1. SCOPE OF WORK

1.1. General Information. Contractor shall provide all labor, materials, equipment, supervision, supplies, and transportation necessary to perform all Recreational Attendant Services at Black Butte Lake, Tehama and Glenn Counties, CA. See Figure 1.

1.2. Site Visit. In no event shall a failure to inspect the site constitute grounds for a withdrawal of a quotation after the closing date and/or a claim after award of the contract.

1.3. Work Locations. Services shall be performed at Buckhorn, Eagle Pass, and Orland Buttes

Recreation Areas within the Black Butte Lake boundaries. The Buckhorn Recreation Area consists of: 92 campsites, group-use area, two-lane boat ramp, day-use picnic area, shoreline access area, amphitheater, and nature trail. The Eagle Pass Recreation Area consists of: two-lane boat ramp, pedestrian shoreline access, and day use picnic tables. The Orland Buttes Campground consists of:

35 campsites, group-use campground, two-lane boat ramp, and nature trail. It is essential that the Contractor possess a vehicle in good working order to make trips between work locations and fulfill contract requirements.

2. SPECIAL CONSIDERATIONS

Contractor shall be knowledgeable and proficient in handling money, maintaining written records, performing math calculations and operating computers. Contractor will provide the following evidence:

1) proficiency in the National Recreation Reservation System, 2) successful past performance as a campground fee collector with duties that included registering campers and informing visitors of Park Regulations. Contractor shall be capable of handling dissatisfied or difficult visitors in a respectful and courteous manner. Contractor shall comply with all requirements and instructions contained in the Campground Host Handbook. Contractor shall keep all campsite records and reports on the Buckhorn Recreational Area current and in an orderly manner in which to provide an efficient transfer of duties if relieved by an employee or subcontractor.

3. DEFINITIONS

As used throughout this document, the following terms shall have the meaning set forth below and other common sense considerations and industry standards.

3.1. Where "as shown", "as indicated", "as detailed", or words of similar importance are used, it shall be understood that reference is made to this specification and the drawings, if any, accompanying this specification unless stated otherwise.

3.2. Where "as directed," "as required," "as permitted," "approval," "acceptance," or words of similar importance are used, it shall be understood that direction, requirement, permission, approval, or acceptance of the Contracting Officer is intended unless stated otherwise.

3.3. Contractor. The term Contractor as used herein refers to both the prime Contractor and any subcontractors or personnel. The prime Contractor shall ensure that his/her subcontractors comply with the provisions of this contract.

3.4. Contracting Officer’s Representative (COR). The Government employee appointed by the Contracting Officer, with limited authorities specific to this contract.

3.5. Quality Assurance (QA). A method used by the Government to provide some measure of control over the quality of purchased services received.

3.6. Quality Assurance Evaluator (QAE). The Government employee designated to evaluate the quality of services produced.

3.7. Contract Discrepancy Report (CDR). See Attachment A – Performance Work Requirements

Summary.

4. CONTRACTOR’S QUALITY CONTROL PROGRAM

Contractor shall establish a complete Quality Control Program (QCP) for the performance requirements of this contract and shall provide a written copy to the Government no later than 30 days after contract award. Contractor shall maintain the QCP throughout the contract performance period;

and, at any time upon verbal or written request, shall provide a copy to the Government for review.

The QCP shall include as a minimum the following:

4.1. A method of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. Contractor shall use process control procedures and quality data analysis techniques.

4.2. Corrective action procedures for deficiencies and measures to prevent recurrence. The corrective actions will address the deficiency and an action to prevent future deficiencies. Additional inspection(s) are not considered a corrective action. The QCP shall be evaluated for adequacy and changed or updated by Contractor as a part of all corrective actions taken by Contractor.

5. GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)

This plan shall be used by the Government to assure that the work specified under this contract is being completed satisfactorily by Contractor, and that a viable QCP is in place. This plan is included for information purposes only and will not become part of any resulting contract. The QASP will consist of periodic inspections conducted by the COR or QAE. Payment analysis will be conducted by using the random, planned, 100% sampling methods, or validated complaint. However, the Government has the right to change or modify inspection methods at its discretion. Management Support Rating Criteria are included in Attachment D.

6. PERFORMANCE EVALUATION MEETINGS

Contractor shall meet with the COR as often as determined necessary by the Government. A mutual effort will be made to resolve any and all problems identified.

7. PERFORMANCE CRITERIA

Acceptable and unacceptable contract performance will be determined by the COR in accordance with

Attachment A – Performance Work Requirements Summary. When Contractor’s performance is considered to be unsatisfactory, a report shall be made to the COR to determine the deduction in price to be taken. Contractor shall respond to any complaints and/or ratings of poor performance within 5 calendar days after receipt of the report. The COR will require Contractor to explain, in writing, the cause of the discrepancy, and corrective action to obtain an acceptable level(s), and corrective action to preclude a recurring incidence of the problem. Contractor will not be paid for that portion of performance determined to be unsatisfactory by the COR.

8. REMEDIAL ACTIONS

8.1. The COR will verbally advise or give a written inspection report to Contractor of discrepancies the first time they occur and ask Contractor to correct the problem. A notation will be made on the COR checklist of the date and time the deficiency was discovered and the date and time Contractor was notified.

8.2. If the Government created any of the discrepancies, these will not be counted against Contractor’s performance. When the Government has caused Contractor to perform in an unsatisfactory manner, the COR will forward a written notice to the responsible organizational element requesting corrective action be taken.

8.3. When Contractor is not meeting the limits of satisfactory performance, a CDR will be issued to Contractor. The seriousness of the failures should govern whether to issue a CDR at the end of the period, or as soon as the limits of satisfactory performance are exceeded.

8.4. When a CDR is issued for a service, the Contracting Officer must deduct from the periodic payment, a percentage of that payment as indicated in the Performance of Work Requirements Summary, Attachment A.

8.5. If the Contractor does not achieve satisfactory performance by the end of the next period or agreed suspense date, another CDR will be issued and the appropriate amount deducted from the periodic payment in accordance with the disincentive rate listed in the Performance of Work Requirements Summary, Attachment A.

8.6. A third CDR will be the cause for a Cure Notice. However, the Contracting Officer may issue a Cure Notice or Show Cause letter at any time he/she deems appropriate. Depending on the overall performance of Contractor, an unsatisfactory reply to the Cure Notice should require a Show Cause letter to be issued, followed by consideration of termination of the contract.

9. PAYMENT AND INVOICES

9.1. Estimated Quantity Line Items. All Section B Pricing Schedule Line Items with quantities are estimated-quantity Line Items. The quantities are estimated amounts and are not guaranteed amounts. Contractor will only be paid for work actually performed. At no time will Contractor exceed the estimated quantity on any estimated quantity Line Item. Contractor will establish a tracking system of actual quantities against the contract’s estimated quantities for each estimated quantity Line Item and will maintain the tracking system up to date throughout the life of the contract. When the actual quantity of any Line Item reaches 85% of the estimated quantity on any estimated quantity Line Item, the Contractor will notify the Government’s Contract Specialist and the Technical Point of Contact (Technical POC) in writing by fax or e-mail within two calendar days. Once the Government is notified that the actual quantity has reached 85% of the estimated quantity on any Line Item and if the Government determines that the estimated quantity needs to be increased, Contractor will receive an official modification to the contract action signed by the Contracting Officer increasing the quantity and the amount obligated on the contract before Contractor will proceed to work over the existing estimated quantity. The modification will set the new estimated quantity that Contractor may not exceed without another modification

9.2. Invoices for payments shall be submitted upon completion of tasks as outlined in Section B, Pricing Schedule. Invoices shall include all necessary information, including any necessary supporting documentation required as part of this Performance Work Statement. All invoices must reflect the Contract; see Block 2 of the Standard Form 1449. The final invoice shall be marked “Final.”

9.3. In the event that any part or the entire park is permanently or temporarily closed, the segments of this contract pertaining to that area may not be required and therefore not utilized. Contractor shall not perform work in those closed areas or facilities that shall not be in use and shall not be compensated for work not accomplished.

9.4. Contractor's performance will be compared to Industry Standards and shall not exclude common sense considerations as may be applied by the COR. If the performance in any required service is unsatisfactory, and poor performance is clearly the fault of the Contractor, monthly payments to Contractor will be reduced by Contractor as deemed appropriate per bid sheet. In the event of continued unsatisfactory performance with documentation of three (3) incidences where correction and time to cure has been given, the entire recreational attendant contract may be terminated.

9.5. Invoices are to be submitted monthly in arrears, after services have been provided, to the addresses specified below. Contractor must deduct from invoice appropriately for deficiencies and/or no shows. Responsibility for providing an acceptable invoice to the Government for payment rests with Contractor. Incomplete or incorrect invoices are not acceptable and will be returned to Contractor for correction. Payment will be net 30 days after receipt of an invoice in a format acceptable to the Government and verified and approved by the COR and subject to routine processing requirements.

9.6. Contractor will provide an invoice on Contractor letterhead for services rendered. Each invoice will have a number/date and will include the following information:

9.6.1. Contractor name and address (same as stated in block 17a of contract)

10. ARMY CONTRACTOR MANPOWER REPORTING (CMR) REQUIREMENT

Contractor Manpower Reporting Application (CMRA) Version 3.0 is a business process for collecting information on contracts that provide services to the Department of the Army. The Army operates and maintains a secure data collection site where Contractors must report all Contractor manpower (including subcontractor manpower) required for performance of contracts subject to the CMR requirement. Unless this is a Blanket Purchase Agreement (BPA) or Indefinite Delivery type contract (IDC), all services procured under this contract are subject to the CMR requirement. Labor hours and associated labor costs will be treated as proprietary information when linked to Contractor’s name and the contract number.

10.1. Reporting is accomplished by direct data entry into a secure Army website found at https://cmra.army.mil . Contractors must register in this system. You are referred to the Contractor and Subcontractors Users Guides and the FAQ’s available at this website for detailed information and instructions pertaining to registration for and data entry into the CMRA system.

10.2. The CMRA Help Desk can be contacted for assistance by email

(contractormanpower@hqda.army.mil). Please note that other Government personnel (Contracting, Black Butte Lake, etc.) will not be able to answer questions related to the CMRA system. ALL questions pertaining to system registration, data entry problems, and other information technology-related issues or concerns must be directed to the CMRA Helpdesk.

10.3. Annual reporting is required. The data for each Government fiscal year (October 1st through

September 30th) must be entered no later than October 31st. If the contract action to which the CMR requirement applies overlaps two or more Government fiscal years, Contractor must prorate the labor hours and labor dollars accordingly.

10.4. There is a flow-down requirement to subcontractors providing applicable services. The prime

Contractor has overall responsibility for ensuring that their subcontractors timely enter their respective data.

10.5. Concurrent with or following the award of each contract subject to the reporting requirement, a

Contract Manpower Reporting Worksheet, Attachment C, will be provided to Contractor by the Government that lists data that must be entered.

10.6. A Contract Line Item Number (CLIN) will be included in the contract or order for each contract action to which the CMR requirement applies. The Contractor may elect to price or not-separately-price the CMR requirement.

10.7. The CMR requirement does not require a Contract Requirement List in the contract or order.

10.8. The CMR requirements are subject to change. Contractor will be responsible for complying with the reporting requirements specified on the CMRA website at the time the annual report is due, at no additional cost to the Government.

11. E-VERIFY

As of September 8, 2009, employers with federal contracts or subcontracts are required to use E-Verify to determine the employment eligibility of employees performing direct, substantial work under those federal contracts. The decision of the Contracting Officer as to serviceability of the equipment shall be final. Equipment shall meet current Federal, State and local safety requirements and all applicable requirements of the Corps of Engineers Safety Manual, EM 385-1-1.
