1.1. General Information. Contractor shall provide all labor, materials, equipment, supervision, supplies, and transportation necessary to perform all Recreation Attendant Services at Black Butte Lake, Tehama and Glenn Counties, CA.

1.2. Site Visit. In no event shall a failure to inspect the site constitute grounds for a withdrawal of a quotation after the closing date and/or a claim after award of the contract.

1.3. Work Locations. Services shall be performed at Buckhorn, Eagle Pass, and Orland Buttes

Recreation Areas within the Black Butte Lake boundaries. The Buckhorn Recreation Area includes 92 campsites, group-use campground, two-lane boat ramp, day-use picnic area, shoreline access area, amphitheater, and nature trail. The Eagle Pass Recreation Area consists of: two-lane boat ramp, pedestrian shoreline access, and day use picnic tables. The Orland Buttes Campground consists of: 35 campsites, group-use campground, two-lane boat ramp, and nature trail. It is essential that the Contractor possess a vehicle in good working order to make trips between work locations and fulfill contract requirements.

2. SPECIAL CONSIDERATIONS

Contractor shall be knowledgeable and proficient in handling money, maintaining written records, performing math calculations and operating computers. The Contractor will need to encompass proficiency in the National Recreation Reservation System, and maintain successful performance as a campground fee collector with duties that include registering campers and informing visitors of Park Regulations. Contractor shall be capable of handling dissatisfied or difficult visitors in a respectful and courteous manner. Contractor shall comply with all requirements and instructions contained in the Campground Host Handbook. Contractor shall keep all campsite records and reports on the Buckhorn Recreation Area current and in an orderly manner in which to provide an efficient transfer of duties if relieved by an employee or subcontractor.

3. DEFINITIONS

As used throughout this document, the following terms shall have the meaning set forth below and other common sense considerations and industry standards.

3.1. Where "as shown", "as indicated", "as detailed", or words of similar importance are used, it shall be understood that reference is made to this specification and the drawings, if any, accompanying this specification unless stated otherwise.

3.2. Where "as directed," "as required," "as permitted," "approval," "acceptance," or words of similar importance are used, it shall be understood that direction, requirement, permission, approval, or acceptance of the Contracting Officer is intended unless stated otherwise.

3.3. Contractor. The term Contractor as used herein refers to both the prime Contractor and any subcontractors or personnel. The prime Contractor shall ensure that his/her subcontractors comply with the provisions of this contract.

3.4. Contracting Officer’s Representative (COR). The term is defined as the Government employee, appointed by the Contracting Officer, with limited authorities specific to this contract.

3.5. Quality Assurance (QA). A method used by the Government to provide some measure of control over the quality of purchased services received.

3.6. Quality Assurance Evaluator (QAE). The Government employee designated to evaluate the quality of services produced.

3.7. Contract Discrepancy Report (CDR). A CDR is issued to the Contractor when the Contractor is not meeting the limits of satisfactory performance.

4. CONTRACTOR’S QUALITY CONTROL PROGRAM

Contractor shall establish a complete Quality Control Program (QCP) for the performance requirements of this contract and shall provide a written copy to the Government no later than 30 days after contract award. Contractor shall maintain the QCP throughout the contract performance period;

and, at any time upon verbal or written request, shall provide a copy to the Government for review.

The QCP shall include as a minimum the following:

4.1. A method of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. Contractor shall use process control procedures and quality data analysis techniques.

4.2. Corrective action procedures for deficiencies and measures to prevent recurrence. The corrective actions will address the deficiency and an action to prevent future deficiencies. Additional inspection(s) are not considered a corrective action. The QCP shall be evaluated for adequacy and changed or updated by Contractor as a part of all corrective actions taken by Contractor.

5. GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)

This plan shall be used by the Government to assure that the work specified under this contract is being completed satisfactorily by Contractor, and that a viable QCP is in place. The QASP will consist of periodic inspections conducted by the COR or QAE. Payment analysis will be conducted by using the random, planned, 100% sampling methods, or validated complaint. However, the Government has the right to change or modify inspection methods at its discretion.

6. PERFORMANCE EVALUATION MEETINGS

Contractor shall meet with the COR as often as determined necessary by the Government. A mutual effort will be made to resolve any and all problems identified.

7. PERFORMANCE CRITERIA

Contractor shall respond to any complaints and/or ratings of poor performance within 5 calendar days after notification. The COR will require Contractor to explain, in writing, the cause of the discrepancy, and corrective action to obtain an acceptable level(s), and corrective action to preclude a recurring incidence of the problem.

8. REMEDIAL ACTIONS

8.1. The COR will verbally advise or give a written inspection report to Contractor of discrepancies the first time they occur and ask Contractor to correct the problem. A notation will be made on the COR checklist of the date and time the deficiency was discovered and the date and time Contractor was notified.

8.2. If the Government created any of the discrepancies, these will not be counted against Contractor’s performance. When the Government has caused Contractor to perform in an unsatisfactory manner, the COR will forward a written notice to the responsible organizational element requesting corrective action be taken.

8.3. When Contractor is not meeting the limits of satisfactory performance, a CDR will be issued to Contractor. The seriousness of the failures should govern whether to issue a CDR at the end of the period, or as soon as the limits of satisfactory performance are exceeded.

8.4. When a CDR is issued for a service, the Contracting Officer may decline payment until the performance issue is resolved.

8.5. If the Contractor does not achieve satisfactory performance by the end of the next period or agreed suspense date, another CDR will be issued and the appropriate invoice re-calculations will continue until performance issues are resolved.

8.6. A third CDR will be the cause for a Cure Notice. However, the Contracting Officer may issue a Cure Notice or Show Cause letter at any time he/she deems appropriate. Depending on the overall performance of Contractor, an unsatisfactory reply to the Cure Notice should require a Show Cause letter to be issued, followed by consideration of termination of the contract.

9. PAYMENT AND INVOICES

9.1. Estimated Quantity Line Items. All Section B Pricing Schedule Line Items with quantities are estimated-quantity Line Items. The quantities are estimated amounts and are not guaranteed amounts. Contractor will only be paid for work actually performed. At no time will Contractor exceed the estimated quantity on any estimated quantity Line Item. When the actual quantity of any Line Item reaches 85% of the estimated quantity on any estimated quantity Line Item, the Contractor will notify the Government’s Contract Specialist and the Technical Point of Contact (Technical POC) in writing by fax or e-mail within two calendar days. Once the Government is notified that the actual quantity has reached 85% of the estimated quantity on any Line Item and if the Government determines that the estimated quantity needs to be increased, Contractor will receive an official modification to the contract action signed by the Contracting Officer increasing the quantity and the amount obligated on the contract before Contractor will proceed to work over the existing estimated quantity. The modification will set the new estimated quantity that Contractor may not exceed without another modification.

PERFORMANCE WORK REQUIREMENTS SUMMARY

Attachment A

1. Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.

2. Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer.

The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the payment re-calculation determination.

3. COR Recommendation. The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.

4. Payment Determination. The Contracting Officer may meet with the COR to discuss the COR's report. The Contracting Officer will make a final determination in writing as to the percentage of work successfully completed, and the resulting payment to be made. A copy of the determination will be provided to the Contractor no later than 45 calendar days after the end of the period being evaluated.

All Contracting Officer decisions regarding payment re-calculations are unilateral decisions made solely at the discretion of the Government.

5. Payment Re-Calculations. Notwithstanding any other clause of this contract, payment re-calculations will be made within the later of 60 days after the end of the evaluation period or 30 days after receipt of an approved invoice.

6. The Quality Assurance Surveillance Plan is one evaluation method the government uses to surveillance performance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
