1.0 OBJECTIVE AND TASK DESCRIPTION: CERCLA response action and remedy requires completion of RI/FS, proposed plan, Record of Decision (ROD), remedial action work plan, remedial action completion report, etc. This PWS include review of ARCO, the potential responsible party (PRPs) or other contractor’s work products/deliverables on the RI/FS, response action and remedy, as requested by EPA, and other management and technical support as outlined in this PWS. The site is in many stages with many operable units. Support to EPA includes all actions required from RI/FS to reach ROD and implement the remedial action under EPA oversight, including review of deliverables and technical documents prepared by PRP or other contractors, and providing technical comments and recommendations. EPA will complete the ROD internally after the proposed plan and responsiveness summaries are completed.

This Task Order (TO) is to provide 12 months of support to EPA for the Leviathan Mine Site. All tasks required to support management, planning, meeting attendance, communications, day to day operations and continued support activities to EPA are included in this TO. The primary deliverables will typically be weekly and monthly reports for all requirements. All tasks required to develop and complete deliverables are included in this TO. No additional compensation outside this TO will be awarded to support the required deliverables.

1.1 Background. Leviathan Mine is an inactive mine located on the east side of the Sierra Nevada Mountains in California. Acid drainage from the mine (AMD) contributes pollutants to Leviathan and Bryant Creeks and to the Carson River. The Carson River is a significant source of water supply to agricultural, tribal, and urban users in western Nevada. Because of the interstate and tribal interests involved, and the lack of progress toward cleanup at the site, the U.S. Environmental Protection Agency (EPA) added the Leviathan Mine to its national priority list (NPL) in 2000.

The California Regional Water Quality Control Board - Lahontan Region (RWQCB), currently owns the mine. Before it was owned by California, the Anaconda Company, a former subsidiary of the Atlantic Richfield Company (ARCO), operated Leviathan Mine. ARCO and RWQCB are Potentially Responsible Parties (RPs) for the reclamation of Leviathan Mine, and since 2001, both PRs have implemented interim treatment systems at the site to reduce discharge of AMD.

Under EPA oversight, ARCO has been performing ongoing studies (RI/FS) to develop a long-term solution at the Leviathan Mine as part of the cleanup plan. RI began in 2008. Burleson has supported the EPA requirements for this project under contract to USACE and through an interagency agreement. Over the past several years, ARCO has prepared work plans to gather historical information and environmental data.

EPA, other federal and state agencies, and the Washoe Tribe, have reviewed and provided recommendations, and will continue to provide stakeholder support. EPA maintains a long list of previous documents on its publically available web site. Any references required to complete these tasks can be found at the EPA web site.

QUALITY ASSURANCE SURVEILLANCE PLAN

LEVIATHAN REMEDIAL ACTION AND EARLY ACTIN SUPPORT

1. INTRODUCTION. This plan sets forth procedures and guidelines that the U.S. Army Corps of Engineers (USACE) will use in evaluating the technical performance of the Contractor. A copy of this plan will be furnished to the Contractor so that the Contractor will be aware of the methods that the Government will employ in evaluating performance on this contract and address any concerns that the Contractor may have prior to initiating work.

2. PURPOSE OF THE QASP

• Confirm that the action is conducted utilizing proper procedures and in accordance with the approved work and safety plans;

• Define the roles and responsibilities of participating Government officials;

• Define the types of work to be performed with required end results;

• Document the evaluation methods that will be employed by the Government in assessing the Contractor’s performance;

• Provide the Surveillance Activities Table and Corrective Action Request (CAR) form that will be used by the Government in documenting and evaluating the Contractor’s performance; and

• Describe the process of performance documentation.

3. ROLES AND RESPONSIBILITIES OF PARTICIPATING GOVERNMENT OFFICIALS

The USACE Contracting Officer Representative (COR):

• Provides overall guidance to the contractor when necessary or requested for purposes of PWS/SOW clarification.

• Reviews vouchers and makes recommendations to the Contracting Officer for payment action based on completion of designated milestones.

• Reports problems or discrepancies to the Contracting Officer as soon as possible.

• Oversees the implementation of the QASP.

• Reviews contractor submittals.

• Initiates periodic contractor evaluations in the Past Performance Information Management System (PPIMS).

• Responsible for the execution of the work on schedule, within budget, in a safe manner, and at a level of quality consistent with the customer’s requirements.

• Periodically reviews contractor performance relative to the contract schedule and budget.

The USACE Contract Specialist:

• Monitors contract performance.

• Maintains central repository for all QA documents required for payment.

• Issues all acceptance/rejection statements.

The Project Manager (PM):

• Reviews contractor’s Technical Management Plan.

• Ensures that all necessary subject matter experts are involved in technical decisions.

• Conducts or supports other surveillance activities as required by the project team.

4. METHODOLOGIES TO BE USED TO MONITOR THE CONTRACTOR’S PERFORMANCE:

Even though the Government will be monitoring the contractor’s performance on a continuing basis, the volume of tasks performed by the contractor makes technical inspections of every task and step impractical. Accordingly, USACE will use the Surveillance Activities Table as the basis for monitoring the contractor’s performance under this contract. The contractor’s performance will be evaluated by the Contracting Officer using the performance metrics.

5. QUALITY ASSURANCE REPORTING FORMS. The primary form used to document surveillance activities will be the review memorandum. The review memorandum format will be determined at the time of the first deliverable submittal.

Upon completion of field work and acceptance of all final reports, the COR will document QA activities in a final Quality Assurance memorandum.
