DETERMINATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SIMPLIFIED ACQUISITION PROCEDURES – BRAND NAME)

1. Contracting Activity:

U.S. Army Corps of Engineers, Huntington District, CELRH-CTD, 502 8th Street, Huntington, WV, 25701

2. Description of Action:

The action hereby submitted for approval is for a brand name procurement of the rental of a 386 Ton, lattice boom crawler crane with supporting equipment for the Regional Rivers Repair Fleet (R3F), Heavy Capacity Fleet (HCF) Derrick Boat 50 Woodie Walden. This will be provided and assembled by the contractor. The cost for the equipment exceeds Government Visa purchase thresholds. FY19 funds will be used for this contract.

3. Description of Supplies/Services:

The purpose of this procurement is for a vendor to provide a Manitowoc MLC300 crane and all accompanying equipment for rental for a time period of one year, with option periods up to an additional year. The total estimated cost of the rental including all options, is approximately including delivery, assembly, pickup, and disassembly.

4. Authority Cited:

FAR 13.106-1(b), 10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1(c) and DFARS 206.302-1, and FAR 6.302-1(c), as the existing conditions at the project location preclude consideration of products manufactured by another company. The Agency’s need is for brand-name commercial items.

5. Reason for Authority Cited:

The Derrick Boat 50 barge is being retrofitted due to the prior crane no longer being able to be used. The barge was custom designed when it was built; part of that customization is that there is only one crane type that will fit this boat: that is a Manitowoc brand crane. No other crane type will fit the barge. As a result, the abovementioned brand-name crane rental is the only crane that can satisfy the Heavy Capacity Fleet’s mission requirement.

6. Efforts to Obtain Competition:

In accordance with FAR 5.101 and 5.102, competition will be obtained by posting a solicitation to Federal Business Opportunities (FBO) to allow all interested vendors to

LRH Control No. 19-0020 submit quotes for the required products. Vendors will be provided no less than five

(5) calendar days to submit quotes. It has been determined it is in the best interest of the Government to consider offers from small and large businesses in order to maximize competition.

7. Actions to Increase Competition:

As stated in Number 6 above, this procurement will be solicited unrestricted via FBO to allow for maximum practicable competition. No actions have been taken to further increase competition.

8. Market Research:

Market research was conducted by the R3F HCF Plant Manager to determine fair estimates for the parts and by the Purchasing Agent to determine small business capability. Based on the market research, there are no other systems by others manufacturers that will meet the mission requirements.

9. Interested Sources:

Several vendors have expressed interest in this procurement. To date, no other sources have been explored.
