Single Source Justification US Army Corps of Engineers, Sacramento District FAR 13.106-1(b)(1), Simplified Acquisitions
1. Contracting Activity:
Requestor: Hydrologic Engineering Center, 609 Second Stret, Davis, CA. 95616
US Army Corps of Engineers, Supply & Services Branch, 1325 J St., Sacramento, CA 95814
2. Description of Action. The Nature Conservancy (TNC) will provide assistance to the Hydrologic Engineering Center (HEC), U.S. Army Corps of Engineers (USACE), in the teaching of the Hydrologic Analysis for Ecosystem Restoration Training Course.
Topics to be covered by TNC include Ecologically Sustainable Water Management (ESWM), the Sustainable Rivers Project (SRP), Indicators of Hydrologic Alteration (IHA), and TNC perspectives on Ecosystem Goods and Services (EGS). Each of these topics (ESWM, SRP, IHA, and EGS) are TNC initiatives that are essential to the content of the training course and can be suitably taught only by TNC.
This Performance Work Statement (PWS) details services to be provided by TNC in support of HEC’s training program. Work includes preparation and teaching of several lectures. The course agenda is attached to show TNC’s role and workload (attachment 1).
3. The rationale or circumstances for limiting competition. The lectures to be supplied include Ecologically Sustainable Water Management (ESWM), the Sustainable Rivers Project (SRP), and the Indicators of Hydrologic Alteration (IHA) software. Each of these topics (ESWM, SRP, and IHA) are TNC’s initiatives that are essential to the content of the training course and can be suitably taught only by TNC. FAR 6.30201, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. Citations: 10 U.S.C. 2304(c)(1). This requirement is a follow-on to previous Sole source awards: 1) W91238-16-P-0003; 2) W91238-14-P-0053; 3) W91238-13-P-0003; 4) W91238-11-P-0088; 5) W91238-11-P-0008.
4. Market Research (MR) A notification was posted to FEDBIZ OPPS, which resulted in no interest in the solicitation announcement. Based upon the last six years of sole source awards, and FEDBIZ postings, it is deemed, that no other company has the required knowledge necessary to deliver the material and lecture on the topics provided above. Also, the topics being lectured are TNC published proprietary initiatives. Therefore it is not cost-effective to the Government to procure the proprietary information. The Nature Conservancy (TNC) is the only suitable organization outside of the Federal Government with comprehensive knowledge of all required topics (ESWM, SRP, and IHA software), so conducting further market research could not possibly render any other source.
5. Price estimate, including options, if applicable. $100,000.00 ~ based on previous contractual awards.
6. Recommended source.
