting Officer. Contracting Officer Representatives (CORs) are limited to the authorities stated in the COR appointment letters. If a COR is appointed under this contract, they will be appointed by written letter from the Contracting Officer to the Contractor and COR specific to this contract only. COR appointment letters from previous contracts at this installation are not valid for this contract.
4. Period of Performance: The period of this contract shall not exceed 365 days following contract award.

6. Work Schedule: Contractor shall be notified at least 72 hours in advance for significant schedule changes and as much time as possible for minor schedule changes. Contractor requests for modification of duty hours shall be submitted in writing for action by the COR.
6.1 Hours of Operation: Work shall be accomplished between 08:00 am and 04:30 pm., unless otherwise approved by the COR. Contractor shall notify the COR if the services are unable to be performed for any reason.
6.2 Federal Holidays: Work shall not be performed by the contractor during a federal holiday unless approved by the COR. The eleven Federal Holidays are as follows:
New Years Day, Martin Luther King Jr Day, Presidents Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. When one of the above designated holidays falls on a Sunday, the following Monday shall be observed as the legal holiday. When a designated holiday falls on a Saturday, the preceding Friday shall be observed as a legal holiday.
7. Invoicing and Payments: Payment shall be made in arrears at the contract unit price for services performed in accordance with the pricing schedule and as described herein. Invoices shall include all necessary information, including any necessary supporting documentation required as part of this Performance Work Statement. All invoices must reflect the contract number W91238-XX-X-XXXX. The final invoice must be marked “FINAL.” Copies of all invoices shall be provided to the following:

Following the COR notification of an approved invoice and the creation of a receiving report, submit the original invoice only, without additional information or supporting documentation, to the following physical or email address:

Provide each invoice with a date, a unique invoice number, contract number, company name, USACE project name, CLIN number, task description and amount being billed against. Also include a billing summary history of all preceding invoices billed. The contractor may request a template invoice from the Contracting Officer’s Representative (COR) if necessary. Invoicing will follow the specific format outlined above.
Part B – Work to be Performed:
1. General Information: Contractor shall provide all materials, labor, tools, transportation, and equipment necessary to upgrade and modernize the Hidden Dam elevator at Hidden Dam, Hensley Lake. The Contractor shall furnish all labor, equipment, transportation, and supervision necessary for the Hidden Dam control tower elevator upgrade and modernization at Hidden Dam, Hensley Lake.
1) Replace controllers with new, non-proprietary solid-state electronics. Contractor shall provide an owner’s manual to the COR for the controllers.
2) Remove old and replace with new the Elevator Hoist Motor, seismic switch and all necessary parts. Provide a custom-built elevator motor to include a gearbox, brake, rope gripper and all new wiring. Engineering and drawings shall be provided to the
COR.
3) Update signage in the Machine Room (control room on 8th floor in the dam control tower) to meet ASME A17.1 and all State and local codes.
4) Elevator car shall have all new electrical wiring and all existing lighting replaced with LED fixtures and new LED lamps.
5) Install new power elevator car doors and equipment to include the door operator, door tracks, door, hoistway doors, hoistway tracks, hoistway door interlock mechanisms, door gibs, door rollers, and car door detectors.
6) Re-wire hall fixtures (located at all elevator floor landings) and replace all existing lighting with LED fixtures and new LED lamps.
7) Install new cellular ADA phone to be built into the elevator car fixture with any additional cabling and antenna to be fully function with current cellular signal(s) in the area. Contractor shall provide one year of service on the cellular service. The existing phone and phone line is to be retained.
8) Install and replace traveling cables, positioning door device, top of car door inspection station, car top stop switch, pit switch GFCI outlet in pit, rail joint plates and limit switches.
9) Install and replace with new the overspeed governor, governor tail sheave, governor rope, car safeties, hoist cables, hatch wiring, positioning door device, and pit switches.
10) Provide a new elevator recall system to include engineering and designs, and provide to the COR.
11) Provide and install a new addressable fire alarm system which includes fire panels, cellphone communicator, heat detectors on all nine floors, all necessary relays, 110VAC power disconnect, remove and reinstall wiring and conduit, waterproof junction boxes, pull wiring and splits, install new circuits, Myer hubs, and terminate wire with Polaris connection. All lighting circuits shall be tested to ensure they function properly.
12) Replace buffer and pit steel after the service and upgrade is complete.
13) Install new car station panels and hall panels. Ensure filler plates are placed behind wall panels to fill any gaps.
a. The Contractor shall furnish all labor, tools, and safety documents necessary to complete repairs and retest. This action is expected to take approximately two weeks pending the arrival of parts. Two warranty visits shall be included for faulty equipment and the adjustment on cables or mechanism that were installed.
2. Pre-Work Meeting - The contractor shall contact the COR to schedule a Pre-Work meeting to discuss all elements of this contract. At least one week prior to this meeting, the Contractor shall submit to the COR all information required under this contract including Certificate of Insurance, Safety Plan, and name of supervisor and alternate supervisor. The COR shall determine the date, time, and location of this meeting. The Contractor shall submit to the COR all items listed below:
a. Certificates of Insurance
b. Safety Hazard Analysis (Will be provided at pre-work meeting).
c. Name and local telephone numbers of supervisor if other than the contractor.
d. Exposure Report – Form 94 (Man-hours worked). Submit within 5 working days after the first of each month (Will be provided at pre-work meeting).
e. Monthly Invoice.
f. Safety Data Sheet (SDS) for compound to be used for the contract.
3. EPA Designated - Under the Comprehensive Procurement Guidelines (CPG) program, the Environmental Protection Agency (EPA) designates products that are or can be made with recovered materials, and recommends practices for buying these products. Any designated product that is being offered or supplied under this contract shall meet the minimum recommended content levels as identified under the CPG program. Visit http://www.epa.gov/epawaste/conserve/tools/cpg/products for a complete list of designated products and the associated recommended content levels. Offerors must be able to demonstrate that each offered product meets minimum content levels upon request.
4. Safer Choice - The contractor shall provide Safer Choice labeled products under this contract, as applicable. The contractor is encouraged to visit http://www2.epa.gov/saferchoice/products for updated lists of qualifying products.
5. Bio-based - The United States Department of Agriculture (USDA) designates certain biobased products for federal procurement and specifies minimum biobased content levels for those products. Any designated product that is being offered or supplied under this contract shall meet USDA BioPreferred’s minimum biobased content level. Visit the BioPreferred web site for the complete list of designated products and the associated minimum biobased content level requirements.
Part C – Contractor’s Responsibility:
1. Contractor Furnished equipment - The Contractor shall provide all equipment, necessary to comply with this contract. Contractor shall not use any Government-owned equipment and/or supplies.
2. Inspection - Contractor Records -The Contractor shall maintain a record of all contract services performed.
3. Personnel - The Contractor shall ensure all personnel are E-verified with https://www.e-verify.gov and strictly comply with all Federal, State and local laws. A copy of the E-verify status for every Contractor employee shall be provided to the COR prior to the employee working on-site.
4. Safety - The work to be performed shall be within the boundaries of Hidden Dam and this location will be accessible only when a COR designated government employee is present. The public is restricted from entering the dam areas. All work performed and equipment shall comply with and meet all requirements of the latest version of the Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, which can be found here:

a. Accident Prevention Plan (per EM 385-1-1, Section 2-7, sub-section b.) shall be submitted to the COR for approval no less than three weeks prior to the commencement of work. The Contractor shall include the following with the Accident Prevention Plan submittal:
1) Personnel Required Qualifications/Certifications/Training
2) Personnel Roles and Responsibilities
3) Activity Hazard Analysis’ (AHA) Requirements
4) Inspection Requirements
5) General Requirements
6) Checklists and Forms
5. Security –
a. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor ("Contractor") and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as "RAMs"), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures -this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
b. Antiterrorism (AT) Level I training: All contract personnel requiring routine access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level I awareness training. Online AT Level I awareness training is available at https://jko.jten.mil/ (website subject to change).
c. Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as "NCIC-I11") and Terrorist Screening Database (commonly referred to as "TSDB"). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
d. Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
e. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements.
Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/ eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form 1-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
6. Damage to Property - The COR shall be notified immediately of any and all damage to Government facilities and/or environmental features as well as to private property and equipment by the Contractor or his/her employees. Damaged property shall either be repaired or replaced to its original condition as supervised/directed by the COR.
Performance Assessment Plan:
a. Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.
b. Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer. The self-assessment shall be submitted no later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned and/or taken to correct such deficiencies to avoid their recurrence. The self-assessment itself will NOT be the basis for the payment re-calculation determination.
c. COR Recommendation. The COR shall consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor shall be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.
d. Payment Determination. The Contracting Officer may meet with the COR to discuss the COR's report. The Contracting Officer will make a final determination in writing as to the percentage of work successfully completed, and the resulting payment to be made. A copy of the determination will be provided to the Contractor no later than 45 calendar days after the end of the period being evaluated. All Contracting Officer decisions regarding payment re-calculations are unilateral decisions made solely at the discretion of the Government.
e. Payment Re-Calculations. Notwithstanding any other clause of this contract, payment re-calculations will be made within the later of 60 days after the end of the evaluation period or 30 days after receipt of an approved invoice.
f. The Quality Assurance Surveillance Plan is one evaluation method the government uses to surveillance performance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
