ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

PERFORMANCE WORK STATEMENT

Performance Work Statement Garbage Collection Services for Hensley Lake

November 14, 2018

Project: Garbage collection services to be performed at Hensley Lake, Madera County, CA.

1. General Information

1.1 This is a performance based contract for garbage collection and recycling services at Hensley Lake, Madera County, CA. The overall responsibility of the Contractor is to plan, coordinate, organize, manage, and perform the activities described herein in accordance with the performance objectives.

2. Introduction

2.1 This Performance Work Statement (PWS) describes the basic objectives for garbage collection services within the Hensley Lake project boundaries, Madera County, CA. The performance based service approach provides potential offerors the flexibility to develop cost effective solutions and the opportunity to propose innovative alternatives to meet the stated objectives. It also presents the Government with an opportunity to assess the offerors understanding of all aspects of the effort to be performed by eliminating the “how to” instructions to accomplish the required effort. Minimum levels of performance and disincentive for failure to meet the minimum levels are outlined in the “Performance of Work Requirements Summary” contained in Attachment A.

3. Authorities/Technical Direction

3.1 The Contractor shall take no direction from any Government employee or any other person other than the Government Contracting Officer that changes the terms and conditions of this contract action, the scope, or any change that impacts the cost, price or schedule. Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor shall act upon those changes. Any direction given by any Government employee or any other person outside their authority shall be reported to the Contracting Officer. Contracting Officer Representatives (CORs) are limited to the authorities stated in the COR appointment letters. A COR will be appointed to this contract by letter from the Contracting Officer to the Contractor and COR specific to this contract only. COR appointments from previous contracts at this installation are invalid for this contract.

4. Estimated Quantity Line Items

The Contractor shall establish a tracking system of actual quantities against the contract’s estimated quantities for each estimated quantity Line Item and shall maintain the tracking system up to date throughout the period of performance of the contract. When the actual quantity of any Line Item reaches 75% of the estimated quantity on any estimated quantity Line Item, the Contractor shall notify the Government’s Contract Specialist and the Technical PoC in writing by e-mail within two calendar days. Once the Government is notified that the actual quantity has reached 75% of the estimated quantity on any Line Item and if the Government determines that the estimated quantity needs to increased, the Contractor will receive an official modification to the contract signed by the Contracting Officer increasing the quantity and the amount to be obligated on the contract BEFORE the Contractor shall proceed to work over the existing estimated quantity. The modification will set the new estimated quantity that the Contractor shall not exceed without further notification.
