USACE Sacramento intends to award a Firm Fixed Price Purchase Order with a Base and (4) Option Years in response to this solicitation. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This requirement is being set aside 100% for Small Business.

Performance Work Statement Grounds Maintenance - Englebright Lake

Dated: January 2020 PART A

– GENERAL INFORMATION:

1. Summary: The Contractor shall furnish all labor, materials, equipment, supplies, permits, transportation and supervision necessary to provide grounds maintenance services at the Englebright Lake project. The Contractor shall be responsible for all costs related to performing this contract and its successful completion. Services shall be performed at various locations within the Englebright Lake project boundaries, Yuba and Nevada Counties, CA. All work, materials and equipment shall be subject to the control and approval of the Contracting Officer Representative (COR). Prospective vendors are strongly urged to visit the site to become familiar with the locations and work involved. Some service locations are accessible only by vessel. High lake levels and/or inclement weather may restrict access into a service location. This condition shall not release the Contractor from completing the service as specified. In no event shall a failure to inspect the site constitute grounds for withdrawal of a quotation after closing date and or a claim after award of the contract.

2. Authorities/Technical Direction: The Contractor shall take no direction from any Government employee, or any other person other than the Government Contracting Officer that changes the terms and conditions of this contract action, scope, or any change that impacts the cost, price or schedule.

Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor shall act upon those changes. The Contractor shall comply with the changes clause of this contract when the Contractor believes direction has been given from persons other than the Government Contracting Officer that equate to a change by notifying the Contracting Officer as directed by the clause. Any direction given by any Government employee or any other person outside their authority must be reported to the Contracting Officer. Contracting Officer Representatives (CORs) are limited to the authorities stated in the COR appointment letters.

3. Estimated Quantity Line Items: All Section B Pricing Schedule Line Items with quantities are estimated-quantity Line Items. The quantities are estimated amounts and are not guaranteed amounts.

The Contractor shall only be paid for work actually performed. At no time shall the Contractor exceed the estimated quantity on any estimated quantity Line Item. The Contractor shall establish a tracking system of actual quantities against the contract’s estimated quantities for each estimated quantity Line Item and will maintain the tracking system up to date throughout the life of the contract. When the actual quantity of any Line Item reaches 85% of the estimated quantity on any estimated quantity Line Item, the Contractor shall notify the Government’s Contract Specialist and the Technical POC in writing by fax or e-mail within two calendar days. Once the Government is notified that the actual quantity has reached 85% of the estimated quantity on any Line Item and if the Government determines that the estimated quantity needs to be increased, the Contractor shall receive an official modification to the contract action signed by the Contracting Officer increasing the quantity and the amount obligated on the contract BEFORE the Contractor will proceed to work over the existing estimated quantity. The modification will set the new estimated quantity that the Contractor may not exceed without another modification.

4. Period of Performance: This contract consists of a Base Year and four (4) Option Years. The Base Year of this contract shall be from 01 March 2020 until 28 February 2021. The total

Government contract shall be from 01 March 2020 until 28 February 2025. The Government may elect to exercise the option years.

6. Pre-Work Meetings: The Contractor shall meet with the Park Manager at least five (5) days prior to commencement of work to discuss contract requirements and provide proof of meeting the following requirements:

a. General park orientation.

b. Valid California Driver’s License.

c. General Liability Insurance.

d. Automobile Liability Insurance.

e. Worker’s Compensation Insurance (if you have employees).

f. Submittal of required licenses and/or administrative materials.

g. Safety and first-aid responsibilities.

h. Contract statement of work and compliance.

i. Acceptable performance standards.

j. Billing procedures.

7. Area Closures: In the event that any part or the entire Park is permanently or temporarily closed, the segments of this contract pertaining to that area may not be required and therefore not utilized.

The number of facilities may vary. Contractor shall not perform work in those closed areas or facilities that will not be in use and shall not be compensated for work not accomplished.

8. Work Locations: Service shall be performed in the areas listed in Appendix A unless otherwise specified by the Park Manager. Service can be at locations other than those listed in Appendix D. It is essential that the Contractor possess a vehicle and a vessel in good working order to make trips between work locations to fulfill contract requirements. It is possible some areas shall be closed longer than noted in the contract specifications or undergo major changes in operational status. If these changes become effective, the Contractor shall be notified two weeks before implementation.

9. Work Schedule:

a. Days of Operation: A business day shall be considered Monday through Friday. Service shall be as indicated within this statement of work unless otherwise specified by the Park Manager. The Contractor shall be notified of schedule changes at least 72 hours in advance. Services might be required on weekends. No work shall be conducted on days other than those scheduled without prior approval from the Park Manager.

b. Hours of Operation: Work completed under this statement of work shall be accomplished between 8:00 a.m. and 4:30 p.m. unless otherwise approved by the Park Manager. The Contractor shall notify the Park Office if the services are unable to be performed for any reason.

c. Federal Holidays: When a service day falls on a Federal Holiday, the service shall be performed on that day. The ten Federal Holidays are as follows:

New Years Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Christmas Day.

When one of the above designated holidays falls on a Sunday the following Monday is observed as the legal holiday. When a designated holiday falls on a Saturday the preceding Friday is observed as a legal holiday.

10. Invoices & Payments:

a. The Contractor shall be paid at the completion of specified services for the amount of work accomplished. Invoices shall be verified by the Contracting Officer’s Representative before payment can be authorized.

b. Invoices shall be sent monthly in arrears to the following addresses:

c. Final payment shall be authorized when Government issued keys have been returned (if issued) and all contract reporting requirements have been met.

PART B – WORK TO BE PERFORMED:

1. General Information: The Contractor shall provide all labor, equipment, materials, supplies, transportation and supervision necessary to perform all grounds maintenance service at Englebright Lake.

2. Blowing and Cleaning Firebreaks: This service is not guaranteed and shall only be accomplished at the request of the Park Manager. If the service is requested, the Contractor shall begin work within one week of Notice to Proceed (NTP). Firebreak locations are identified in Appendix A. Firebreak widths vary, but they are typically eight feet wide or more. The firebreaks shall be cleaned down to bare mineral soil.

3. Grass and Weed Cutting/Square Feet: At the request of the Park Manager, the Contractor shall cut grasses and weeds in requested areas at a per Acre cost. (Also see location map, Attachment 5).

The Contractor shall provide all personnel, materials, supplies, and equipment, including boat transportation. The vegetation shall be cut to a height not less than two (2") inches and not more than four (4") inches. Vegetation shall be cut completely down to the ground surface at all herbicide spray zones locations around picnic tables and fire rings. The Park Manager shall specify the dates of any additional services as needed. Minimum requested service will be 21,780 Square feet or 0.5 acres.

Service by shall not exceed 10 acres

4. Grass and Weed Cutting Full Service: At the request of the Park Manager, the Contractor shall cut grasses and weeds in the areas designated below (also see location map, Attachment

5. The Contractor shall provide all personnel, materials, supplies, and equipment, including boat transportation. The vegetation shall be cut to a height not less than two (2") inches and not more than four (4") inches. Vegetation shall be cut completely down to the ground surface at all herbicide spray zones locations around picnic tables and fire rings. At the direction of the Park Manager, the initial cutting shall be accomplished during a one-week period between 01 March and 15 March in the base year and 01 April and 01 May in the option years. The Park Manager shall specify the dates of any additional services as needed. All grass and weed cutting locations are described as follows:

a. Narrows Recreation Area. Weed-eat around the base of each sign in the recreation area. Weed-eat the level areas around the Narrow’s lower parking lot, Narrows’s middle parking lot and Narrow’s Upper parking lot and the entire picnic areas all the way to the dam. Weed-eat ten feet (10') both sides of the stairway from the lower parking lot up to the park office. Weed-eat around the display area near the waterborne restroom that is contained within the wooden fencing. Weed-eat both sides of restroom. Starting from the women's side of the water-borne restroom, weed-eat the level picnic area to ten feet (10’) beyond last bench.

b. Englebright Dam Road. Weed-eat around base of each sign and car counter on Englebright

Dam Road. Weed-eat ten feet (10) feet on both sides of road ways from Mooney Flat Road to Narrows Boat Ramp.

c. Park Office. Weed-eat the entire hillside below the office from the far end of chain-link fence to the Narrows waterborne restroom. This includes the area surrounding the propane storage tank, Park Office Back yard all the way to overlook and around Gate House. Weed-eat around the light pole and twin power poles on the hill next to the covered parking area.

d. Maintenance Yard. Weed-eat all gravel and dirt roadways when weeds are present. Weed-eat ten feet (10') both sides of all gravel dirt roadways, including the road to the water treatment plant, Sniper Lane all the way down to Englebright Dam Road. Weed- eat a ten-foot (10') perimeter around concrete landings, sign shed, concrete shed, water treatment plant and water storage tank. Weed-eat the entire island around pump house and boat trailer storage area. Weed-eat a ten-foot (10') perimeter around the Maintenance Shop compound (chain-link fenced area).

e. Joe Miller Recreation Area. Weed-eat around the base of each sign in the recreation area.

Weed-eat five feet (5') on each side of the Joe Miller launch ramp, behind the guardrails, around fee station, around life jacket loaner station and on each side of the stairway between lower Joe Miller Lower and Middle parking lots, middle walk way and Joe Miller launch ramp. Weed-eat fifteen feet (15') behind the guardrail at the lower Joe Miller parking lot and three feet (3'). Weed-eat ten feet (10') around the exterior water well fence. Weed-eat the triangular area located between the Joe Miller lower parking lot entrance road, the launch ramp road and the Joe Miller restroom.

f. Marina Drive Road. Weed-eat around base of each sign and car counter on Marina Dam.

Weed-eat ten feet (10) both sides of Road ways from Mooney Flat Road to Joe Miller Lower Parking Lot.

g. Mooney Flat Road. Weed-eat 10 feet around base of each USACE Corps sign on Mooney

Flat Road.

h. Fishing Access Trail. Weed-eat two feet (2’) on each side of the Fishing Access Trail, starting from the Joe Miller boat launch ramp and ending at the Narrows launch ramp.

i. Boat-In Campgrounds - Group A: The following boat-in campgrounds shall be mowed and/or weed-eated entirely within the area of the firebreak as indicated below:

1) Rocky Bluff (weed-eat the entire area within the fire break down to the shoreline)

2) Longs Point (weed-eat the entire contiguous campground area, from the shoreline to 10 feet beyond any picnic table, tent pad, fire ring and portable restroom)

3) Singles Point (weed-eat the entire contiguous campground area, from the shoreline cliff to

10 feet beyond any picnic table, tent pad, fire ring and portable restroom. Weed-eat three feet (3’) on each side of the trail between Singles Campground and Shadyside Campground)

4) Shadyside (weed-eat the entire contiguous campground area, from the shoreline cliff to 10 feet beyond any picnic table, tent pad, fire ring and portable restroom. Weed- eat a six-foot (6’) wide trail from the campsites to the shoreline)

5) Cherokee (weed-eat the entire contiguous campground area, from the shoreline to 10 feet beyond any picnic table, tent pad, fire ring and portable restroom. Note: Includes weed-eating the dense weeds on the beach)

6) Buck's Beach (weed-eat the entire area within the fire break down to the shoreline)

7) Dixon Hill (weed-eat the entire area within the fire break down to the shoreline)

8) Point Defiance (weed-eat the entire open areas within the fire break down to the shoreline and/or cliff edge; includes internal access trails and pathways to shoreline)

9) Lower Missouri Bar (weed-eat the entire area within the fire break down to the shoreline; excludes the steep ravine area)

10) Missouri Bar (weed-eat the entire contiguous campground area, from the shoreline to 10 feet beyond any picnic table, tent pad, fire ring and portable restroom; excludes willow tree groups)

11) Sunnyside (weed-eat the entire area within the fire break down to the shoreline)

j. Boat-In Campgrounds - Group B: Hogback Ravine, Bonanza Point and Long's Cove. The boat-in campgrounds indicated below shall be mowed and/or weed-eated as follows: Weed-eat the entire contiguous area of each campsite to include cutting ten feet (10’) beyond any tent pad, picnic table and fire ring. Weed-eat a ten-foot (10’) wide zone around each portable toilet.

Weed-eat all campground trails that link campsites, portable restrooms and paths to the shoreline, to a width of six feet (6’).

k. Boat-In Campgrounds – Group C: Boston Bar and Upper Boston Bar. The boat-in campgrounds indicated below shall be mowed and/or weed-eated as follows: Sites 8, 10- 11 at Boston Campground weed-eat the entire campsite to include weed-eating down to the low water line of the shoreline below each site. Sites 1-7, 9, 12-13 at Boston and all of Upper Boston Campground shall be mowed and/or weed-eated as follows: Weed-eat the entire contiguous area of each campsite to include cutting ten feet (10’) beyond any tent pad, picnic table and fire ring. Weed-eat a ten-foot (10’) wide zone around each portable toilet. Weed-eat all campground trails that link campsites, portable restrooms and paths to the shoreline, to a width of six feet (6’)

l. Boat-In Campgrounds - Group D: Rice's Crossing. Weed-eat the parking lot turn- around area, gate, signs, and CXT restroom. Weed-eat a six-foot wide path on the two main trails that lead down to the water.

5. Ability to Perform: The Contractor shall have sufficient equipment and labor to perform services prescribed. If for any reason the Contractor shall be unable to perform any service as scheduled, the Park Manager shall be notified in advance.

PART C - CONTRACTORS RESPONSIBILITIES:

1. Quality Control: If someone other than the person named on the official contract is actually performing the duties as described, it is the responsibility of the Contractor to personally inspect the worksite a minimum of every 30 days to ensure adherence to contract specifications and acceptable performance standards. Contact with the Park Office must be made upon arrival during these visits.

2. Facilities/Deliveries: The Government shall not supply office, storage or operational facilities to the Contractor. Government personnel shall not accept deliveries of materials that are to be used or installed by the Contractor.

3. Keys: The Contractor shall be responsible for all keys issued. Keys are for the exclusive use of the Contractor and authorized employees while performing the specified services. Contractor shall be liable for any costs involved in changing locks due to lost keys. Key loss shall be reported to the Park Manager immediately. Keys shall be turned in to the Park Manager immediately upon completion and or termination of the contract.

4. Hazardous Waste: If the Contractor encounters hazardous waste during the performance of this contract, Contractor shall immediately notify the Contracting Officer’s Representative upon discovery.

The Contractor shall be given direction as to the required action.

5. Title 36, Chapter III, PART 327, Rules and Regulations: The work to be performed under this contract shall be within the boundaries of land administered by the U.S. Army Corps of Engineers. The Contractor and contract employees are subject to all Title 36 regulations while completing work under this contract. No special provisions or entitlements shall be granted to the Contractor or contract employees.

6. Health Codes: The Contractor shall comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, Safety and Health Requirement Manual, the California State Health Code, Cal- OSHA, and Yuba and Nevada Counties Codes. EM 385-1-1 can be viewed at the following website:

http://www.usace.army.mil/publications/eng-manuals/em385-1-1/toc.htm. An observed violation of safety requirements shall be grounds for the Government to stop work. Work shall not continue until the violation is corrected.

7. Employees: The Contractor shall furnish competent, safety conscious personnel. If employees prove to be incompetent or unsatisfactory, the Contractor shall remove them immediately and replace them.

For safety and security purposes, the Contractor shall submit IN WRITING the name, address and phone number of all personnel performing services under this contract prior to the commencement of work.

The Contractor shall submit IN WRITING the name of all employees discharged during this contract.

8. Contractor Clothing: All Contractors and their employees shall wear clothing suitable for the weather and work conditions while performing the duties of this contract. The minimum required shall be a shirt, long trousers and leather or other protective work shoes or boots, per EM 385-1-1. A clean, well-groomed appearance shall be maintained at all times while on duty.

9. Area Safety: The work to be performed shall be within the boundaries of public recreation areas and the attention of the Contractor and his employees is directed to the need for extreme caution and care while driving and/or operating equipment in these locations. The Contractor and contractor employees shall comply with all state and local traffic and boating laws. The Contractor and contract employees shall not park in any reserved or restricted parking areas except as approved in advance by the Supervisory Park Ranger.

10. Equipment: General employee safety equipment includes safety shoes, safety glasses, hard hats, hearing protection, work gloves, Coast Guard Approved personal flotation devices and/or other additional personal safety equipment required for specific work duties. Vehicle use shall be restricted to paved, dirt, or gravel roadways. Off-road operation of Contractor vehicles shall be prohibited unless provided specific exception by the Park Manager. The equipment used by the Contractor for the specified service shall be in satisfactory operating condition and shall be maintained in this condition.

The Government reserves the right to require the Contractor to discontinue the use of unsatisfactory equipment and to require that such equipment be replaced with acceptable equipment to maintain contract compliance. The decision of the Contracting Officer as to serviceability of the equipment shall be final. Equipment shall meet current Federal, State and local safety requirements and all applicable http://www.usace.army.mil/publications/eng-manuals/em385-1-1/toc.htm requirements of the Corps of Engineers Safety Manual, EM 385-1-1. The Contractor shall conduct a daily pre-work safety inspection of all equipment. Power equipment shall be equipped with operable muffler and USFS approved spark arrestors. A fire shovel and at least one (1) type 10-A:B:C: dry chemical or CO2 fire extinguisher must be readily available to the operator at all times when performing contract services. The fire extinguisher shall be mounted on riding equipment and kept in close proximity to the operator of hand-powered equipment.

11. Disposal: The disposal of waste materials shall be done at approved locations and in accordance with all applicable State and County regulations. The Contractor shall be respon- sible for locating a legal dump site for all waste material. No waste of any kind shall be discharged on Government property.

12. Protection of Government Facilities: The Contractor shall be responsible for restoring any Government facilities or property damaged as a result of Contractor's operations. Reasonable care shall be used to avoid damage to existing structures, equipment, facilities, and trees in the areas serviced.

Any damage shall be repaired or the items replaced, as directed by the Park Manager, at no cost to the Government. If the Contractor shall not make such repair or replacement, the cost thereof shall be deducted from normal contract payments.

13. Hazardous Spill Notification: The Contractor shall immediately notify the Park Office of any hazardous material spills that occur on Government property. If the Contractor is responsible for the spill, the Contractor shall notify appropriate local and state agencies as required and arrange for the spill cleanup. Any cost incurred during clean up is the Contractor's responsibility.

14. Certification: The Contractor shall hold any licenses or certifications required by the State of California and register with Yuba and/or Nevada County as needed, and provide proof of any certification before the start of work. The Contractor shall be responsible for any permits required to perform services.

15. Service Record Sheets: The Contractor shall deliver to the Park Office a completed service record sheet for each service day. Service record sheets shall include a description of each service performed, date, start time, total time on the project, the number of Contractor personnel, and the signature of the service person. Any reports required by state, local or other Federal agency shall be the responsibility of the Contractor.

16. Exposure Data Report: The Contractor shall submit a Safety Exposure Report, CESPD Form 94, to the Park Manager with each service invoice. A master copy of Form 94 is provided in Attachment 1. It is the Contractor's responsibility to provide any additional copies. Failure to submit Form 94 by the due date may delay payment for services performed. Negative reports are required.

17. Safety Data Sheet (SDS): The Contractor shall submit a SDS and product information sheet or label for any chemicals used. This information shall be given to the Park Manager before work begins.

18. Safety Meetings: The Contractor shall submit a report containing the minutes of the Contractor's monthly safety meetings as required in EM 385-1-1. A report of each meeting shall be submitted to the Park Manager with each service invoice. A sample format is shown in Attachment 2.

19. Activity Hazard Analysis: The Contractor shall submit a Job Safety Hazard Analysis on all phases of the work to be performed prior to the start of service. A sample format is shown in Attachment 3.

20. Accident Records: The Contractor shall maintain an accurate record of, and shall report to the Contracting Officer in the manner and on the forms prescribed by the Contracting Officer, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incidental to work performed under this contract. Medical expenses for Contractor personnel are the responsibility of the Contractor.

21. Insurance: A copy of evidence showing the acquisition of insurance, if required by this contract, shall be submitted to the Park Manager prior to the commencement of work.

22. Call-Out Number: The Contractor shall maintain a telephone number(s) and means of contact during normal business hours. The contact shall be a person or answering service or machine. Once the Corps has notified this contact, the Contractor shall be considered officially notified when called for problems or other work related items.

23. Lost & Found: All personal property found anywhere on Government property shall be accounted for and turned over to the Park Manager.

24. Repair/Work Request Forms: The Contractor shall report vandalism and potential safety hazards encountered while performing services. Any situation within or interfering with the Contractor’s scope of operation shall also be reported. The Contractor shall complete Repair/Work Request Form and submit to the Park Office on the day the problem is discovered. Equipment malfunctions, if applicable, shall also be reported. Damaged or inoperative facilities shall be reported. If the damaged facilities pose an immediate danger to the public, the Contractor shall notify the Park Office or a Park Ranger as quickly as possible.

PART D – GOVERNMENT RESPONSIBILITIES:

1. Contract Monitoring: The Government shall monitor the Contractor’s performance in all functional areas under this contract and shall reserve the right to use whatever additional surveillance procedures are deemed appropriate. Contractor services shall be monitored using the random sampling method, the planned sampling method and/or 100% inspection method. The Government reserves the right to change or alter the type of inspection plan at its discretion at any time.

2. Unsafe Conditions: Work shall be halted by the Contracting Officer or his representative if an unsafe condition exists or shall develop if work continues. The Contractor shall have no basis for compensation should such a work stoppage cost the Contractor damages. Work shall not resume until the condition is corrected in a safe manner.

PART E – CONTRACTORS RESPONSIBILITIES: SECURITY:

1. AT Level I Training. This provision/contract text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. or it can be provided by the RA ATO in presentation form which will be documented via memorandum."

2. Access and General Protection/Security Policy and Procedures. This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office.

Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes."

2b. For contractors who do not require CAC, but require access to a DoD facility or installation. Proposed language: Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014- 05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

3. Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something).

This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training."

4. Pre-screen candidates using E-Verify Program. Proposed language: "The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. (a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from…
